Senate File 2039 violates Article III, Section 1 of the Iowa constitution (separation of powers). You may want to change it, but I believe it would require a constitutional amendment, which to the best of my knowledge you have not proposed. Rep. Thomson, as an attorney, is heavily involved in the Republican Legislative Intervenors for Justice, which intervened in the Summit Carbon matter. Rep. Holt is also involved. It is my belief that all members of this group, the Free Soil Foundation, and the Dauntless Dozen have potential conflicts of interests. If any legislators have received funding related to their stance opposing eminent domain protections, then this may fall under Iowa Code section 68B.2A. I ask that you recuse yourselves from this matter as appropriate.

Vote NO on SF 2039. We have separate branches with their own powers for a reason, and this violation of them seems illconsidered and illfounded.
