House File 843 is identical to Senate File 546. IA Code ch 458A was secretly amended by the legislature in 2024 to add naturally occurring gasses to the definition of gas, which includes CO2 from fermented corn. In my opinion, in conjunction with House File 2104 (under amendment S5002), the legislature's amendment of IA Code ch 458A in 2024 and the draconian adjustments to that same chapter in HF 843 set the table for what is referred to as Phase 2 of the Summit Carbon project. Under amendment S5002, eminent domain is now banned: "Land within the voluntary easement corridor shall not be subject to eminent domain." (p.3) The same bill expands the voluntary easement corridor to entire counties, contiguously encompassing millions and millions of acres. (p.1) Former Pennsylvania Governor Tom Corbett termed forced pooling to be a form of "private eminent domain." This will involve tax credits, which means there should be zero confidentiality. An absolute disgrace.
