I am a farmer and landowner impacted by Phase 1 of Summit's CO2 pipeline.I am asking that you please support HF2104. This bill does NOT stop pipelines from being built and it does NOT impact other infrastructure projects. It just ensures property rights are protected by allowing landowners to say yes or no. It levels the playing field when negotiating easements by removing the threat of eminent domain. There are over 800 parcels that are targeted by eminent domain on Phase 1. Eminent domain is suppose to be a last resort. With that many parcels on that list how can that be called a last resort?Everyone should have property rights protection as per the Constitution. That is what this bill doesgive property rights protection to those targeted by a CO2 pipeline but it does NOT stop the project. Project can continue.PLEASE SUPPORT HF2104 so all property owners in the state of Iowa can have property rights protection.

This bill will not stop the CO2 pipeline , but it will allow landowners caught in whatever size corridor to say, No Thank You to a CO2 pipeline on their property as the Iowa constitution and both party platforms support. The governor wanted a short clean bill. HF2104 meets that standard. Farmers have no assurances of higher prices for corn as the 45q tax credit is a credit for ethanol plants. There has been no evidence of how much or if any of that savings would be passed on to corn producers. The ethanol from a plant with a carbon pipeline is no different from a plant without one. The only difference is the availability of the $85/ ton tax subsidy from taxes paid to the Federal Government which will line the pockets of billionaires. Allow landowners to say NO to this scam by Voting YES on HF2104!

We are located in Shelby County with affected land directly adjacent to US44, north and south side. The proposed route will completely bisect our property. I am now living in the house I grew up injust over the hill from the proposed hazardous pipeline route. My siblings and I feel it is our right to decide what we do with our propertythat a private company for private gain should not be allowed to wrest that away from us. This bill does NOT stop the pipeline. It does NOT stop the potential for "jobs". It does NOT affect other pipelines/ other products. Those legislators who are listening to the Summit and Union PR are misinformed. Summit said long ago that they would hire a "few" locals, but the pipe itself would be built by "specialized crews brought in from outofstate". Even the monitoring will be done out of state. What does this bill DO? It simply stops the use of eminent domain for a pipeline carrying a carbon oxide material. THIS DOES NOT STOP THE PIPELINE. IT DOES STOP THE MISUSE OF EMINENT DOMAIN and it DOES STOP THE EROSION OF PROPERTY RIGHTS. Think about the longterm ramifications of allowing ED for this do not set a very ugly precedent. I'm asking you to vote yes on HF 2104 that bans eminent domain for a carbon dioxide pipeline. This bill would not impact other pipelines and would not prevent Summit from building their pipeline. Summit can still get voluntary easements and build their pipeline. Carbon dioxide pipelines would just not be able to violate landowner rights and take land by eminent domain for a carbon dioxide pipeline. We are landowners in Worth County and one of our farms will be affected by Summits pipeline. We bought this farm in 1980 right before the beginning of the 80s farm crisis and worked 30 years to pay for it. We have invested thousands of dollars to pattern tile it and have been good stewards of the land which has resulted in making it a highly productive farm. All of our corn is marketed through local ethanol plants and we have a large investment in ethanol plants. The ethanol plants were profitable again in 2025 and set records for weekly corn usage in 2025. There are other means available to the ethanol plants to reduce their carbon index score to make them eligible for 45Z tax credits without the use of a pipeline. By supporting HF2104 which will eliminate the use of eminent domain for CO2 pipelines, this will not prevent Summit from going forward with their project by obtaining voluntary easements.Our farming operation generates jobs in manufacturing equipment, chemicals and fertilizer, seed, and grain processing, as well as seasonal employees in our operation.Should pipelines that transport CO2 to other states for the primary purpose of profiting pipeline investors be given the extreme power of eminent domain? We should not have to negotiate our Constitutional rights. We feel that we should have the right to say no to Summit just as our neighbors have the right to say yes. With over 1,300 miles of hazardous CO2 pipelines, nearly 850 parcels of land are facing condemnation for Summit Carbon Solutions proposed CO2 pipeline, with hundreds of additional landowners and tenants living with the threat of eminent domain from an expansion plan for the proposed pipeline.Landowners are advocating for straightforward, commonsense legislation to be passed in 2026: a bill to prohibit the use of eminent domain for carbon dioxide pipelines. Short, clear, unambiguous, focused! It would not ban carbon pipelines, and it would not affect other types of infrastructure. Instead, it would remove eminent domain authority for privately owned CO pipelines to allow for a fair negotiation process. Companies could still build carbon pipelines simply by reaching agreements with landowners who are willing participants. Voluntary easement should be easy to get based on support Summit claims from leaders of corn growers, ethanol plants, and some unions! Especially with the county wide notification corridors in sf2067! I support Statewide Notification Corridors! I know the Biofuel plants that get my Corn and Soybean crops are experiencing Record Profits without Eminent Domain! Even the Federal Government pulled E15 out of the current must pass Bills which shows lack of support for ethanol. The Governor asked for a much more focused and shorted bill in her veto last year. SF2107 certainly does NOT meet that expectation. (The bill) isnt just about eminent domain. It goes much further and in doing so sets a troubling precedent that threatens Iowas energy reliability, economy and reputation as a place where businesses can invest with confidence, Reynolds said in the statement. Bottom Line: Its time for Results satisfactory to ALL!! Senator Klimesh should work with the House on a new bill to address his perceived Corridor shortcomings and include the contents of HF2104. That would be a middle ground approach that enhances landowner rights and protections but would allow (carbon capture and sequestration) projects a path forward. As Monte Shaw, Renewable Fuels Association Leader, requested in his response to the Governors veto last year.HF 2104 is focused, short, and only about Eminent Domain for the CO2 issue! Passage and signed by the Governor, HF2104 will open up the state to clear voluntary easements for CO2 and improve Iowas energy reliability, economy and reputation as a place where businesses can invest with confidence just like it has in other states. My name is Don Johannsen and I am a phase 1 landowner from Cherokee county. I am deeply concerned about the Summit carbon pipeline and the use of eminent domain. While proponents highlight benefits to the state and local governments, the voices of those most affectedlandownersare often overlooked. Per the exhibit F form submitted to the IUC, Summit expects to capture nearly 30 million tonnes of CO annually, earning $85/ tonne in 45Q tax credits and $105/ tonne in carbon credit resulting in a total of $5.7 billion dollars per year. Over the 1072 mile length of pipeline in Iowa this translates to an income of $1,000 per foot of pipeline each year. How much of this will I as a landowner receive in compensation?I will receive compensation in two forms, the initial purchase price of the easement and the yearly incentive payment proposed by Summit.For the easement Summit has offered me a onetime payment of $35,200 for the easement and three years of crop loss. For the incentive, Cherokee County at an 80% voluntary sign up rate would result in an incentive payment of $0.31/ foot. For the 1477 foot length of my easement this would result in yearly payments of $460.Combining these values over a 30 year period (the expected life of the pipeline) would result in a total payment to me of $49,000, the equivalent of $1.10 per foot per year.For comparison:Summit will make $1000/ foot on my 1477 foot easement; I will be paid $1.10/ foot.Over the length of my easement Summit will make $1.5 million per year, I will be paid $1,600.Over a 30 year period Summit will make $45 million, I will be paid a total of $49,000.What rational landowner would ever sign such an unfair one sided agreement only to end up with a hazardous pipeline crossing through the heart of my farm at odd angles?Summit has claimed it cannot obtain a corridor without eminent domain. This has been proven to be false. Tallgrass obtained a corridor in Nebraska without eminent domain and Summit has obtained a corridor in Minnesota without eminent domain. A comparison of the route Summit proposed in Minnesota versus the final route is telling. The proposed route was a straight diagonal line crossing southern Minnesota going through farms at odd angles. The final negotiated route contains large lengths of north/ south and east/ west segments. This is important because this allows farmers to place the pipe along the fence line adjacent to the road. This provides the access to the pipeline that Summit needs, it does not cross through tile fields or over terraces, it provides rectangular fields that can accommodate large farm equipment and most importantly, it eliminates the need for farmers to farm over the pipe. It provides a workable solution for both Summit and the Landowner.In the fall of 2023 150 landowners testified at the IUC hearing in Fort Dodge. As part of our testimony we were required to suggest an alternate route which we all did. The changes requested would have added only a few hundred feet to the route but Summit rejected all but a handful of the 150 requests. With the proposed 10 mile corridor are we to believe that Summit will now be willing reroute over a 10 mile distance when they have repeatedly rejected requests for only a few hundred feet? Summit has proven they will never do this.Summit has had 4 years to behave as a responsible partner with landowners and has repeatedly refused to do so. As long as Summit has the right of eminent domain they will never offer fair compensation or reasonable routing to landowners. Their actions over the last four years is proof of that,If they want to build pipelines that is fine, HF2104 does not prohibit carbon pipelines, it just requires pipeline companies to offer landowners fair and just compensation and the ability to negotiate workable routing.HF2104 provides landowners with the protection they need.I would urge the senate to support passage of HF2104.Don Johannsen

Senator Bousselot said he would sign a clean bill disallowing eminent domain for carbon pipelines, but HF639 was too complicated. Well, this new bill, HF2104, is exactly what they ordered! Remember June 2025, when the Governor vetoed HF639, stating she wanted "a clean bill." Well, THIS IS IT. Farms employ many people in Iowa, while CO2 pipeline Union jobs will most likely go to people who come from outofstate and are not contributing significantly to Iowa's economy. HF 2104 is a "clean" and "simple" bill so there's no reason to not pass it out of subcommittee. It fulfills requests made by several Senators and the Governor when they worked against a previous property rights protective bill last year, so again, please do what's right and pass HF 2104.

Please advance HF2104. Governor Reynolds requested a clean bill and it doesn't get cleaner than this. This bill is a win win for both land owners and Summit. The bill sent to the Senate last year, was criticized as being too complicated and having unintended consequences. We now have three bills before us. One has pages of text and outlines a plethora of rules and regulations. Another legislates charging fees, but fails to outline the details of monitoring and oversight. The new legislative session at the state capitol began January 12, 2026. You would think there would be so many new issues brought forth. But, for land owners, we are still fighting for our property rights. It has been 5 years now since we received our first packet from Navigator, Heartland Greenway notifying us of their intention of burying a hazardous CO2 pipeline through 120 acres of our home farm. How can this be when our federal and state constitutions protect us from eminent domain for private gain?On January 21st, the House of Representatives passed HF 2104 stating, No Eminent Domain for Carbon Dioxide pipelines. We fully support this bill. This is the same bill that South Dakota passed in March of 2025. It does not ban CO2 pipelines. SCS just has to acquire 100% voluntary easements. HF2104 has been expedited to the senate. We absolutely support this bill. So called farmer groups such as Iowa Farmers Union and Iowa Farm Bureau Federation have taken a stand protecting farmers against eminent domain by carbon pipelines. The Iowa Corn Growers Association is promoting CCS. The primary reason is to increase the profitability and demand for corn and reduce the carbon intensity of ethanol. They will not protect the farmers land and/or legacy. What I find interesting is the company behind constructing the CO2 pipelines in Iowa and the Midwest is also the same company in South America who is one of our biggest competitors of ethanol production. Summit Agricultural Group bought land and began growing corn in Brazil in 2012. Raising corn in Brazil is favorable due to longer growing seasons, optimal climate and the ability to double crop. Summit Agriculture Group opened their first corn based ethanol plant in 2017. Today, summit produces 600 million gallons annually. Compare to Iowa ethanol production of 4.7 billion gallons annually. Our corn markets and ethanol markets are driven by supply and demand. As Iowa companies produce corn and ethanol in Brazil, that decreases our demand in iowa and the world. Corn production in Brazil is approximately 1/3 of the US production. I am not willing to give up my land to help Summit Agriculture Group promote their monopoly. A carbon dioxide pipeline carries a lethal, odorless asphyxiant that is vastly different from traditional oil or gas; in this case, proximity is everything. It is important to note that a landowner with no family or neighbors living near the proposed Summit CO2 pipeline route has a very different perspective than those of us obligated to consider the welfare of families living next tooften within mere hundreds of feeta CO2 line proposed for our property. We feel a deep responsibility for these people, who were allowed no say in this process and whose safety is now being compromised.We pleaded with Summit and the IUC to adjust the route to protect these households, but our requests were ignored. Our liberties we prize, and our rights we will maintain. If you read those words, then repeat them, there is a sense of freedom and protection. However, many of the farmers/landowners have felt a sense of extreme disappointment in the sense that our rights have been taken from us. The right to say "NO" has not been honored. In fact, eminent domain has become a weapon against us. "All of your neighbors have signed," "You need to sign or we'll take it," and "We're going to get it anyway, so sign and make more money" are all words that we have heard. Our family has owned our land for over 126 years. Family history, our legacy, and memories are rooted in this land. Decades of notill has improved and enhanced the topsoil of a highly erodible piece of land. Caring for the land started as soon as the deed was signed and has continued all these years. Promises of continued care were made with our Grandma and our Dad on their deathbeds. It is a promise that we continue to try and keep.Please support HF 2104 as submitted by the House. This is a simple and fair bill. It does NOT prevent the pipeline from being built. It does give us the right to say "no" and keep our land from erosion, compaction, and reduced yields for many years. When Governor Reynolds vetoed HF 639 in June 2025, she stated I respect both sides of that debate. Ive consistently said that if eminent domain is used, it must be rare, fair, and a last resort.... While I share the bills goal of protecting landowners, good policy should draw clear careful lines. This bill doesnt." HF 2104 does fit the bill she wanted. Clean and simple. Eminent domain kept in check for the farmers/landowners that do not want this pipeline going through their land.The sixth and seventh generations are waiting in the wings to take their place on our family's land. Without property rights protection, we will be handing them land with a hazardous pipeline buried in it, a forever easement, and absolutely no liability insurance to cover a break, rupture, or leak that could lead to a total loss of the family land and litigation that would individually bankrupt all of them. We should not have to assume all the risk and lose our land for a company that has NEVER built a pipeline, advertised that they would pursue voluntary easements, and continues to promise more than they can deliver.

Please see attached. This legislative body is or should be aware that three wells have been established in Webster County near Vincent, Iowa. The first was established in 2022. It is my understanding that they are near Vincent, which is near the Summit Carbon pipeline route. They are named Van Diest 143, Van Diest 143A, and Van Diest 90272322 according to Noah Poppelreiter of the Iowa Department of Natural Resources. I do not know if this is his property, but a Robert Van Diest testified at the Summit Carbon hearings held in Fort Dodge in 2023. In 2024, this legislative body secretly amended Iowa Code chapter 458A, which includes forced pooling statutes (458A.8), to include naturally occurring gas, which includes CO2 produced from corn fermentation. The attachment explains more. If you vote to deny eminent domain protections when some members of the legislature have actively campaigned that this action will protect Iowans from seizure of their property without just compensation determined by a jury and will give them the opportunity to say no, then I believe you will be deceiving the masses, and that it will materially harm them. If these wells will be used to inject CO2 underground to potentially create hydrogen and other forms of fuel in Iowa and potentially mine for critical minerals and forced pooling statutes are employed, then all of the language in Senate File 2069 is meaningless and grossly misleading, because the Iowa Utilities Commission does not oversee the forced pooling statutes. In my opinion, the same thing is happening in South Dakota. If you pass this bill, and others currently at play, in my opinion, you are violating your oath to uphold the Iowa and U.S. Constitutions. Summit Carbon Solutions will be heavily funded by the government. Much of its proposed activities have been heavily funded by the government. The first article I wrote about this in 2023 documented a plane owned by Summit Ag making regular flights in Alaska. I believe this is a federally funded and supported project.
