Forcing local police to assist ICE is a bad idea. Right now federal immigration enforcement actions including a surge of agents in places like Minneapolis that has led to deadly and violent encounters with civilians and huge protests are already making people afraid to interact with local police and eroding trust in law enforcement. Immigration enforcement is a federal responsibility, and making local departments do it raises constitutional and liability issues, diverts limited local resources from real public safety needs, and shifts federal costs onto local taxpayers. Communities are safer when people trust police, not fear them.

The proposed additional language to be added to already existing law is too broad and unnecessary. The existing law provides for cooperating with immigration retainer and LEGAL documents. Our local police have worked hard to establish good relationships and trust in the community. This bill would erode those positive efforts. Please vote NO on House File 2041.

Unfortunately, ICE tactics are brutalizing people and also detaining too many US citizens who are later released. ICE agents have proven themselves untrustworthy and cruel and don't have nearly the amount of training as local and state law enforcement. This bill would erode public trust in local and state law enforcement, something that is very much needed in order to keep our communities safe. I oppose this bill.

In no way should my states law enforcement be using my tax dollars to work with a federal agency. Especially an agency that has now shown itself to completely disregard our constitutional rights. Claiming the ability to enter homes without a warrant, shown to arrest citizens on a consistent basis, asking citizens for papers, and have now killed 2 citizens in less than 10 days. If they want cooperation they need to get their agents better trained in the constitution and how to implement deportation in a humane way. At no time should they be masked and attacking people in grocery stores, schools etc. this type of behavior puts ALL Iowans at risk. These rules should written, agreed upon and enforced otherwise they will not follow them as theyve already shown time and time again.

Local law enforcement should not be compelled by state law to comply with a federal agency. This bill is gross submission and abdication of authority for the sole purpose of partisan loyalties. If Immigration and Customs Enforcement agents are complying with the law, there's no reason for a specific act requiring cooperation. I believe this bill is fully unnecessary and overly vague. Police officials will already presently comply with request from ICE as legally required. It also goes so far as to say "shall fully comply with any instruction made in the detainer request and in any other legal document provided by a federal agency". This does not account for any illegal instructions or incorrectly issued instructions and would potentially force police to comply with them in those cases as well. This would be obviously harmful for citizens, the police, and the government as well. Please vote No on this bill.

As the spouse of a law enforcement officer, I plead with our legislators not to pass this bill. This is utterly appalling to even propose. Local police departments are here to serve and PROTECT their communities. That holds true regardless of the standing POTUS or any federal agenda. These officers should not be expected to bow to the whims of ICE agents who do not care about the residents and have no connection to these communities. Forcing police officers to abide by the demands of agents who are often times less trained than they are will put local officers into greater danger by breaking hard won trust with those they serve, and that trust will remain broken long after ICE leaves. Please do not force officers to engage in border enforcement that they never intended to be a part of, and do not push officers out by forcing this agenda on them.

I am writing today in the wake of the second deadly shooting by ICE agents in Minneapolis. As your constituent, I am angry, and I'm scared. I look to you now to help provide the means by which Iowans can be protected from ICE, which has shown a total disregard for following law and order. I ask you to propose the following amendment to HF2041.Amendment: ICE shall carry no means of lethal force while operating within the jurisdiction of the State of Iowa. If ICE is serving a warrant for a known dangerous individual, they shall request assistance from local or county law enforcement agencies.If we are going to force local authorities to assist ICE, we should do so in the most beneficial way for the communities. The purpose of ICE is to serve warrants for humans suspected of committing the civil offense of being in the US illegally. Local law enforcement agencies know their communities best and should be leading any enforcement activities. We should not accept ICE raiding our towns and neighborhoods free from oversight or consequence.ICE has proven that they are not responsible when using lethal force; therefore, to guarantee the safety of Iowans, ICE should not be allowed to carry lethal force within our borders. ICE agents found in violation of this should be arrested by local, county, or state authorities and charged as outlined by Chapter 724.3 of Iowa Code 2026.Without this amendment, I urge you to vote NO on HF2041.I recognize the potential inability of state governments to regulate the practices of the federal government; however, with people dying at the hands of federal officers, now is not the time for formalities. As citizens, we look to our elected leaders to be the checks and balances of an outofcontrol government that fails to serve its people. I oppose this legislation being introduced. It remains vague and requires a more collaborative relationship between the Federal and local law enforcement agencies. Law needs to include prior notification to local law enforcement and a warrant or court order to attempt to pick up and detain the targeted subject. Local law enforcement should be present to ensure the local and state laws are abided by. There needs to be an addition in the state law to ensure that there is in fact a federal warrant for the targeted subject before the resident is even considered to be picked up. The top focus of Iowa legislators should be to protect it's citizens and only when there is a clear documented cause for arrest is presented. This ensures there is no exception for non violent residents being subjected to search and seizure without identified laws being broken while protecting the public. Without these considerations, there is no protection for any resident or citizen of this state.

If what we have seen in Chicago, LA, Portland and most recently Minneapolis are any indication of how they operate, no thanks. I am writing you today in opposition to HF 2041, a bill related to state law enforcement cooperation with federal immigration and customs enforcement. The world has watched the result of federal government overstep in Minneapolis since ICE agents were deployed there. We have seen the murder of two members of the Minneapolis community, Renee Good and Alex Pretti, because of this invasion/occupation of Minneapolis. Lets be frank: this was NEVER about detaining undocumented immigrants. If that were the case, ICEs presence would have been in Iowa and not Minneapolis. Not only does ICE have a record of raiding entire communities, such as when the raided Postville, IA in 2008, but there are multiple targets in Iowa that are wellknown to the public. We are home to multiple factories that employ immigrants, such as Tyson Foods in Columbus Junction, IA, and many communities are built on the backs of migrant workers, including the town of Williamsburg, where I grew up. There are countless farms that employ immigrants in our state, which is widely known for our agricultural production. Im not telling you anything you do not know this was never about immigrants. The occupation of Minneapolis is a political movement against a state that has voted against ideals and laws presented in Washington DC. Over the weekend, Kristi Noem said it clearly: ICE will leave if you give us your voting records. This is about voter suppression as we head into a critical midterm year. If this were about immigrants, Iowa would have been invaded and occupied by ICE, but it hasnt been because Iowas elected officials have supported what is happening in Washington DC, whether they believe in it or not. Put simply: Minnesota is a blue state; Iowa is a red state. Like Minnesota, I believe Iowans have a strong sense of community. I believe if this were happening in our state, we would be in the streets protesting. We would be taking care of each other by bringing meals to folks who are afraid to leave their homes. We would be making sure the unconstitutional use of power was being recorded. I am terrified of this happening in our state. With protection from the Federal Government, ICE is currently raiding homes without signed JUDICIAL warrants. HF 2041 specifically notes, that if passed, law enforcement agencies would have to go along with, any instruction made in the detainer request or other legal document provided by a federal agency. With protection from the Federal Government, ICE is currently provided with IMMUNITY following the deaths of two community members at their hands. My spouse was in law enforcement when a weapon is discharged, and somebody dies, there is always an investigation. This should apply to ICE as well. And finally, with protection and support from the Federal Government, ICE is currently stopping, detaining, gassing, and pepper spraying PEACEFUL PROTESTERS. Alex Pretti had a permit to carry a weapon. He was helping a community member who was sprayed by pepper spray in the face. He was not attempting to harm the officers, and he never drew his weapon. He was disarmed. And after all of this, he was shot multiple times. And all of this has been said to be because he brought a firearm, so it wasnt considered peaceful protest. If individuals wish to work for ICE and do the disgusting work they are doing, that should be their choice. Law enforcement agencies are supposed to serve and protect the citizens of their jurisdiction. They are not soldiers in the army they are policemen and women. The federal government should not be able to force them to comply with ICE as ICE continues to perform unconstitutional acts because that is neither serving, nor protecting us as Iowans. It is only putting us in further danger. The timing of this bill doesnt seem coincidental as we continue to watch our neighbors up north resist occupation. The folks you intend to have local police arrest could very well be US citizens, and Immigration and Customs Enforcement (ICE) may be too lazy, or too poorly trained, to know who has committed crimes and who hasn't, as we have seen in their bungled raids in Minnesota and other states. As I said before, I am in FAVOR of this bill. I am appalled some of the ignorant, misinformed, and hateful statements that have been made here. Minnesota officials have caused these issues because it is a sanctuary state and refuses to aid ICE in arresting illegal immigrants that are criminals and are actively encouraging violent interference. I have seen that some have had deportation orders for a long time. Minnesota officials have encouraged rioting and harassing federal law enforcement officials who are trying to do their lawful jobs. Sadly, two people were killed and another wounded because they were not obeying orders given by law enforcement. All the facts are not out yet at this time. I disagreed with statements made after the fact by both sides before the investigation was even under way. However, the outcome, the fact remains, had these people been protesting peacefully and not interfering as they claimed, they would still be alive. I have numerous videos of the so call "peaceful protests". Truthfully, I am surprised how patient the border patrol and ICE officials have been. I don't want this repeated in Iowa because we want to copy Minnesota. Obama deported far more people than have been deported with the same ICE leader (who also was given an award) and we did not see this behavior by any states.

Under current law, cooperation with federal agencies is allowed, but local officials can consider community needs, resources, and priorities before deciding how to respond. This bill shifts that choice from locally elected sheriffs and city leadership to a blanket statewide mandate.For many community members, particularly immigrants and mixedstatus families, mandatory cooperation with ICE could deter people from reporting crimes, seeking help, or cooperating with investigations. As a United Methodist, I affirm the dignity, worth, and rights of all people, and this bill appears to be part of an effort to intentionally demonize, dehumanize, and strip the dignity of those who are migrants, immigrants, and refugees. I have watched with sadness as the presence of ICE in other communities has not only made them less safe, but has resulted in violence and deaths. The response to speech has been pepper spray, and nonviolent protests where met with violence that as repeatedly resulted in injuries and several tragic deaths. Law enforcement agencies already have the option to voluntarily enter into formal agreements to cooperate with ICE, and it is telling that in Iowa of only the Dept of Public Safety and one county sheriff's ofice have opted to do so. Requiring local law enforcement to "cooperate" with ICE, whatever that is supposed to mean, would not only divert resources away from carrying out their mission of keeping their communities safe, but erode the often hard won trust they have worked to develop with immigrant, migrant, and refugee members within their communities, making it less likely they will engage with law enforcement when they are the victims of crime or are aware of criminal activity, making everyone less safe.

The bill is overly broad and vague. As drafted the bill is applicable to at least 8 state law enforcement agencies, all city police departments and county sheriffs offices and the police departments of state colleges and universities. The bill is vague as there is no definition of cooperate and work with. Who is the judge of whether a law enforcement agency has cooperated or worked with? It is also noteworthy that under the bill law enforcement is required to act when requested. As written, Iowa law enforcement agencies are not permitted to consider their public safety priorities to serve and protect Iowa citizens but to act at the whim of a federal agency that does not know or understand the needs of Iowa citizens.Iowa law enforcement personnel are trained to comply with Iowa and US constitutional requirements, as well as Iowa statutes. According to credible news sources, a secret memorandum was issued directing ICE to violate the 4th Amendment. What happens under the proposed legislation when ICE directs Iowa law enforcement agencies and officers to violate state and/or federal constitutional protections? Placing Iowa law enforcement officers in the untenable position of violating the constitutional rights of Iowa residents is abhorrent.Consider what is happening in Minneapolis. If similar activity were happening in Des Moines and the current legislation were enacted and ICE requested all Des Moines police officers, Iowa Capitol Police and other law enforcement to support them, what does that means to the residents of Des Moines? State and local law enforcement should be able to exercise their discretion when and how to cooperate with federal immigration and customs enforcement. In many cases it will not be in the best interest of a community or its residents for local law enforcement to participate. From what we are seeing in Minnesota, local lawenforcement might actually need to protect residents from violence perpetrated by federal agents. Iowa law enforcement should not be required to cooperate when those federal agencies have been acting lawlessly. When there is an actual criminal involved, state and local lawenforcement will always cooperate. Beyond that circumstances matter, and those with knowledge of the community should exercise their best judgment. Federal agents also should be required to show their face and identify themselves for public safety reasons. They must be held accountable when theyre acting violently and/or recklessly, and for violating civil rights. This has been a huge problem in Minnesota, Portland, Chicago, etc.

ICE claims to be arresting dangerous criminals, but most of what I see is ICE arresting people doing their jobs, going to school, raising their families, and otherwise living normal, lawabiding lives. Even their own arrest statistics show that a majority of the people they arrest are not the "worst of the worst" as they claim, but in fact they have never been convicted of a crime at all. If that wasn't bad enough, ICE shot a woman whose last words were "I'm not mad," then lied and called her a domestic terrorist, and refused to even investigate the incident or allow state officials to do so. They shot a man 12 times as he tried to help a woman who had been pushed down by an ICE agent, then lied and called him a domestic terrorist and a wouldbe assassin, and now they refuse to even identify the officer who shot him or investigate the incident. ICE is ignoring the Bill of Rights granted by our Constitution. They ignore the first amendment when they pepper spray, tear gas, beat, arrest, and shoot people who are legally protesting their actions. They ignore the fourth amendment when they repeatedly enter private homes and businesses without a judicial warrant. They ignore the fifth amendment when they prevent those they arrest from accessing a lawyer and then deport them before they can have a chance to contest their deportation.These are not the actions of a responsible, lawabiding federal agency. I would ask that all parties vote NO on this bill and save everyone's time and effort from letting this move out of subcommittee. There is simply no appetite in the state for federalizing our LOCAL law enforcement agencies. The federal agencies such as ICE/DHS have very large federal budgets. They do not need to create undue burden on local law enforcement agencies and local budgets. At no point in the bill does it define what fully cooperate with ICE means. It lays no penalties for lack of cooperation. There is no funding mandate that says where local law enforcement agencies would be reimbursed for manhours given to ICE/DHS tasks so presumably local tax payers are on the hook for their local officers being federalized. Any time sheriffs, police officers or other LEO's spend aiding ICE is time not spent on local crimes or the daily tasks these officers already have. Not only does that not make residents safer, it actually makes them less safe by removing local law enforcement from local duties. Local law enforcement is already a tough job. Many are overworked. We do not need to add more of a burden to these officers. Federal agents are tasked with handling immigration enforcement. There is simply no need to shift that burden from already well funded federal agencies onto the backs of local agencies. This bill seems poorly thought out, poorly written, and extremely vague. This bill also does not address any legal liability if local officers are tasked with tasks by ICE that may or do violate constitutional rights. Nowhere does it say where liability of a lawsuit would land. Is that with the federal agency? The state itself? Or the local police, sheriff's office or other local agency that is tasked with helping ice. If a US citizen or someone else is wrongfully detained by ICE and a county sheriff is forced to jail them due to this bill does that mean all legal liability shifts to that county jail (Sheriff's office)? Our local officers have made an oath to protect and serve our communities. How could they keep that oath while working with immigration and customs enforcement officers. This bill would expose our city and county to significant legal liability by requiring officers to hold people past when they should otherwise be released simply because ICE requests it. In cases like Roy v. Los Angeles County ($14 M settlement), the Suffolk County detention lawsuit (over $100 M jury verdict), and the Allegheny County case ($25 K for wrongful detention), local governments ended up paying out millions in damages for unlawful postrelease detentions at ICEs request. As a citizen, I do not want my tax dollars spent on constitutional settlements because our governor wants to please the current federal administration.

I think it is quite evident that we as American citizens need protection from ice and border control. Our state and local police are meant to serve the public from criminal offenders. U.S. Immigration and Customs Enforcement are enforcing civil matters at a federal level which should include due process for anyone on US soil. I look to you now to help provide the means to which lowans can be protected from ICE, who has shown total disregard to following law and order. Forcing local police to assist ICE is a bad idea. Right now federal immigration enforcement actions including a surge of agents in places like Minneapolis that has led to deadly and violent encounters with civilians and huge protests are already making people afraid to interact with local police and eroding trust in law enforcement. Immigration enforcement is a federal responsibility, and making local departments do it raises constitutional and liability issues, diverts limited local resources from real public safety needs, and shifts federal costs onto local taxpayers. Communities are safer when people trust police, not fear them
