Being a Summitimpacted landowner on "Phase I" (original docket 20210001), and an intervenor in the permit proceedings, I have experienced directly the actions of Summit and the Iowa Utilities Board. Some of these actions are simply unconscionable. It is time for some correction. From the very first letter we landowners received announcing this proposed project, it was unequivocally stated that the CO2 would be safely, securely, permanently sequestered underground. As that statement implied, it would mean that all captured CO2 would be "buried". Therefore, this contradicts any attempt at claims of being a "common carrier". Additionally, please address the issue of eminent domain, as that is of prime importance to ALL Iowa property owners. The 2024 Iowa State Republican platform, in the section marked "Property", item #6: "we oppose government using eminent domain to take private property away from the owner for the use of another private party or forprofit entity." Please adhere to that statement. Thank you.

Thank you for scheduling a hearing on HF 639. Myself and our families do support these bills, even though our preferred bill is HF 943. We need a bill that bans eminent domain from Agricultural land being utilized for carbon pipelines. Please consider adding HF943 or passing it in the current form. We are directly impacted by the pipeline as it will be buried next to our acreage. The pipeline will also impact our son and grandchildren that live and the land across from us in the same section. When the rupture happens we will not live to see the next day. The pipeline would also be bored underneath Flood Creek that flows directly through our properties. A rupture, when it does happen will cause irreversible harm to this ecosystem. Another major concern is the karst topography that lies beneath the topsoil in Floyd County. When the rupture occurs it will have irreversible consequences to our aquifers along with other land owners aquifers downstream. As trustee for land in the corridor of Summit's Phase 2 Lateral 12 CO2 pipeline project, I am very pleased that you are meeting on HF639. I especially like how HF639 would make Summit provide or help supplement the landowner's liability insurance costs. It is also very important to me that others, like the 600 people of Albert City living less than a mile from the proposed pipe, would be able to intervene at the hearing. HF943 is also very important to me. As MN and SD have done, Iowa needs to protect landowners who aren't interested in having the Chinese investors own part of their land be able to say, "No Thank You!" A combination of HF639 and also Hf943 needs to be brought to the floor of the full Senate so they can have a voice for their constituents. Thank You!

Thank you for scheduling a subcommittee hearing on HF369. While the issues of liability insurance and IUC reform are important, HF943 is primary and we ask that it be added to HF369 as an amendment. Banning eminent domain for CO2 pipelines on ag land is the right thing to do. Eminent domain should only be used by the government to take private property for public use or necessity with just compensation. There is no provision in the federal or state constitution for one private entity to take property from another private entity for profit. South Dakota and Minnesota do not allow eminent domain for CO2 pipelines. Iowa needs to do the same. I urge you to add HF943 as an amendment to HF639 and send the entire package to the full committee for a hearing followed by sending it to the floor of the Senate for a full and fair debate. I especially like how HF639 includes language to make Summit responsible for the landowner's liability insurance costs since the potential damage due to pipeline failure precludes indemnification with typical liability coverage. However **HF943** is also desperately needed to protect the private property rights of ALL Iowans. So I'm asking that you do what it takes to get this bill passed as well. We need to make sure property rights are protected from eminent domain for private gain. Even though right now it's about carbon pipelines, in the future it could easily be expanded to other private entities. For instance, let's say a popular restaurant wants to build in Sioux City and they want my property to do it. I'm older and I want to stay where I am, so eminent domain would be the easiest route for them. I hope you still believe enough in truth, justice and the American way to prevent forcing an old lady out of her home to make way for another restaurant. I urge you not to let another session pass without safeguarding our private property rights. Landowners and other concerned citizens are on year four of asking our elected legislators to do the right thing: represent their constituents by passing meaningful legislation that will protect property rights. While this is a complex issue, it is NOT a partisan issue. This is NOT an issue that should be dictated by someone that holds political sway over elected officials. This is an issue that has farreaching implications, not just for Iowans, but for the nation in the precedence that could be set. While the House of Representatives has done their due diligence for several sessions, it is time NOW for the Senate to do the same: pass HF639 AND HF943.

Neither this bill nor HF 943 contain any safety provisions in the event that eminent domain is used or the pipeline is built without using eminent domain. You've had four years to make some improvements. The eminent domain bill, in my view, may not be effective if the 45Q tax credit is repealed and the CO2 is instead used to make sustainable aviation fuel and other products. That is because I believe the primary purpose of the pipeline would no longer be transportation of CO2. All pipelines transport product, but based upon my research, I believe the technical category under these circumstances would likely be a gathering pipeline.I support the landowners' concerns regarding eminent domain. But one key issue related to this has received little attention. How will a decision to disallow eminent domain affect the safety of such pipelines when they are built? A DAPL filing in the Summit Carbon matter in South Dakota stated the following: "This includes only the most basic information that Summit is planning more than 40 crossings of DAPL and inconsistent information on collocation of pipelines..." Why are there so many planned DAPL crossings in South Dakota? I am not an attorney, but it appears to me that recent court filings in the Summit Carbon appeal in Polk County indicate that the environmental groups which have largely managed the opposition to this project, Bold and Sierra Club, did not preserve the issues of water quality and quantity during the lengthy IUC proceeding. It will also use a great deal of water:We will use about 1,500 gallons of water per minute, and we will put about 500 gallons per minute back, Westling said. I think that is roughly approximate to a single center pivot.Based on my research, I believe several other businesses that may use CO2 to produce fuel and other products will be a part of the Trailblazer route. I believe they will also use massive amounts of water, which no environmental group has even striven to account for. I am gravely concerned that if we wind up with a pipeline, increased ethanol production, and the proliferation of additional plants that use CO2 to make methanol, sustainable aviation fuel, and other products, this may have a catastrophic effect on our water sources.I do not support this part of the bill: "The following persons are entitled as of right to intervene in any proceeding conducted by the commission: a. A member of the general assembly. b. An elected county or city official. c. Any resident with a minimally plausible interest in the proceedings." I am concerned the term "plausible" may invoke the plausibility standard, which may in turn make it more difficult for interested parties to intervene. I have no idea why you would seek to extend the right to intervene to politicians. Here is the text from a recent Tweet by energy secretary Chris Wright:"Commonsense energy policy means putting energy over politics something the last administration failed to do." We are four years or more into this matter absent any meaningful, constructive intervention by the Iowa Legislature.

I do support HF 639. As a landowner in Kossuth County directly affected by the Summit CO2 pipeline, I support this bill. I was appalled that my neighbors who will be living and working dangerously close to this pipeline, were not allowed to speak at the IUC hearings in Fort Dodge. I was one of many landowners who testified that I am unable to obtain liability insurance for a CO2 pipeline on my land. A pipeline I do not want on my property. If that pipeline ruptures on my property, everyone will be sued Summit, tenants and landowners. Unfortunately, we will have to pay for lawyers out of own pocket until we are bankrupt.I also support HF 943. Please add it to this bill or pass it separately. South Dakota and Minnesota do not allow eminent domain for CO2 pipelines. Do your constituents in Iowa deserve any less??

For four years I have been personally attacked by the very company and its constituents that this legislation has been necessary for. I am one of hundreds of individuals and families that have been attacked, mocked, threatened and bullied because we believe in our rights to own property in the state of Iowa unincumbered, and not allowing the government the power to 'gift' it to a private company that has influence in the right places to get it done. I testified in the Phase I hearings. I have spent countless hours sending communication to legislators both local and state. Hours spent and energy expended just to protect 5 generations of blood sweat and tears. My ancestors fought for and preserved for almost 150 years so that I COULD HONOR THEM BY CONTINUING ON TRADITIONS. I come from an ag family and is at the core of who I am and where I came from. Its my God given path to be in the service of others, and to protect that farm. Period. And just like groundhog day, the last several legislative sessions, whenever the commerce committee was posed with ANY legislation to stand up for those rights, no committee would vote to bring it to the senate. Flat out undermining any legislative help. What do you stand for? PAC money? The rights of Iowans to own tax paid for generational land is at the core of our rights as residents of this state and country DESERVE IT TO BE DEBATED IN THE SENATE. Thank you for bringing HF639 along. HF943 would end this madness. Let them both be brought into light so it can be debated.

My wife and I live and own property that is directly affected by the main trunk of the Summit CO2 pipeline. Our neighbors and friends who will be living and working dangerously close to this pipeline, were not allowed to testify at the hearing in Fort Dodge. I believe they should have been allowed to testify so I support this bill.We are unable to obtain liability insurance coverage specific to the CO2 pipeline we do not want on our property. I am an impacted landowner with property in Page County. The current path of the Summit pipeline is 300 feet from my residence and 300 feet from my grain bin complex on the opposite side of the pipeline. This is to close for myself, my children and grandchildren as they will be near or traversing over the top of the pipeline. Thank you for scheduling a subcommittee meeting regarding HF 639 which was overwhelmingly passed by the House last week. However, PLEASE include HF 943 as a separate bill or included with HF 639. My preference is HF 943 separately which would protect those landowners that do not want the risk or the soil damage from the CO2 pipeline. We have waited four years for help and I would point out that Summit originally indicated that they would not use eminent domain for this project. The attached document was posted on Facebook in 2022 and mentions "working with landowners who wish to voluntarily participate". We have chosen not to participate!
