PAG LIN 1 1 SENATE FILE 2316 1 2 1 3 AN ACT 1 4 RELATING TO THE SALE OF CERTAIN FARMLAND BY IOWA STATE 1 5 UNIVERSITY OF SCIENCE AND TECHNOLOGY, PROVIDING FOR THE 1 6 APPROPRIATION AND USE OF PROCEEDS FROM THE SALE, AND 1 7 PROVIDING AN EFFECTIVE DATE. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. LEGISLATIVE FINDINGS GOAL. 1 12 1. The general assembly finds and declares that Iowa state 1 13 university of science and technology has maintained a very 1 14 successful dairy research facility for more than fifty years 1 15 consisting of one thousand one hundred acres at its Ankeny 1 16 dairy farm. However, the dairy farm's facilities have become 1 17 outdated. The general assembly further finds that in the 1 18 years since the land for the dairy farm was first purchased by 1 19 the university, the city of Ankeny has grown and now surrounds 1 20 the facility. The general assembly finds that the dairy farm 1 21 is now inhibiting the city's future growth and forcing real 1 22 estate developers to develop land outside the city, 1 23 exacerbating urban sprawl. 1 24 2. The purpose of this Act is to encourage the 1 25 university's continued financial commitment to dairy research 1 26 and teaching, to promote economic growth in the state, and to 1 27 provide for intelligent growth within existing city limits. 1 28 Sec. 2. NEW SECTION. 266.39F SALE OF DAIRY BREEDING 1 29 RESEARCH FARM. 1 30 1. Immediately after the effective date of this Act, Iowa 1 31 state university of science and technology shall develop a 1 32 plan to sell, at market value, the one thousand one hundred- 1 33 acre tract of land within the city limits of Ankeny, commonly 1 34 referred to as the Iowa state university dairy breeding 1 35 research farm. The plan shall include the sale of substantial 2 1 portions of the tract as soon as practical, and the sale of 2 2 all of the tract within a commercially reasonable time. Prior 2 3 to implementing the plan, the university shall submit the plan 2 4 to the state board of regents for review and approval. The 2 5 sale shall be handled in a manner that is the most financially 2 6 beneficial to the university. Appraisals conducted by the 2 7 university of the value of any portion of the tract shall be 2 8 made available to the public immediately following the sale of 2 9 that portion of the tract. 2 10 2. The proceeds from the sale of the property as provided 2 11 in subsection 1 are appropriated and shall be retained by Iowa 2 12 state university of science and technology for use in 2 13 establishing a new dairy research and dairy teaching facility 2 14 or for the university's plant sciences institute. 2 15 The provisions of section 262.9, subsection 7, and section 2 16 262.10, shall not apply to the sale of any portion of land to 2 17 be sold in accordance with this section or to the use of the 2 18 proceeds from the sale of the land. 2 19 3. By December 15 annually, the state board of regents 2 20 shall submit a report of the activities and costs of the sale 2 21 of any property in accordance with subsection 1, including but 2 22 not limited to the use of any proceeds from the sale of the 2 23 property and the environmental cleanup costs for any proposed 2 24 sale in accordance with this section, to the general assembly 2 25 in accordance with section 7A.11A, and to the legislative 2 26 fiscal bureau, until such time as the sale of the property is 2 27 complete and the proceeds have been expended by the 2 28 university, at which time the state board of regents shall 2 29 submit a final report on the sale of the property and use of 2 30 the proceeds to the general assembly in accordance with 2 31 section 7A.11A and to the legislative fiscal bureau. 2 32 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 33 immediate importance, takes effect upon enactment. 2 34 2 35 3 1 3 2 MARY E.
