  1  4 APPROPRIATING STATE SCHOOL FOUNDATION AID AND MAKING
  1  5    RELATED CHANGES TO THE STATE PERCENT OF GROWTH FOR SCHOOL
  1  6    BUDGETS AND TO THE FUNDING FOR AREA EDUCATION AGENCIES, AND
  1  7    PROVIDING AN EFFECTIVE DATE.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 257.8, subsection 1, Code Supplement
  1 12 2001, is amended to read as follows:
  1 13    1.  STATE PERCENT OF GROWTH.  The state percent of growth
  1 14 for the budget year beginning July 1, 2001, is four percent.
  1 15 The state percent of growth for the budget year beginning July
  1 16 1, 2002, is four one percent.  The state percent of growth for
  1 17 each subsequent budget year shall be established by statute
  1 18 which shall be enacted within thirty days of the submission in
  1 19 the year preceding the base year of the governor's budget
  1 20 under section 8.21.  The establishment of the state percent of
  1 21 growth for a budget year shall be the only subject matter of
  1 22 the bill which enacts the state percent of growth for a budget
  1 23 year.
  1 24    Sec. 2.  Section 257.35, Code 2001, is amended to read as
  1 25 follows:
  1 26    257.35  AREA EDUCATION AGENCY PAYMENTS.
  1 27    1.  The department of management shall deduct the amounts
  1 28 calculated for special education support services, media
  1 29 services, and educational services for each school district
  1 30 from the state aid due to the district pursuant to this
  1 31 chapter and shall pay the amounts to the respective area
  1 32 education agencies on a monthly basis from September 15
  1 33 through June 15 during each school year.  The department of
  1 34 management shall notify each school district of the amount of
  1 35 state aid deducted for these purposes and the balance of state
  2  1 aid shall be paid to the district.  If a district does not
  2  2 qualify for state aid under this chapter in an amount
  2  3 sufficient to cover its amount due to the area education
  2  4 agency as calculated by the department of management, the
  2  5 school district shall pay the deficiency to the area education
  2  6 agency from other moneys received by the district, on a
  2  7 quarterly basis during each school year.
  2  8    2.  Notwithstanding subsection 1, the state aid for area
  2  9 education agencies and the portion of the combined district
  2 10 cost calculated for these agencies for each fiscal year of the
  2 11 fiscal period beginning July 1, 2002, and ending June 30,
  2 12 2004, shall be reduced by the department of management by
  2 13 seven million five hundred thousand dollars.  The reduction
  2 14 for each area education agency shall be equal to the reduction
  2 15 that the agency received in the fiscal year beginning July 1,
  2 16 2001.
  2 17    Sec. 3.  Section 257.37, Code 2001, is amended by adding
  2 18 the following new subsection:
  2 19    NEW SUBSECTION.  6.  For the budget years beginning July 1,
  2 20 2002, and July 1, 2003, notwithstanding the requirements of
  2 21 this section for determining the budgets and funding of media
  2 22 services and education services, an area education agency may,
  2 23 within the limits of the total of the funds provided for the
  2 24 budget years pursuant to section 257.35, expend for special
  2 25 education support services an amount that exceeds the payment
  2 26 for special education support services pursuant to section
  2 27 257.35 in order to maintain the level of required special
  2 28 education support services in the area education agency.
  2 29    Sec. 4.  2001 Iowa Acts, chapter 174, section 1, subsection
  2 30 1, is amended to read as follows:
  2 31    1.  Notwithstanding provisions to the contrary in sections
  2 32 99D.17 and 99F.11, and notwithstanding provisions to the
  2 33 contrary in section 8.57, subsection 5, paragraph "e", and
  2 34 following deposits in the general fund of the state, the
  2 35 vision Iowa fund created in section 12.72, and the school
  3  1 infrastructure fund created in section 12.82, pursuant to
  3  2 section 8.57, subsection 5, paragraph "e", for the designated
  3  3 fiscal years, the following moneys received pursuant to
  3  4 sections 99D.17 and 99F.11 shall be deposited in the endowment
  3  5 for Iowa's health account of the tobacco settlement trust fund
  3  6 created in section 12E.12 for the purposes specified in
  3  7 section 12E.12 for the endowment for Iowa's health account:  
  3  8 FY 2001-2002 ..................................... $ 80,000,000
  3  9 FY 2002-2003 ..................................... $ 75,000,000
  3 10 FY 2003-2004 ..................................... $ 70,000,000
  3 11 FY 2004-2005 ..................................... $ 70,000,000
  3 12 FY 2005-2006 ..................................... $ 70,000,000
  3 13 FY 2006-2007 ..................................... $ 70,000,000
  3 14    The total moneys received pursuant to sections 99D.17 and
  3 15 99F.11 in a fiscal year, in excess of the moneys received
  3 16 pursuant to sections 99D.17 and 99F.11 and deposited in the
  3 17 general fund of the state, the vision Iowa fund, the school
  3 18 infrastructure fund, and the tobacco settlement trust fund,
  3 19 shall be deposited in the rebuild Iowa infrastructure fund and
  3 20 shall be used as provided in section 8.57, notwithstanding
  3 21 section 8.60.
  3 22    For the fiscal year beginning July 1, 2002, and ending June
  3 23 30, 2003, of the $75,000,000 to be deposited in the endowment
  3 24 for Iowa's health account of the tobacco settlement trust fund
  3 25 under this subsection, the first $20,000,000 is appropriated
  3 26 to the department of management to pay that part of foundation
  3 27 aid which represents the allowable growth amounts for all
  3 28 school districts.  An appropriation from the general fund of
  3 29 the state for foundation aid which is supplanted by the
  3 30 appropriation made in this subsection, shall be reduced by the
  3 31 amount of the appropriation which supplants it.
  3 32    Sec. 5.  STATE FOUNDATION AID APPROPRIATION.
  3 33    1.  Notwithstanding section 257.16, for the fiscal year
  3 34 beginning July 1, 2002, and ending June 30, 2003, there is
  3 35 appropriated from the general fund of the state to the
  4  1 department of education the following amount, or so much
  4  2 thereof as is necessary, to be used for the purpose
  4  3 designated:  
  4  4    For state foundation aid: ..................... $1,784,090,500
  4  5    If the amount appropriated in this section is less than the
  4  6 amount required pursuant to section 257.16, unnumbered
  4  7 paragraph 1, the difference shall be deducted from the
  4  8 payments to each school district in the same ratio that the
  4  9 budget enrollment of the school district for the budget year
  4 10 beginning July 1, 2002, bears to the total budget enrollment
  4 11 in the state for that budget year.
  4 12    2.  a.  There is appropriated from the Iowa economic
  4 13 emergency fund created in section 8.55 to the department of
  4 14 management for the fiscal year beginning July 1, 2002, and
  4 15 ending June 30, 2003, the following amount, or so much thereof
  4 16 as is necessary, to be used for the purpose designated:
  4 17    For supplanting an equal amount from the appropriation made
  4 18 from the general fund of the state for the fiscal year
  4 19 beginning July 1, 2002, pursuant to section 257.16, to pay
  4 20 that part of foundation aid which represents the allowable
  4 21 growth amounts for all school districts:  
  4 22 .................................................. $ 25,000,000
  4 23    b.  The moneys appropriated in this subsection are declared
  4 24 to be appropriated for emergency expenditures as required in
  4 25 section 8.55, subsection 3, paragraph "a".
  4 26    c.  An appropriation from the general fund of the state,
  4 27 which is supplanted by an appropriation from the Iowa economic
  4 28 emergency fund made in this subsection, shall be reduced by
  4 29 the amount of the appropriation which supplants it.
  4 30    Sec. 6.  EFFECTIVE DATE.  This Act, being deemed of
  4 31 immediate importance, takes effect upon enactment.
