1 1 Section 1. NEW SECTION. 321.45A TITLE AVAILABLE FOR
1 2 MOTOR VEHICLES AT AUCTION.
1 3 A person shall not offer a motor vehicle for sale at
1 4 auction unless the person has the certificate of title to the
1 5 motor vehicle physically available at the time and place of
1 6 the auction. For purposes of this section, "certificate of
1 7 title" includes a valid certificate of title or salvage
1 8 certificate of title issued in this state or a valid
1 9 certificate of title issued in another state that permits the
1 10 reassignment of that state's certificate of title in this
1 11 state.
1 12 EXPLANATION
1 13 This bill prohibits a person from offering a motor vehicle
1 14 for sale at auction unless the motor vehicle's certificate of
1 15 title is physically present at the time and place of the
1 16 auction. A violation of the prohibition is a simple
1 17 misdemeanor punishable by confinement for no more than 30 days
1 18 or a fine of at least $50 but not more than $500 or by both.
