  1  1    Amend the amendment, S-5437, to Senate File 2293,
  1  2 as follows:
  1  3    #1.  Page 16, by inserting after line 6, the
  1  4 following:
  1  5    "   .  The department may disapprove an application
  1  6 for a construction permit if the department determines
  1  7 that a confinement feeding operation structure poses a
  1  8 significant risk to the environment or public health.
  1  9 The department's determination shall be based on any
  1 10 of the following:
  1 11    a.  The animal unit capacity of the confinement
  1 12 feeding operation if the structure were constructed.
  1 13    b.  The type of confinement feeding operation
  1 14 structure proposed to be constructed and the type of
  1 15 any related pollution control device or practice
  1 16 proposed to be installed or used, including but not
  1 17 limited to engineering standards for the construction
  1 18 of a manure storage structure as provided in section
  1 19 455B.205 or 455B.205A.
  1 20    c.  The proximity to the proposed construction site
  1 21 of any of the following:
  1 22    (1)  Human population areas with weight provided to
  1 23 this factor based on the population density of such
  1 24 areas.
  1 25    (2)  Fragile land areas including but not limited
  1 26 to wetlands, floodplains, or areas with rare or
  1 27 valuable ecosystems.
  1 28    (3)  Water sources including major water sources
  1 29 used as drinking water supplies; watersheds; and
  1 30 aquifers and their recharge areas.
  1 31    (4)  Public use areas or areas of unique scenic or
  1 32 historic significance.
  1 33    d.  The availability of land required for the
  1 34 application of manure originating from the confinement
  1 35 feeding operation as provided in section 455B.203.
  1 36    e.  The geology and hydrology of the site,
  1 37 including but not limited to the risk of pollution to
  1 38 surface and subsurface water caused by a breach in a
  1 39 manure storage structure or leaching or runoff from
  1 40 manure applied on land located in proximity to the
  1 41 confinement feeding operation.
  1 42    f.  The impact of the confinement feeding
  1 43 operation, after construction of the proposed
  1 44 confinement feeding operation structure, on the
  1 45 services of any city located in proximity to the
  1 46 confinement feeding operation or the county in which
  1 47 the confinement feeding operation is located.
  1 48    g.  The extent to which the applicant has complied
  1 49 with requirements under this division for other animal
  1 50 feeding operations owned by the applicant.
  2  1    h.  The availability of alternative construction
  2  2 sites, including an analysis of cost comparisons."
  2  3    #2.  Page 25, by inserting after line 8, the
  2  4 following:
  2  5    "(___)  Whether the construction of a proposed
  2  6 confinement feeding operation structure poses a
  2  7 significant risk to the environment or public health."
  2  8    #3.  Page 43, line 36, by inserting after the
  2  9 figure "2001." the following:  "The board may provide
  2 10 comments that the confinement feeding operation poses
  2 11 a significant risk to the environment or public
  2 12 health."
  2 13    #4.  By striking page 45, line 22 through page 50,
  2 14 line 11.
  2 15    #5.  Page 50, by striking lines 15 through 19.
  2 16    #6.  By renumbering as necessary.
