  1  1    Amend the amendment, S-5437, to Senate File 2293,
  1  2 as follows:
  1  3    #1.  Page 1, by inserting after line 39, the
  1  4 following:
  1  5    "Sec.    .  NEW SECTION.  455B.124  CONFINEMENT
  1  6 FEEDING OPERATIONS – SITING ORDINANCE.
  1  7    1.  a.  Notwithstanding sections 331.304A and
  1  8 335.2, a county may adopt a confinement feeding
  1  9 operations siting ordinance, pursuant to section
  1 10 331.302.  The purpose of the ordinance shall be to
  1 11 allow approval of the siting of a confinement feeding
  1 12 operation regardless of whether the county has adopted
  1 13 an ordinance under chapter 335.
  1 14    b.  The ordinance shall apply to the siting of a
  1 15 confinement feeding operation structure other than a
  1 16 small animal feeding operation.
  1 17    c.  The ordinance shall authorize a county to
  1 18 approve the site of the construction or expansion of a
  1 19 confinement feeding operation, including confinement
  1 20 feeding operation buildings and related animal feeding
  1 21 operation structures in order to preserve and protect
  1 22 natural resources, including water sources and fragile
  1 23 environmental locations; lessen congestion and
  1 24 overcrowding of confinement feeding operations,
  1 25 especially near cities; and to protect the health and
  1 26 welfare of the public.
  1 27    d.  The ordinance shall provide for methods and
  1 28 procedures required for submission of proposals,
  1 29 review of proposals, and approval of a site.  In
  1 30 administering the ordinance, the county shall
  1 31 establish a confinement feeding operations siting
  1 32 commission which shall review each proposal for the
  1 33 construction or expansion of a confinement feeding
  1 34 operation, and recommend to the county board of
  1 35 supervisors that the board approve or disapprove the
  1 36 proposal.  The board shall appoint five persons as
  1 37 members of the commission.  Four members shall not
  1 38 reside in a city, and one member shall reside in a
  1 39 city.  At least three of the members shall be persons
  1 40 who are or were actively engaged in animal
  1 41 agriculture.  The commission shall make its
  1 42 recommendation to the board within forty-five days
  1 43 after the date that the board receives a complete
  1 44 proposal.  The board shall approve or disapprove a
  1 45 proposal within forty-five days after the date that
  1 46 the board receives the commission's recommendation
  1 47 regarding approval or disapproval."
