1 1 Amend Senate File 2308 as follows:
1 2 #1. Page 2, by inserting after line 9 the
1 3 following:
1 4 "Sec. . Section 437A.5, Code 2001, is amended
1 5 by adding the following new subsection:
1 6 NEW SUBSECTION. 10. a. For purposes of this
1 7 subsection, "new gas-fired turbine generator system"
1 8 means such a system that initially generates
1 9 electricity subject to replacement generation tax
1 10 under section 437A.6 on or after January 1, 2002.
1 11 b. Notwithstanding anything to the contrary in
1 12 this chapter or the provisions of any other law or
1 13 charter, the board of supervisors of the county in
1 14 which a new gas-fired turbine generator system is
1 15 proposed to be located may enter into an agreement
1 16 with any person to exempt certain natural gas consumed
1 17 for generation purposes from the tax imposed by this
1 18 section on behalf of all local taxing authorities with
1 19 respect to all local taxing districts located within
1 20 that county for such period and upon such terms and
1 21 conditions as the board may determine, provided,
1 22 however, that this exemption shall apply only to
1 23 natural gas used or to be used by a new gas-fired
1 24 turbine generator system located in that county to
1 25 generate electricity subject to the replacement
1 26 generation tax imposed by section 437A.6.
1 27 c. The board of supervisors shall consult local
1 28 taxing authorities within the county as to the
1 29 advisability of entering into such an agreement and
1 30 the positive economic impact that granting an
1 31 exemption would have on the county.
1 32 d. During the period that any exemption granted in
1 33 accordance with this subsection is in effect, any
1 34 delivery of natural gas used or to be used by a new
1 35 gas-fired turbine generator system located in that
1 36 county to generate electricity shall be excluded for
1 37 purposes of computing the recalculation of replacement
1 38 tax on the delivery of natural gas under this
1 39 section."
1 40 #2. By renumbering, redesignating, and correcting
1 41 internal references as necessary.
