  1  1    Amend Senate File 2325 as follows:
  1  2    #1.  Page 16, by inserting after line 21 the
  1  3 following:
  1  4    "Sec.    .  Section 455B.133, Code 2001, is amended
  1  5 by adding the following new subsection:
  1  6    NEW SUBSECTION.  10.  Adopt rules allowing a city
  1  7 to conduct a controlled burn of a demolished building
  1  8 subject to the same restrictions as are in effect for
  1  9 fire fighting training fires.  The rules shall include
  1 10 a provision that a city may undertake no more than
  1 11 three controlled burns in every overlapping six-
  1 12 tenths-of-a-mile-radius circle every three years.  The
  1 13 rules shall prohibit a controlled burn of a demolished
  1 14 building in Cedar Rapids, Marion, Hiawatha, Council
  1 15 Bluffs, Carter Lake, Des Moines, West Des Moines,
  1 16 Clive, Windsor Heights, Urbandale, Pleasant Hill,
  1 17 Buffalo, Davenport, Mason City or any other area where
  1 18 area-specific state implementation plans require the
  1 19 control of particulate."
  1 20    #2.  Page 24, by inserting after line 29 the
  1 21 following:
  1 22    "Sec.    .  DEMOLITION SITE WASTE MATERIAL TASK
  1 23 FORCE.
  1 24    1.  The department of natural resources, in
  1 25 cooperation with the department of economic
  1 26 development, shall establish a task force to study
  1 27 issues related to the proper disposal of waste
  1 28 material from buildings demolished in cities and
  1 29 counties.  The task force shall study issues
  1 30 including, but not limited to, all of the following:
  1 31    a.  The proper removal and disposal of waste
  1 32 material containing lead-based paints and asbestos.
  1 33    b.  The proper removal and disposal of any other
  1 34 hazardous waste material or waste material commonly
  1 35 found in old buildings that may be considered a health
  1 36 hazard if removed improperly.
  1 37    c.  Any alternatives to the disposal of waste
  1 38 material from demolition sites such as salvage
  1 39 operations.
  1 40    d.  The training of fire department personnel in
  1 41 relation to the disposal of waste material from
  1 42 demolition sites.
  1 43    e.  Asbestos inspection training for volunteers at
  1 44 the local level.
  1 45    f.  An appropriate local limit for the controlled
  1 46 burning of demolished buildings from which hazardous
  1 47 materials have been removed prior to burning.
  1 48    g.  The proper method for encouraging cooperation
  1 49 between cities and counties on issues related to the
  1 50 disposal of demolition site waste material.
  2  1    2.  The task force membership shall include, but
  2  2 not be limited to, all of the following:
  2  3    a.  Representatives from the department of natural
  2  4 resources knowledgeable in air toxics and toxic
  2  5 materials.
  2  6    b.  Representatives from the department of economic
  2  7 development knowledgeable in community development.
  2  8    c.  A representative of the Iowa league of cities.
  2  9    d.  A representative of the Iowa society of solid
  2 10 waste operators.
  2 11    e.  Four members of the general assembly with not
  2 12 more than one member from each chamber being from the
  2 13 same political party.  The two senators shall be
  2 14 designated by the president of the senate after
  2 15 consultation with the majority and minority leaders of
  2 16 the senate.  The two representatives shall be
  2 17 designated by the speaker of the house of
  2 18 representatives after consultation with the majority
  2 19 and minority leaders of the house of representatives.
  2 20    3.  By January 1, 2003, the task force shall submit
  2 21 a report to the general assembly, including
  2 22 recommendations, regarding issues relating to the
  2 23 disposal of debris from demolition sites in Iowa."
  2 24    #3.  By renumbering as necessary.
