  1  1    Amend the House amendment, S-5272, to Senate File
  1  2 2190, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 2, by striking line 45 and inserting the
  1  5 following:  "line 6, and inserting the following:
  1  6    "Sec.    .  Section 86.13, unnumbered paragraph 4,
  1  7 Code 2001, is amended by striking the unnumbered
  1  8 paragraph and inserting in lieu thereof the following:
  1  9    Unless the employer proves as an affirmative
  1 10 defense that the employer had a reasonable excuse for
  1 11 not paying or for paying weekly compensation after its
  1 12 due date, the denial or delay of which is proven by
  1 13 the employee, the workers' compensation commissioner
  1 14 shall order the employer to pay the employee a penalty
  1 15 equal to treble the amount of the weekly compensation,
  1 16 the payment of which was denied or delayed past the
  1 17 due date.""
