  1  1    Amend the House amendment, S-5272, to Senate File
  1  2 2190, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 2, line 45, by striking the figure "6."
  1  5 and inserting the following:  "6, and inserting the
  1  6 following:
  1  7    "Sec.    .  Section 86.13, unnumbered paragraph 4,
  1  8 Code 2001, is amended by striking the unnumbered
  1  9 paragraph and inserting in lieu thereof the following:
  1 10    Unless the employer proves as an affirmative
  1 11 defense that the employer had a reasonable excuse for
  1 12 not paying or for paying amounts after their due dates
  1 13 fixed by law or by a health care provider, including
  1 14 all benefits provided by sections 85.27 through 85.34
  1 15 or section 86.13, whether constituting compensation,
  1 16 interest, penalties, or other benefits, the denial or
  1 17 delay of which payment is proven by the employee, the
  1 18 workers' compensation commissioner shall order the
  1 19 employer to pay the employee a penalty equal to treble
  1 20 the amount or the value, as the case may be, of the
  1 21 payment which was denied or delayed past the due
  1 22 date.""
