Section 483A.7, subsection 3, Code 2001, 2 27 is amended to read as follows: 2 28 3. A nonresident wild turkey hunter is required to 2 29 have only a nonresident wild turkey hunting license 2 30 and pay the wildlife habitat fee. The commission 2 31 shall annually limit totwothree thousand licenses 2 32 the number of nonresidents allowed to have wild turkey 2 33 hunting licenses. The number of nonresident wild 2 34 turkey hunting licenses shall be determined as 2 35 provided in section 481A.38. If a license cannot be 2 36 issued, the applicable fees, excluding an application 2 37 fee of twenty-five dollars, shall be returned to the 2 38 applicant. The commission shall allocate the 2 39 nonresident wild turkey hunting licenses issued among 2 40 the zones based on the populations of wild turkey. A 2 41 nonresident applying for a wild turkey hunting license 2 42 must exhibit proof of having successfully completed a 2 43 hunter safety and ethics education program as provided 2 44 in section 483A.27 or its equivalent as determined by 2 45 the department before the license is issued. 2 46 Sec. 3. Section 483A.8, subsection 3, Code 2001, 2 47 is amended to read as follows: 2 48 3. A nonresident hunting deer is required to have 2 49 a nonresident deer license and must pay the wildlife 2 50 habitat fee. The commission shall annually limit to 3 1seventen thousandfive hundredlicenses the number of 3 2 nonresidents allowed to have deer hunting licenses. 3 3Of the first six thousand nonresident deer licenses3 4issued, not more than thirty-five percent of the3 5licenses shall be bow season licenses and, after the3 6first six thousand nonresident deer licenses have been3 7issued, all additional licenses shall be issued for3 8antlerless deer only.The number of nonresident deer 3 9 hunting licenses shall be determined as provided in 3 10 section 481A.38. The commission shall allocate the 3 11 nonresident deer hunting licenses issued among the 3 12 zones based on the populations of deer. However, a 3 13 nonresident applicant may request one or more hunting 3 14 zones, in order of preference, in which the applicant 3 15 wishes to hunt. Ifthe requesta license cannot be 3 16fulfilledissued, the applicable fees, excluding an 3 17 application fee of twenty-five dollars, shall be 3 18 returned to the applicant. A nonresident applying for 3 19 a deer hunting license must exhibit proof of having 3 20 successfully completed a hunter safety and ethics 3 21 education program as provided in section 483A.27 or 3 22 its equivalent as determined by the department before 3 23 the license is issued. 3 24 Sec. 4. Section 483A.24, subsection 2, paragraph 3 25 b, Code 2001, is amended to read as follows: 3 26 b. Uponwrittenapplicationon forms furnished3 27 pursuant to rules established by the department, the 3 28 department shall issue annually without fee one deer 3 29 or one wild turkey license, or both, to the owner of a 3 30 farm unit or to a member of the owner's family, but 3 31 not to both, and to the tenant or to a member of the 3 32 tenant's family, but not to both. The deer hunting 3 33 license or wild turkey hunting license issued shall be 3 34 valid only on the farm unit for which an applicant 3 35 qualifies pursuant to this subsection and shall be 3 36 equivalent to the least restrictive license issued 3 37 under section 481A.38. The owner or the tenant need 3 38 not reside on the farm unit to qualify for a free 3 39 license to hunt on that farm unit. A free deer 3 40 hunting license issued pursuant to this subsection 3 41 shall be valid during all shotgun deer seasons. 3 42 Sec. 5. Section 483A.24, subsection 2, paragraph 3 43 c, Code 2001, is amended to read as follows: 3 44 c. In addition to the free deer hunting license 3 45 received, an owner of a farm unit or a member of the 3 46 owner's family and the tenant or a member of the 3 47 tenant's family may purchase a deer hunting license 3 48 for any option offered to paying deer hunting 3 49 licensees. An owner of a farm unit or a member of the 3 50 owner's family and the tenant or a member of the 4 1 tenant's family may also purchase two additional 4 2 antlerless deer hunting licenses which are valid only 4 3 on the farm unit for a fee of ten dollars each. 4 4 Sec. 6. Section 483A.24, subsection 2, Code 2001, 4 5 is amended by adding the following new paragraph: 4 6 NEW PARAGRAPH. e. Upon application pursuant to 4 7 rules established by the department and payment of a 4 8 nonresident deer hunting license fee, the department 4 9 shall issue a deer hunting license to the nonresident 4 10 owner or owners of a farm unit. In addition to the 4 11 application and payment of the license fee, the 4 12 nonresident owner or owners of a farm unit shall 4 13 prepare and adhere to a deer population management 4 14 plan approved pursuant to rules of the department. 4 15 The primary objective of a deer population management 4 16 plan is to manage deer populations to minimize damage 4 17 to agricultural crops on adjacent land. The deer 4 18 hunting license issued shall be valid only on the farm 4 19 unit for which the applicant qualifies pursuant to 4 20 this subsection and shall be equivalent to the least 4 21 restrictive license issued under section 481A.38. The 4 22 nonresident deer hunting licenses issued pursuant to 4 23 this paragraph shall be in addition to the number of 4 24 nonresident hunting licenses authorized pursuant to 4 25 section 483A.8. 4 26 Sec. 7. NEW SECTION. 483A.28 DEER POPULATION 4 27 MANAGEMENT PLAN. 4 28 A person controlling land by lease, ownership, or 4 29 other means where a hunter is charged a fee for 4 30 hunting deer, shall prepare and adhere to a deer 4 31 population management plan approved by the department. 4 32 The primary objective of a deer population management 4 33 plan is to manage deer populations to minimize damage 4 34 to agricultural crops on land adjacent to the fee 4 35 hunting management area. This section does not apply 4 36 to licensed hunting preserves. 4 37 Sec. 8. EFFECTIVE AND APPLICABILITY DATES. 4 38 Sections 1, 2, 3, and 6 of this Act take effect 4 39 December 15, 2001, and apply to licenses and fees for 4 40 wildlife and game activities for the years beginning 4 41 on or after January 1, 2002." 4 42 #2.
