Fish habitat fee ................................. $ 3.00 2 22 Sec. 3. Section 483A.1, subsection 3, Code 2001, is 2 23 amended by striking the subsection. 2 24 Sec. 4. NEW SECTION. 483A.3A FISH HABITAT FEE. 2 25 A resident or nonresident required to have a fishing 2 26 license shall not fish unless the person has paid the fish 2 27 habitat fee. Fish habitat fees shall be administered in the 2 28 same manner as fishing licenses except that all revenue 2 29 derived from fish habitat fees shall be deposited in the state 2 30 fish and game protection fund and shall be used within this 2 31 state for fish habitat development. Not less than fifty 2 32 percent of the revenue from fish habitat fees shall be used by 2 33 the commission to enter into agreements with county 2 34 conservation boards to carry out the purposes of this section. 2 35 This section shall not apply to residents who are younger than 3 1 sixteen years of age or are sixty-five years of age or more, 3 2 or to residents or nonresidents when fishing in privately 3 3 owned farm ponds or lakes. 3 4 Sec. 5. Section 483A.7, subsection 3, Code 2001, is 3 5 amended to read as follows: 3 6 3. A nonresident wild turkey hunter is required to have 3 7onlya nonresident hunting license and a nonresident wild 3 8 turkey hunting license and pay the wildlife habitat fee. The 3 9 commission shall annually limit to two thousand three hundred 3 10 licenses the number of nonresidents allowed to have wild 3 11 turkey hunting licenses. Of the two thousand three hundred 3 12 licenses, one hundred fifty licenses shall be valid for 3 13 hunting with muzzle loading shotguns only. The number of 3 14 nonresident wild turkey hunting licenses shall be determined 3 15 as provided in section 481A.38. The commission shall allocate 3 16 the nonresident wild turkey hunting licenses issued among the 3 17 zones based on the populations of wild turkey. A nonresident 3 18 applying for a wild turkey hunting license must exhibit proof 3 19 of having successfully completed a hunter safety and ethics 3 20 education program as provided in section 483A.27 or its 3 21 equivalent as determined by the department before the license 3 22 is issued. 3 23 Sec. 6. Section 483A.8, subsection 3, Code 2001, is 3 24 amended to read as follows: 3 25 3. A nonresident hunting deer is required to have a 3 26 nonresident hunting license and a nonresident deer license and 3 27 must pay the wildlife habitat fee. The commission shall 3 28 annually limit toseveneight thousand five hundred licenses 3 29 the number of nonresidents allowed to have deer hunting 3 30 licenses. Of the first six thousand nonresident deer licenses 3 31 issued, not more than thirty-five percent of the licenses 3 32 shall be bow season licenses and, after the first six thousand 3 33 nonresident deer licenses have been issued, all additional 3 34 licenses shall be issued for antlerless deer only. The number 3 35 of nonresident deer hunting licenses shall be determined as 4 1 provided in section 481A.38. The commission shall allocate 4 2 the nonresident deer hunting licenses issued among the zones 4 3 based on the populations of deer. However, a nonresident 4 4 applicant may request one or more hunting zones, in order of 4 5 preference, in which the applicant wishes to hunt. If the 4 6 request cannot be fulfilled, the applicable fees shall be 4 7 returned to the applicant. A nonresident applying for a deer 4 8 hunting license must exhibit proof of having successfully 4 9 completed a hunter safety and ethics education program as 4 10 provided in section 483A.27 or its equivalent as determined by 4 11 the department before the license is issued. 4 12 Sec. 7. Section 483A.8, Code 2001, is amended by adding 4 13 the following new subsection: 4 14 NEW SUBSECTION. 5. A nonresident owning land in this 4 15 state may apply for one of the six thousand nonresident deer 4 16 licenses and the provisions of subsection 3 shall apply. 4 17 However, if a nonresident owning land in this state is 4 18 unsuccessful in the drawing, the landowner shall be given 4 19 preference for one of the two thousand five hundred antlerless 4 20 only nonresident deer licenses. A nonresident owning land in 4 21 this state shall pay the fee for a nonresident antlerless only 4 22 deer license and the license shall be valid to hunt on the 4 23 nonresident's land only. A nonresident owning land in this 4 24 state is eligible for only one nonresident deer license 4 25 annually. If one or more parcels of land have multiple 4 26 nonresident owners, only one of the nonresident owners is 4 27 eligible for a nonresident antlerless only deer license. If a 4 28 nonresident jointly owns land in this state with a resident, 4 29 the nonresident shall not be given preference for a 4 30 nonresident antlerless only deer license. The department may 4 31 require proof of land ownership from a nonresident landowner 4 32 applying for a nonresident antlerless only deer license. 4 33 Sec. 8. Section 483A.24, subsection 2, paragraph c, Code 4 34 2001, is amended to read as follows: 4 35 c. In addition to the free deer hunting license received, 5 1 an owner of a farm unit or a member of the owner's family and 5 2 the tenant or a member of the tenant's family may purchase a 5 3 deer hunting license for any option offered to paying deer 5 4 hunting licensees. An owner of a farm unit or a member of the 5 5 owner's family and the tenant or a member of the tenant's 5 6 family may also purchase two additional antlerless deer 5 7 hunting licenses which are valid only on the farm unit for a 5 8 fee of ten dollars each. 5 9 Sec. 9. EFFECTIVE AND APPLICABILITY DATES.
