PAG LIN 1 1 Amend Senate File 342 as follows: 1 2 #1. Page 1, by inserting before line 1, the 1 3 following: 1 4 "Sec. 100. Section 48A.5, Code 2001, is amended by 1 5 adding the following new subsection: 1 6 NEW SUBSECTION. 3A. If a person is registering 1 7 under the provisions of section 48A.9A, the person 1 8 shall be a resident of the county in which the 1 9 election is held for ten days immediately preceding 1 10 the election, subject to the provisions of subsection 1 11 3 and section 48A.27, subsection 2, paragraph "a", 1 12 subparagraph (3). 1 13 Sec. . Section 48A.9, subsection 1, Code 2001, 1 14 is amended to read as follows: 1 15 1. Registration closes at five p.m. eleven days 1 16 before each election except primary and general 1 17 elections. For primary and general elections, 1 18 registration closes at five p.m. ten days before the 1 19 election. An eligible elector may register during the 1 20 time registration is closed in the elector's precinct 1 21 but the registration shall not become effective until 1 22 registration opens again in the elector's precinct 1 23 unless the elector obtains an affidavit of special 1 24 late registration as provided in section 48A.9A. 1 25 Sec. . NEW SECTION. 48A.9A SPECIAL LATE 1 26 REGISTRATION. 1 27 1. Notwithstanding the voter registration 1 28 deadlines in section 48A.9, an eligible elector may 1 29 register to vote on election day if the elector 1 30 presents to the precinct election official 1 31 identification upon which the voter's photograph and 1 32 signature or mark appears. 1 33 2. The commissioner shall record the information 1 34 required of an eligible elector on the election 1 35 register for the county precinct of the eligible 1 36 elector or shall provide a separate listing of the 1 37 information required of an eligible elector to the 1 38 county precinct of the eligible elector who registers 1 39 in person at the commissioner's office or at the 1 40 elector's precinct polling place on election day. 1 41 3. If the commissioner is unable to make available 1 42 to a county precinct the information required of an 1 43 eligible elector who registers through special late 1 44 registration procedures, on the election register of a 1 45 county precinct or through the provision of a separate 1 46 listing of the eligible electors who register through 1 47 special late registration procedures, an eligible 1 48 elector may obtain from the commissioner of 1 49 registration a form of affidavit prescribed by the 1 50 state commissioner of elections to serve as evidence 2 1 of special late registration. If the affidavit is 2 2 completed by the elector and notarized by the 2 3 commissioner of registration or an employee of the 2 4 commissioner, the elector is deemed registered under 2 5 special late registration procedures and may present 2 6 the affidavit at the elector's polling place as proof 2 7 that the elector is registered to vote. The election 2 8 officials of the elector's precinct shall accept the 2 9 elector's affidavit of special late registration and 2 10 shall proceed as if the elector's name were listed in 2 11 the election register. 2 12 The election officials shall preserve all 2 13 affidavits submitted pursuant to this section and 2 14 forward them to the commissioner of registration at 2 15 the time the election register is returned. A 2 16 registration under this section is subject to 2 17 verification as provided in section 48A.26. 2 18 4. The commissioner may designate the precinct 2 19 polling places, in addition to the commissioner's 2 20 office, to provide access to special late registration 2 21 procedures. If the precinct polling place is 2 22 designated as a place to register to vote on election 2 23 day, the commissioner or an employee of the 2 24 commissioner shall process special late registrations 2 25 at a table separate from the precinct election 2 26 officials in order to reduce congestion at the polling 2 27 place and to avoid discouraging voters from casting a 2 28 ballot. 2 29 Sec. . Section 48A.11, subsection 1, paragraph 2 30 c, Code 2001, is amended to read as follows: 2 31 c. The address at which the registrant resides and 2 32 claims as the registrant's residence for voting 2 33 purposes. The commissioner may require proof of 2 34 residency if the registrant is registering pursuant to 2 35 section 48A.9A. The state commissioner of elections 2 36 shall designate which documents are acceptable to show 2 37 proof of residency. 2 38 Sec. . Section 48A.26, subsections 1 and 4, 2 39 Code 2001, are amended to read as follows: 2 40 1. Within seven working days of receipt of a voter 2 41 registration form or change of information in a voter 2 42 registration record the commissioner shall send an 2 43 acknowledgment to the registrant at the mailing 2 44 address shown on the registration form. However, in 2 45 the case of special late registrations, the 2 46 commissioner shall send the acknowledgment within ten 2 47 days of receipt of the special late registration. The 2 48 acknowledgment shall be sent by nonforwardable mail. 2 49 4. If the acknowledgment is returned as 2 50 undeliverable by the United States postal service, the 3 1 commissioner shall follow the procedure described in 3 2 section 48A.29, subsection 1. However, if the 3 3 acknowledgment mailed for a special late registration 3 4 is returned as undeliverable by the postal service, 3 5 the commissioner shall cancel the registration and 3 6 shall immediately notify the state commissioner of 3 7 registration and the county attorney. 3 8 Sec. . Section 48A.26, Code 2001, is amended by 3 9 adding the following new subsection: 3 10 NEW SUBSECTION. 1A. Within ten working days after 3 11 receiving a special late registration pursuant to 3 12 section 48A.9A, the commissioner shall send an 3 13 acknowledgment to the registrant at the mailing 3 14 address shown on the registration form. The 3 15 acknowledgment shall be sent by nonforwardable mail. 3 16 Sec. . Section 48A.30, subsection 1, Code 2001, 3 17 is amended by adding the following new paragraph: 3 18 NEW PARAGRAPH. g. The acknowledgment of a voter 3 19 who registered to vote under the special late 3 20 registration provisions is returned pursuant to 3 21 section 48A.29, subsection 1 or 2." 3 22 #2. Page 1, line 5, by inserting after the word 3 23 "appears" the following: "if the voter is requesting 3 24 to register on election day". 3 25 #3. Page 1, line 7, by inserting after the words 3 26 "allowed to" the following: "register to vote and 3 27 to". 3 28 #4. Page 1, by inserting after line 7, the 3 29 following: 3 30 "Sec. . Section 49.77, Code 2001, is amended by 3 31 adding the following new subsection: 3 32 NEW SUBSECTION. 6. A person whose name does not 3 33 appear on the election register of the precinct who 3 34 registers under section 48A.9A shall be allowed to 3 35 cast a ballot and the precinct election official is 3 36 not under a duty to require that the ballot be cast 3 37 under section 49.81. 3 38 Sec. . IMPLEMENTATION OF ACT. Section 25B.2, 3 39 subsection 3, shall not apply to this Act." 3 40 #5. Title page, line 1, by inserting after the 3 41 word "Act" the following: "relating to the conduct of 3 42 elections by providing for special late voter 3 43 registration on election day, by providing a 3 44 durational residency requirement for voting, and by". 3 45 #6.
