1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 40.1, Code 2001, is amended by striking
1 10 the section and inserting in lieu thereof the following:
1 11 40.1 CONGRESSIONAL DISTRICTS.
1 12 The state of Iowa is hereby organized and divided into five
1 13 congressional districts, which shall be composed,
1 14 respectively, of the following counties:
1 15 1. The first district shall consist of the counties of
1 16 Butler, Bremer, Fayette, Clayton, Black Hawk, Buchanan,
1 17 Delaware, Dubuque, Jones, Jackson, Clinton, and Scott.
1 18 2. The second district shall consist of the counties of
1 19 Linn, Johnson, Cedar, Washington, Louisa, Muscatine, Wapello,
1 20 Jefferson, Henry, Des Moines, Wayne, Appanoose, Davis, Van
1 21 Buren, and Lee.
1 22 3. The third district shall consist of the counties of
1 23 Grundy, Tama, Benton, Polk, Jasper, Poweshiek, Iowa, Marion,
1 24 Mahaska, Keokuk, Lucas, and Monroe.
1 25 4. The fourth district shall consist of the counties of
1 26 Emmet, Kossuth, Winnebago, Worth, Mitchell, Howard,
1 27 Winneshiek, Allamakee, Palo Alto, Hancock, Cerro Gordo, Floyd,
1 28 Chickasaw, Pocahontas, Humboldt, Wright, Franklin, Calhoun,
1 29 Webster, Hamilton, Hardin, Greene, Boone, Story, Marshall,
1 30 Dallas, Madison, and Warren.
1 31 5. The fifth district shall consist of the counties of
1 32 Lyon, Osceola, Dickinson, Sioux, O'Brien, Clay, Plymouth,
1 33 Cherokee, Buena Vista, Woodbury, Ida, Sac, Monona, Crawford,
1 34 Carroll, Harrison, Shelby, Audubon, Guthrie, Pottawattamie,
1 35 Cass, Adair, Mills, Montgomery, Adams, Union, Clarke, Fremont,
2 1 Page, Taylor, Ringgold, and Decatur.
2 2 Sec. 2. Section 41.1, Code 2001, is amended by striking
2 3 the section and inserting in lieu thereof the following:
2 4 41.1 REPRESENTATIVE DISTRICTS.
2 5 The state of Iowa is hereby divided into one hundred
2 6 representative districts as follows:
2 7 1. The first representative district in Woodbury county
2 8 shall consist of that portion of the city of Sioux City
2 9 bounded by a line commencing at the point the boundary of the
2 10 state of Iowa intersects the north boundary of Woodbury
2 11 county, then proceeding east along the boundary of Woodbury
2 12 county until it intersects Hamilton boulevard, then proceeding
2 13 southwesterly along Hamilton boulevard until it intersects
2 14 Buckwalter drive, then proceeding easterly, then southerly,
2 15 along Buckwalter drive until it intersects Outer Drive North,
2 16 then proceeding west along Outer Drive North until it
2 17 intersects Cheyenne boulevard, then proceeding south along

3 26 proceeding east along the boundary of Woodbury county until it
3 27 intersects the east corporate limit of the city of Sioux City,
3 28 then proceeding southerly along the corporate limits of the
3 29 city of Sioux City until it intersects Correctionville road,
3 30 then proceeding west along Correctionville road until it
3 31 intersects South Westcott street, then proceeding south along
3 32 South Westcott street until it intersects Gordon drive, then
3 33 proceeding west along Gordon drive until it intersects South
3 34 Court street, then proceeding south along South Court street
3 35 and its extension to the Missouri river until it intersects

5 13 (2) Buncombe, Logan, Nassau, Reading, Sherman, and
5 14 Washington townships.
5 15 b. In Plymouth county, Elgin, Grant, Hancock, Johnson,
5 16 Liberty, Perry, Plymouth, Portland, Preston, Sioux, Stanton,
5 17 Washington, Westfield, and America townships.
5 18 4. The fourth representative district shall consist of:
5 19 a. Lyon county.
5 20 b. In Sioux county, Capel, Eagle, Garfield, Lincoln,
5 21 Settlers, Sheridan, Sioux, Welcome, West Branch, Center,
5 22 Plato, and Rock townships, and that portion of Holland
5 23 township lying outside the corporate limits of the city of
5 24 Orange City.
5 25 5. The fifth representative district shall consist of:
5 26 a. Osceola county.
5 27 b. O'Brien county.
5 28 c. In Sioux county, East Orange, Floyd, Grant, and Lynn
5 29 townships.
5 30 d. In Clay county, Clay, Douglas, Garfield, Herdland,
5 31 Lincoln, Logan, Lone Tree, Peterson, Riverton, Summit,
5 32 Waterford, and Gillett Grove townships.
5 33 6. The sixth representative district shall consist of:
5 34 a. Dickinson county.
5 35 b. In Clay county:
6 1 (1) The city of Spencer.
6 2 (2) Freeman, Lake, Meadow, and Sioux townships.
6 3 7. The seventh representative district shall consist of:
6 4 a. Emmet county.
6 5 b. Palo Alto county.
6 6 c. In Kossuth county:
6 7 (1) The cities of Wesley and West Bend.
6 8 (2) Buffalo, Burt, Eagle, German, Grant, Greenwood,
6 9 Harrison, Hebron, Lincoln, Lotts Creek, Portland, Ramsey,
6 10 Seneca, Springfield, Swea, Wesley, Fenton, Ledyard, and Plum
6 11 Creek townships.
6 12 (3) That portion of Union township bounded by a line
6 13 commencing at the point the east boundary of Union township
6 14 intersects the north corporate limit of the city of Algona,
6 15 then proceeding first north, and then in a counterclockwise
6 16 manner along the boundary of Union township until it
6 17 intersects the west corporate limit of the city of Algona and
6 18 the east boundary of Cresco township, then proceeding first
6 19 north, and then in a clockwise manner along the corporate
6 20 limits of the city of Algona to the point of origin.
6 21 8. The eighth representative district shall consist of:
6 22 a. Humboldt county.
6 23 b. Pocahontas county.
6 24 c. In Kossuth county:
6 25 (1) The city of Algona.
6 26 (2) Irvington, Luverne, Riverdale, Sherman, Whittemore,
6 27 and Cresco townships, that portion of Garfield township lying
6 28 outside the corporate limits of the city of West Bend, that
6 29 portion of Prairie township lying outside the corporate limits
6 30 of the city of Wesley, and that portion of Union township not
6 31 contained in the seventh representative district.
6 32 d. In Webster county, Deer Creek, Jackson, and Johnson
6 33 townships.
6 34 9. The ninth representative district shall consist of:
6 35 a. The city of Dows.
7 1 b. Wright county.
7 2 c. In Hamilton county:
7 3 (1) The city of Webster City.
7 4 (2) Blairsburg, Cass, Clear Lake, Freedom, Fremont,
7 5 Hamilton, Independence, Marion, Webster, and Williams
7 6 townships.
7 7 d. In Webster county, Hardin, Pleasant Valley, Sumner,
7 8 Webster, and Yell townships, and that portion of Washington
7 9 township lying outside the corporate limits of the city of
7 10 Duncombe.
7 11 10. The tenth representative district shall consist of:
7 12 a. In Story county:
7 13 (1) The city of Kelley.
7 14 (2) Collins, Howard, Indian Creek, Lafayette, Lincoln,
7 15 Milford, Nevada, New Albany, Palestine, Richland, Sherman,
7 16 Union, and Warren townships, and that portion of Grant
7 17 township not contained in the forty-fifth representative
7 18 district.
7 19 b. In Hamilton county, Ellsworth, Lincoln, Lyon, Rose
7 20 Grove, Scott, and Liberty townships.
7 21 11. The eleventh representative district shall consist of:
7 22 a. Winnebago county.
7 23 b. Worth county.
7 24 c. In Hancock county:
7 25 (1) The city of Garner.
7 26 (2) Bingham, Boone, Britt, Concord, Crystal, Ellington,
7 27 Erin, Garfield, Madison, Magor, and Orthel townships.
7 28 12. The twelfth representative district shall consist of:
7 29 a. In Cerro Gordo county:
7 30 (1) The city of Clear Lake.
7 31 (2) Bath, Clear Lake, Dougherty, Falls, Geneseo, Grant,
7 32 Grimes, Lake, Lime Creek, Lincoln, Mount Vernon, Pleasant
7 33 Valley, and Union townships.
7 34 b. In Franklin county:
7 35 (1) The cities of Hampton and Sheffield.
8 1 (2) Geneva, Grant, Hamilton, Ingham, Lee, Marion, Mott,
8 2 Oakland, Reeve, Richland, Ross, Scott, West Fork, and Wisner
8 3 townships, that portion of Morgan township lying outside the
8 4 corporate limits of the city of Dows, and that portion of
8 5 Osceola township not contained in the forty-fourth
8 6 representative district.
8 7 c. In Hancock county, Amsterdam, Avery, Liberty, and Twin
8 8 Lake townships, and that portion of Ell township lying outside
8 9 the corporate limits of the city of Garner.
8 10 13. The thirteenth representative district in Cerro Gordo
8 11 county shall consist of:
8 12 a. The city of Mason City.
8 13 b. That portion of Mason township lying north of the
8 14 corporate limits of the city of Mason City.
8 15 14. The fourteenth representative district shall consist
8 16 of:
8 17 a. The city of Riceville.
8 18 b. Floyd county.
8 19 c. Mitchell county.
8 20 d. In Cerro Gordo county, Owen and Portland townships, and
8 21 that portion of Mason township not contained in the thirteenth
8 22 representative district.
8 23 15. The fifteenth representative district shall consist
8 24 of:
8 25 a. Chickasaw county.
8 26 b. That portion of Howard county lying outside the
8 27 corporate limits of the city of Riceville.
8 28 c. In Winneshiek county, Calmar, Fremont, Jackson,
8 29 Lincoln, Madison, Military, Orleans, Sumner, and Washington
8 30 townships.
8 31 16. The sixteenth representative district shall consist
8 32 of:
8 33 a. Allamakee county.
8 34 b. In Winneshiek county, Bloomfield, Bluffton, Burr Oak,
8 35 Canoe, Decorah, Frankville, Glenwood, Hesper, Highland,
9 1 Pleasant, and Springfield townships.
9 2 17. The seventeenth representative district shall consist
9 3 of:
9 4 a. Butler county.
9 5 b. In Bremer county:
9 6 (1) The city of Waverly.
9 7 (2) Douglas, Lafayette, Polk, Warren, and Washington
9 8 townships, that portion of Jackson township lying outside the
9 9 corporate limits of the city of Janesville, and that portion
9 10 of Jefferson township lying outside the corporate limits of
9 11 the city of Denver.
9 12 18. The eighteenth representative district shall consist
9 13 of:
9 14 a. The cities of Sumner and Janesville.
9 15 b. In Black Hawk county, Bennington, Mt. Vernon, and
9 16 Washington townships, and that portion of Lester township
9 17 lying outside the corporate limits of the city of Dunkerton.
9 18 c. In Bremer county:
9 19 (1) The city of Denver.
9 20 (2) Franklin, Frederika, Fremont, Le Roy, Maxfield,
9 21 Dayton, and Sumner townships.
9 22 d. In Fayette county:
9 23 (1) The city of West Union.
9 24 (2) Auburn, Banks, Bethel, Center, Clermont, Dover, Eden,
9 25 Fremont, Harlan, Jefferson, Windsor, and Union townships, and
9 26 that portion of Oran township lying outside the corporate
9 27 limits of the city of Fairbank.
9 28 19. The nineteenth representative district in Black Hawk
9 29 county shall consist of:
9 30 a. Union township and that portion of Cedar Falls township
9 31 lying outside the corporate limits of the city of Cedar Falls.
9 32 b. That portion of the city of Cedar Falls bounded by a
9 33 line commencing at the point the east corporate limit of the
9 34 city of Cedar Falls intersects Greenhill drive and its
9 35 extension to the corporate limits, then proceeding west along
10 1 Greenhill drive and its extension until it intersects Hillside
10 2 drive, then proceeding north along Hillside drive until it
10 3 intersects Valley High drive, then proceeding west along
10 4 Valley High drive until it intersects Clearview drive, then

10 31 corporate limit of the city of Waterloo, then proceeding north
10 32 along Hawkeye road until it intersects East San Marnan drive,
10 33 then proceeding west along East San Marnan drive until it
10 34 intersects Kimball avenue, then proceeding north along Kimball
10 35 avenue until it intersects West Ridgeway avenue, then
11 1 proceeding west along West Ridgeway avenue until it intersects
11 2 Sheridan road, then proceeding north along Sheridan road until
11 3 it intersects Berkshire road, then proceeding first west, and

11 26 Greenhill drive and its extension until it intersects Hillside
11 27 drive, then proceeding north along Hillside drive until it

11 30 proceeding north along Clearview drive until it intersects
11 31 Primrose drive, then proceeding west along Primrose drive

12 22 along Hawkeye road until it intersects East San Marnan drive,
12 23 then proceeding west along East San Marnan drive until it
12 24 intersects Kimball avenue, then proceeding north along Kimball
12 25 avenue until it intersects West Ridgeway avenue, then
12 26 proceeding west along West Ridgeway avenue until it intersects
12 27 Sheridan road, then proceeding north along Sheridan road until
12 28 it intersects Berkshire road, then proceeding first west, and
12 29 then northwest, along Berkshire road until it intersects

13 15 township not contained in the twenty-third representative
13 16 district.
13 17 c. That portion of the city of Waterloo bounded by a line
13 18 commencing at the point Leversee road intersects the north
13 19 corporate limit of the city of Waterloo, then proceeding first
13 20 east, and then in a clockwise manner along the corporate
13 21 limits of the city of Waterloo until it intersects the Cedar
13 22 river, then proceeding northwesterly along the Cedar river
13 23 until it intersects West Conger street, then proceeding
13 24 southwesterly along West Conger street until it intersects
13 25 Ansborough avenue, then proceeding southwesterly along
13 26 Ansborough avenue until it intersects Maynard avenue, then

78 21 b. The city of Carter Lake.
78 22 Sec. 3. MEMBERSHIP.
78 23 1. CONGRESSIONAL DISTRICTS. Each congressional district
78 24 established by section 1 of this Act shall elect one
78 25 representative for a term of two years in 2002 and every
78 26 subsequent even-numbered year.
78 27 2. STATE SENATE AND HOUSE DISTRICTS. The membership of
78 28 the senate and house of representatives in the eightieth and
78 29 subsequent general assemblies shall be determined as follows:
78 30 a. Each representative district established by section 2
78 31 of this Act shall elect one representative for a term of two
78 32 years in 2002 and every subsequent even-numbered year.
78 33 b. Each odd-numbered senatorial district established by
78 34 section 41.2 which the general assembly adopts by reference,
78 35 and section 2 of this Act, shall elect a senator in 2002 for a
79 1 four-year term commencing in January 2003. If an incumbent
79 2 senator who was elected to a four-year term which commenced in
79 3 January 2001, or was subsequently elected to fill a vacancy in
79 4 such a term, is residing in an odd-numbered senatorial
79 5 district on February 1, 2002, that senator's term of office
79 6 shall be terminated on January 1, 2003.
79 7 c. Each even-numbered senatorial district established by
79 8 section 41.2 which the general assembly adopts by reference,
79 9 and section 2 of this Act, shall elect a senator in 2004 for a
79 10 four-year term commencing in January 2005.
79 11 (1) If one and only one incumbent state senator is
79 12 residing in an even-numbered senatorial district on February
79 13 1, 2002, and that senator meets all of the following
79 14 requirements, the senator shall represent the district in the
79 15 senate for the Eightieth General Assembly:
79 16 (a) The senator was elected to a four-year term which
79 17 commenced in January 2001 or was subsequently elected to fill
79 18 a vacancy in such a term.
79 19 (b) The senatorial district in the plan which includes the
79 20 place of residence of the state senator on the date of the
79 21 senator's last election to the senate is the same as the even-
79 22 numbered senatorial district in which the senator resides on
79 23 February 1, 2002, or is contiguous to such even-numbered
79 24 senatorial district and the senator's declared residence as of
79 25 February 1, 2002, was within the district from which the
79 26 senator was last elected. Areas which meet only at the points
79 27 of adjoining corners are not contiguous.
79 28 (2) Each even-numbered senatorial district to which
79 29 subparagraph (1) of this paragraph "c" is not applicable shall
79 30 elect a senator in 2002 for a two-year term commencing in
79 31 January 2003. However, if more than one incumbent state
79 32 senator is residing in an even-numbered senatorial district on
79 33 February 1, 2002, and, on or before February 15, 2002, all but
79 34 one of the incumbent senators resigns from office effective no
79 35 later than January 1, 2003, the remaining incumbent senator
80 1 shall represent the district in the senate for the Eightieth
80 2 General Assembly. A copy of the resignation must be filed in
80 3 the office of the secretary of state no later than five p.m.
80 4 on February 15, 2002.
80 5 d. To fulfill the purposes of this subsection, the
80 6 secretary of state shall prescribe a form to be completed by
80 7 all senators to declare their residences as of February 1,
80 8 2002. The form shall be filed with the secretary of state no
80 9 later than five p.m. on February 1, 2002.
80 10 Sec. 4. VACANCIES.
80 11 1. MEMBER OF CONGRESS. If a special election to fill a
80 12 vacancy for a representative in Congress occurs or exists
80 13 after the effective date of this Act, at a time which makes it
80 14 necessary to fill the vacancy at a special election held
80 15 pursuant to section 69.14, the vacancy shall be filled from
80 16 the same district provided in chapter 40, Code 2001, which
80 17 elected the representative whose seat is vacant. This
80 18 subsection does not apply if a special election is not
80 19 required under section 69.14.
80 20 2. MEMBER OF GENERAL ASSEMBLY. If a vacancy in the
80 21 general assembly occurs or exists after the effective date of
80 22 this Act, at a time which makes it necessary to fill the
80 23 vacancy at a special election held pursuant to section 69.14,
80 24 the vacancy shall be filled from the same district provided in
80 25 chapter 41, Code 2001, which elected the senator or
80 26 representative whose seat is vacant. This subsection does not
80 27 apply if a special election is not required under section
80 28 69.14.
80 29 3. REPEAL. This section is repealed January 1, 2003.
80 30 Sec. 5. GEOGRAPHY. For purposes of this Act, each
80 31 reference to a specific city or township means the city or
80 32 township as its boundary existed on January 1, 2000, the
80 33 official date for establishing such boundaries under the 2000
80 34 United States decennial census. Also, for purposes of this
80 35 Act, such reference to a street or other boundary means such
81 1 street or boundary as they are delineated on the official Pub.
81 2 L. No. 94-171 census maps.
81 3 Sec. 6. EFFECTIVE DATE. This Act, being deemed of
81 4 immediate importance, takes effect upon enactment.
