  1  4 RELATING TO THE ADMINISTRATION AND MANAGEMENT OF THE
  1  5    DEPARTMENT OF PERSONNEL AND THE STATE BOARD OF REGENTS.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 19A.9, subsection 3, unnumbered
  1 10 paragraph 3, Code 2001, is amended to read as follows:
  1 11    Vacancies shall be announced publicly at least fifteen ten
  1 12 days in advance of the date fixed for the filing of
  1 13 applications therefore, and shall be advertised through the
  1 14 communications media.  The director may, however, in the
  1 15 director's discretion, continue to receive applications and
  1 16 examine candidates for a period adequate to assure a
  1 17 sufficient number of eligibles to meet the needs of the
  1 18 system, and may add the names of successful candidates to
  1 19 existing eligible lists.
  1 20    Sec. 2.  Section 19A.32, Code 2001, is amended to read as
  1 21 follows:
  1 22    19A.32  WORKERS' COMPENSATION CLAIMS.
  1 23    The director shall employ appropriate staff to handle and
  1 24 adjust claims of state employees for workers' compensation
  1 25 benefits pursuant to chapters 85, 85A, 85B, and 86, or with
  1 26 the approval of the executive council contract for the
  1 27 services or purchase workers' compensation insurance coverage
  1 28 for state employees or selected groups of state employees.  A
  1 29 state employee workers' compensation fund is established to
  1 30 pay state employee workers' compensation claims and
  1 31 administrative costs.  The department shall establish a rating
  1 32 formula and assess premiums to all agencies, departments, and
  1 33 divisions of the state including those which have not received
  1 34 an appropriation for the payment of workers' compensation
  1 35 insurance and which operate from moneys other than from the
  2  1 general fund of the state.  The department shall collect the
  2  2 premiums and deposit them into the state employee workers'
  2  3 compensation fund.  Notwithstanding section 8.33, moneys
  2  4 deposited in the state employee workers' compensation fund
  2  5 shall not revert to the general fund of the state at the end
  2  6 of any fiscal year, but shall remain in the state employee
  2  7 workers' compensation fund and be continuously available to
  2  8 pay state employee workers' compensation claims.  The director
  2  9 of revenue and finance is authorized and directed to draw
  2 10 warrants on this fund for the payment of state employee
  2 11 workers' compensation claims may, to the extent practicable,
  2 12 contract with a private organization to handle the processing
  2 13 and payment of claims and services rendered under the
  2 14 provisions of this section.
  2 15    Sec. 3.  Section 19B.5, subsections 2 and 3, Code 2001, are
  2 16 amended to read as follows:
  2 17    2.  The department of personnel shall submit a report on
  2 18 the condition of affirmative action, diversity, and
  2 19 multicultural programs in state agencies covered by subsection
  2 20 1 by September 30 of each year to the department of management
  2 21 governor and the general assembly.  The report shall include
  2 22 information identifying funding sources and itemized costs,
  2 23 including administrative costs, for these programs.
  2 24    3.  The state board of regents shall submit an annual
  2 25 report of the affirmative action, diversity, and multicultural
  2 26 accomplishments of the board and its institutions by January
  2 27 31 of each year to the department of management general
  2 28 assembly.  The report shall include information identifying
  2 29 funding sources and itemized costs, including administrative
  2 30 costs, for these programs.
  2 31    Sec. 4.  Section 19B.6, Code 2001, is amended to read as
  2 32 follows:
  2 33    19B.6  RESPONSIBILITIES OF DEPARTMENT OF PERSONNEL AND
  2 34 DEPARTMENT OF MANAGEMENT – AFFIRMATIVE ACTION.
  2 35    The department of management personnel shall oversee the
  3  1 implementation of sections 19B.1 through 19B.5 and shall work
  3  2 with the governor to ensure compliance with those sections,
  3  3 including the attainment of affirmative action goals and
  3  4 timetables, by all state agencies, including excluding the
  3  5 state board of regents and its institutions.  The department
  3  6 of management shall oversee the implementation of sections
  3  7 19B.1 through 19B.5 and shall work with the governor to ensure
  3  8 compliance with those sections, including the attainment of
  3  9 affirmative action goals and timetables, by the state board of
  3 10 regents and its institutions.
