  1  4 RELATING TO CHILD FOSTER CARE REGULATORY REQUIREMENTS AND
  1  5    PROVIDING AN EFFECTIVE DATE.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 237.3, subsection 2, paragraph f, Code
  1 10 2001, is amended to read as follows:
  1 11    f.  Housing, health, safety, and medical-care policies for
  1 12 children receiving child foster care.  The medical care
  1 13 policies shall include but are not limited to both of the
  1 14 following:
  1 15    (1)  If the health records supplied in accordance with the
  1 16 child's case permanency plan to the foster care provider are
  1 17 incomplete, provision for obtaining additional health
  1 18 information from the child's parent or other source and
  1 19 supplying the additional information to the foster care
  1 20 provider.
  1 21    (2)  Provision for emergency health coverage of the child
  1 22 while the child is engaged in temporary out-of-state travel
  1 23 with the child's foster family.
  1 24    Sec. 2.  Section 237.3, Code 2001, is amended by adding the
  1 25 following new subsection:
  1 26    NEW SUBSECTION.  10.  The department shall adopt rules to
  1 27 administer the exception to the definition of child care in
  1 28 section 237A.1, subsection 3, paragraph "m", allowing a child
  1 29 care facility, for purposes of providing respite care to a
  1 30 foster family home, to provide care, supervision, or guidance
  1 31 of a child for a period of twenty-four hours or more who is
  1 32 placed with the licensed foster family home.
  1 33    Sec. 3.  Section 237A.1, subsection 3, Code 2001, is
  1 34 amended by adding the following new paragraph:
  1 35    NEW PARAGRAPH.  m.  A child care facility providing respite
  2  1 care to a licensed foster family home for a period of twenty-
  2  2 four hours or more to a child who is placed with that licensed
  2  3 foster family home.
  2  4    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  2  5 immediate importance, takes effect upon enactment.
