PAG LIN 1 1 Section 1. NEW SECTION. 237A.14 AT-HOME INFANT CHILD 1 2 CARE PROGRAM. 1 3 1. For the purposes of this section, unless the context 1 4 otherwise requires: 1 5 a. "Eligible family" means a family which meets all of the 1 6 following requirements: 1 7 (1) The family meets the eligibility requirements for the 1 8 state child care assistance program. 1 9 (2) The family is not a participant in the family 1 10 investment program under chapter 239B, is not receiving other 1 11 cash assistance from the state or a political subdivision of 1 12 the state, and is not receiving state child care assistance 1 13 under section 237A.13 or other public assistance for child 1 14 care at the time of participation in the at-home infant child 1 15 care program. 1 16 (3) The family has not previously received the lifelong 1 17 maximum total of twelve months of assistance available under 1 18 the at-home infant child care program. 1 19 (4) The family has an infant member. 1 20 b. "Eligible parent" means a parent who meets all of the 1 21 following requirements: 1 22 (1) The parent is at least age eighteen and is a member of 1 23 an eligible family. 1 24 (2) The parent provides full-time care for the parent's 1 25 infant in the infant's home. 1 26 (3) The parent provides in-home care for any other of the 1 27 parent's children in the eligible family. 1 28 c. "Infant" means a child who is less than one year of 1 29 age. 1 30 d. "Parent" means a birth parent, adoptive parent, or 1 31 stepparent. 1 32 e. "State child care assistance program" means the state 1 33 child care assistance program established under section 1 34 237A.13. 1 35 2. The department shall establish an at-home infant child 2 1 care program in accordance with this section. The program 2 2 shall include all of the following: 2 3 a. An eligible family may participate in the at-home 2 4 infant child care program in lieu of receiving assistance 2 5 under the state child care assistance program. 2 6 b. An eligible family is limited to a lifetime total of 2 7 twelve months of assistance under the program. 2 8 c. The maximum rate of assistance payable to an eligible 2 9 family under the at-home infant child care program is seventy- 2 10 five percent of the maximum reimbursement rate payable under 2 11 the state child care assistance program for infant child care, 2 12 less any amount to be paid by the family under the sliding fee 2 13 scale applicable to the eligible family's income level and 2 14 family size under the state child care assistance program 2 15 requirements. 2 16 3. An eligible family participating in the at-home infant 2 17 child care program must comply with requirements under the 2 18 state child care assistance program for reporting income, 2 19 family changes, and other information. If an eligible family 2 20 is on a waiting list for the state child care assistance 2 21 program at the time of admission into the at-home infant child 2 22 care program, upon leaving the at-home infant child care 2 23 program the family shall reenter the state child care 2 24 assistance program at the position to which the family would 2 25 have advanced on the waiting list if the family had not been 2 26 admitted into the at-home infant child care program. 2 27 4. Implementation of the at-home infant child care program 2 28 is subject to the appropriation of funding specifically for 2 29 the program. 2 30 EXPLANATION 2 31 This bill amends the child care facilities Code chapter to 2 32 require the department of human services to establish an at- 2 33 home infant child care program for certain families that are 2 34 eligible for the state child care assistance program and are 2 35 not participating in the family investment program or 3 1 otherwise receiving other public assistance. Under program 3 2 requirements, an eligible family's infant cannot exceed 12 3 3 months of age. 3 4 The program has a lifelong maximum of 12 months of 3 5 assistance. The maximum amount payable to an eligible family 3 6 is 70 percent of the state's maximum reimbursement for infant 3 7 child care, less the state child care assistance sliding fee 3 8 scale amount payable by the family based upon family income 3 9 and family size. If a participating family was on a waiting 3 10 list for the state child care assistance program, the family 3 11 retains the family's spot on the waiting list as though 3 12 progress on the waiting list had continued while the family 3 13 participated in the at-home infant child care program. 3 14 Implementation of the at-home infant child care program is 3 15 subject to a specific appropriation of funding for the 3 16 program. 3 17 LSB 2952HH 79 3 18 jp/cls/14
