PAG LIN 1 1 Section 1. Section 239B.3, subsection 4, Code 2001, is 1 2 amended to read as follows: 1 3 4. The department may pay, from funds appropriated for 1 4 this purpose, a maximum offourtwo thousand five hundred 1 5 dollars toward funeral expenses on the death of a child who is 1 6 a participant or has been authorized to participate in the 1 7 family investment program, provided both of the following 1 8 conditions apply: 1 9 a. The decedent does not leave an estate which may be 1 10 probated with sufficient proceeds to allow for payment of the 1 11 funeral expenses. 1 12 b. Payments which are due the decedent's estate or 1 13 beneficiary by reason of the liability of a life insurance, 1 14 death or funeral benefit company, association, or society, or 1 15 in the form of United States social security, railroad 1 16 retirement, or veterans' benefits upon the death of the 1 17 decedent, are deducted from the department's payment under 1 18 this section. 1 19 Sec. 2. Section 249.9, Code 2001, is amended to read as 1 20 follows: 1 21 249.9 FUNERAL EXPENSES. 1 22 The department may pay, from funds appropriated to it for 1 23 the purpose, a maximum offourtwo thousand five hundred 1 24 dollars toward funeral expenses on the death of a person 1 25 receiving state supplementary assistance or who received 1 26 assistance under a previous categorical assistance program 1 27 prior to January 1, 1974, provided both of the following 1 28 conditions apply: 1 29 1. The decedent does not leave an estate which may be 1 30 probated with sufficient proceeds to allow for payment of the 1 31 funeral claim. 1 32 2. Payments which are due the decedent's estate or 1 33 beneficiary by reason of the liability of a life insurance, 1 34 death, or funeral benefit company, association, or society, or 1 35 in the form of United States social security, railroad 2 1 retirement, or veterans' benefits upon the death of the 2 2 decedent, are deducted from the department's liability under 2 3 this section. 2 4 EXPLANATION 2 5 This bill raises authorized state payments provided for 2 6 funeral expenses to persons qualified for state supplementary 2 7 assistance and to children participating in the family 2 8 investment program, from a maximum of $400 to a maximum of 2 9 $2,500. 2 10 LSB 3032HH 79 2 11 ta/pj/5
