  1  4 RELATING TO THE PRONOUNCEMENT OF DEATH BY A PHYSICIAN 
  1  5    ASSISTANT, A LICENSED PRACTICAL NURSE, OR A REGISTERED NURSE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 148C.4, Code 2001, is amended to read
  1 10 as follows:
  1 11    148C.4  SERVICES PERFORMED BY ASSISTANTS.
  1 12    A physician assistant may perform medical services when the
  1 13 services are rendered under the supervision of the physician
  1 14 or physicians specified in the physician assistant license
  1 15 approved by the board.  A trainee may perform medical services
  1 16 when the services are rendered within the scope of an approved
  1 17 program.  For the purposes of this section, "medical services
  1 18 rendered under the supervision of the physician or physicians
  1 19 specified in the physician assistant license approved by the
  1 20 board" includes making a pronouncement of death for a patient
  1 21 whose death is anticipated if the death occurs in a licensed
  1 22 hospital, a licensed health care facility, a Medicare-
  1 23 certified home health agency, or a Medicare-certified hospice
  1 24 program or facility, with notice of the death to a physician
  1 25 and in accordance with the directions of a physician.
  1 26    Sec. 2.  Section 152.1, subsection 4, Code 2001, is amended
  1 27 by adding the following new paragraph:
  1 28    NEW PARAGRAPH.  c.  Make the pronouncement of death for a
  1 29 patient whose death is anticipated if the death occurs in a
  1 30 licensed hospital, a licensed health care facility, a
  1 31 Medicare-certified home health agency, or a Medicare-certified
  1 32 hospice program or facility, with notice of the death to a
  1 33 physician and in accordance with any directions of a
  1 34 physician.
  1 35    Sec. 3.  Section 152.1, subsection 6, Code 2001, is amended
  2  1 by adding the following new paragraph after paragraph d:
  2  2    NEW PARAGRAPH.  dd.  Make the pronouncement of death for a
  2  3 patient whose death is anticipated if the death occurs in a
  2  4 licensed hospital, a licensed health care facility, a
  2  5 Medicare-certified home health agency, or a Medicare-certified
  2  6 hospice program or facility, with notice of the death to a
  2  7 physician and in accordance with any directions of a
  2  8 physician.
  2  9    Sec. 4.  Section 152.1, subsection 6, paragraph e, Code
  2 10 2001, is amended to read as follows:
  2 11    e.  Apply to the abilities enumerated in paragraphs "a"
  2 12 through "d" "dd" of this subsection scientific principles,
  2 13 including the principles of nursing skills and of biological,
  2 14 physical, and psychosocial sciences.
  2 15    Sec. 5.  Section 702.8, Code 2001, is amended to read as
  2 16 follows:
  2 17    702.8  DEATH.
  2 18    "Death" means the condition determined by the following
  2 19 standard:  A person will be considered dead if in the
  2 20 announced opinion of a physician, licensed pursuant to chapter
  2 21 148, 150, or 150A, a physician assistant licensed pursuant to
  2 22 chapter 148C, or a registered nurse or a licensed practical
  2 23 nurse licensed pursuant to chapter 152, based on ordinary
  2 24 standards of medical practice, that person has experienced an
  2 25 irreversible cessation of spontaneous respiratory and
  2 26 circulatory functions.  In the event that artificial means of
  2 27 support preclude a determination that these functions have
  2 28 ceased, a person will be considered dead if in the announced
  2 29 opinion of two physicians, based on ordinary standards of
  2 30 medical practice, that person has experienced an irreversible
  2 31 cessation of spontaneous brain functions.  Death will have
  2 32 occurred at the time when the relevant functions ceased.
