  1  4 RELATING TO THE FINANCIAL OPERATIONS AND TRANSACTIONS OF
  1  5    THE INFORMATION TECHNOLOGY DEPARTMENT.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 14B.102, subsection 2, Code 2001, is
  1 10 amended by adding the following new paragraphs:
  1 11    NEW PARAGRAPH.  k.  Receiving and accepting donations,
  1 12 gifts, and contributions in the form of money, services,
  1 13 materials, or otherwise, from the United States or any of its
  1 14 agencies, from this state or any of its agencies, or from any
  1 15 other person, and to using or expending such moneys, services,
  1 16 materials, or other contributions in carrying on information
  1 17 technology operations.
  1 18    NEW PARAGRAPH.  l.  Charging a negotiated fee to recover a
  1 19 share of the costs related to the research and development,
  1 20 initial production, and derivative products of the
  1 21 department's proprietary software and hardware, information
  1 22 technology architecture design, and proprietary technology
  1 23 applications developed to support authorized users, to private
  1 24 vendors and to other political entities and subdivisions,
  1 25 including but not limited to states, territories,
  1 26 protectorates, and foreign countries.  The department may
  1 27 enter into nondisclosure agreements to protect the state of
  1 28 Iowa's proprietary interests.  The provisions of chapter 23A
  1 29 relating to noncompetition by state agencies and political
  1 30 subdivisions with private enterprise shall not apply to
  1 31 department activities authorized under this paragraph.
  1 32    Sec. 2.  Section 14B.203, subsection 1, unnumbered
  1 33 paragraph 1, Code 2001, is amended to read as follows:
  1 34    The department shall collect moneys Moneys paid to a
  1 35 participating governmental entities entity from persons who
  2  1 complete an electronic financial transaction with the
  2  2 governmental entity by accessing IowAccess shall be
  2  3 transferred to the treasurer of state for deposit in the
  2  4 general fund, unless the disposition of the moneys is
  2  5 specifically provided for under other law.  The moneys may
  2  6 include all of the following:
  2  7    Sec. 3.  Section 14B.203, subsection 3, Code 2001, is
  2  8 amended by striking the subsection.
  2  9    Sec. 4.  Section 23A.2, subsection 10, Code 2001, is
  2 10 amended by adding the following new paragraph:
  2 11    NEW PARAGRAPH.  n.  The performance of an activity
  2 12 authorized pursuant to section 14B.102, subsection 2,
  2 13 paragraph "l".
