  1  4 RELATING TO THE DUTIES OF THE BOARD OF DIRECTORS OF A SCHOOL 
  1  5    DISTRICT PRIOR TO A REGULAR SCHOOL ELECTION.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  9    Section 1.  Section 279.3, unnumbered paragraph 1, Code
  1 10 2001, is amended to read as follows:
  1 11    At a regular or special meeting of the board held in July
  1 12 or August prior to or on August 15 the The board shall appoint
  1 13 a secretary who shall not be a teacher employed by the board
  1 14 but may be another employee of the board.  The board shall
  1 15 also appoint a treasurer who may be another employee of the
  1 16 board.  However, the board may appoint one person to serve as
  1 17 the secretary and the treasurer.
  1 18    Sec. 2.  Section 279.33, Code 2001, is amended to read as
  1 19 follows:
  1 20    279.33  ANNUAL SETTLEMENTS.
  1 21    At a regular or special meeting held not later than August
  1 22 15 on or after August 31 and prior to the organizational
  1 23 meeting held after the regular school election, the board of
  1 24 each school corporation shall meet, examine the books of and
  1 25 settle with the secretary and treasurer for the year ending on
  1 26 the preceding June 30, and transact other business as
  1 27 necessary.  The treasurer at the time of settlement shall
  1 28 furnish the board with a sworn statement from each depository
  1 29 showing the balance then on deposit in the depository.  If the
  1 30 secretary or treasurer fail to make proper reports for the
  1 31 settlement, the board shall take action to obtain the balance
  1 32 information.
