  1  1    Amend the amendment, H-8498, to House File 2614, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 46 the
  1  4 following:  
  1  5                     ""DIVISION    
  1  6                  USE TAX APPROPRIATION
  1  7    Sec.    .  DEPARTMENT OF PUBLIC SAFETY – USE TAX
  1  8 APPROPRIATION.  There is appropriated from use tax
  1  9 receipts collected pursuant to sections 423.7 and
  1 10 423.7A prior to their deposit in the road use tax fund
  1 11 pursuant to section 423.24, to the department of
  1 12 public safety use tax clearing fund that is
  1 13 established in the state treasury, for use of the
  1 14 department of public safety for the fiscal year
  1 15 beginning July 1, 2002, and ending June 30, 2003, the
  1 16 following amounts, or so much thereof as is necessary,
  1 17 to be allocated as follows:
  1 18    1.  For the operations, salaries, support,
  1 19 maintenance and miscellaneous purposes in the
  1 20 department of public safety:
  1 21    a.  For the department's administrative functions,
  1 22 including the criminal justice information system:  
  1 23 .................................................. $  2,462,881
  1 24    b.  For the division of criminal investigation and
  1 25 bureau of identification, including the state's
  1 26 contribution to the peace officers' retirement,
  1 27 accident, and disability system provided in chapter
  1 28 97A in the amount of 17 percent of the salaries for
  1 29 which the funds are appropriated, and to meet federal
  1 30 matching requirements:  
  1 31 .................................................. $ 12,620,790
  1 32    Riverboat enforcement costs shall be billed in
  1 33 accordance with section 99F.10, subsection 4.  The
  1 34 costs shall be based upon the total costs for the
  1 35 fiscal year.
  1 36    The department of public safety, with the approval
  1 37 of the department of management, may employ no more
  1 38 than two special agents and four gaming enforcement
  1 39 officers for each additional riverboat regulated after
  1 40 July 1, 2002, and one special agent for each racing
  1 41 facility which becomes operational during the fiscal
  1 42 year which begins July 1, 2002.
  1 43    2.  For the division of narcotics enforcement for
  1 44 undercover purchases:  
  1 45 .................................................. $    129,804
  1 46    3.  For the division of capitol police, including
  1 47 the state's contribution to the peace officers'
  1 48 retirement, accident, and disability system provided
  1 49 in chapter 97A in the amount of 17 percent of the
  1 50 salaries for which the funds are appropriated:  
  2  1 .................................................. $  1,298,828
  2  2    4.  For the division of the Iowa state patrol of
  2  3 the department of public safety, for salaries,
  2  4 support, maintenance, workers' compensation costs, and
  2  5 miscellaneous purposes, including the state's
  2  6 contribution to the peace officers' retirement,
  2  7 accident, and disability system provided in chapter
  2  8 97A in the amount of 17 percent of the salaries for
  2  9 which the funds are appropriated:  
  2 10 .................................................. $ 37,489,890
  2 11    5.  For deposit in the public safety law
  2 12 enforcement sick-leave benefit fund established under
  2 13 section 80.42, for all departmental employees eligible
  2 14 to receive benefits for accrued sick leave under the
  2 15 collective bargaining agreement:  
  2 16 .................................................. $    285,258
  2 17    6.  For the state fire marshal's office, for fire
  2 18 protection services as provided through the state fire
  2 19 service and emergency response council as created in
  2 20 the department:  
  2 21 .................................................. $    599,110
  2 22    7.  For costs associated with the training and
  2 23 equipment needs of volunteer fire fighters:  
  2 24 .................................................. $    570,091
  2 25    Notwithstanding section 8.33, moneys appropriated
  2 26 in this subsection that remain unobligated or
  2 27 unexpended at the close of the fiscal year shall not
  2 28 revert but shall remain available for expenditure only
  2 29 for the purpose designated in this subsection until
  2 30 the close of the succeeding fiscal year.
  2 31    8.  Notwithstanding section 12C.7, subsection 2,
  2 32 interest or earnings on moneys in the department of
  2 33 public safety use tax clearing fund shall be credited
  2 34 to the road use tax fund.
  2 35    Notwithstanding section 8.33, moneys appropriated
  2 36 in subsections 1 through 6 that remain unobligated or
  2 37 unencumbered at the close of the fiscal year shall not
  2 38 revert to the department of public safety use tax
  2 39 clearing fund, but shall be deposited in the road use
  2 40 tax fund."
