  1  1    Amend House File 727 as follows:
  1  2    #1.  Page 6, by inserting after line 6 the
  1  3 following:  
  1  4                      "DIVISION    
  1  5                      BILLING DATA
  1  6    Sec.    .  Section 222.73, Code 2001, is amended by
  1  7 adding the following new subsection:
  1  8    NEW SUBSECTION.  6.  The department shall provide a
  1  9 county with the data set as described in section
  1 10 331.440, subsection 1, and other information, which is
  1 11 not otherwise confidential under law, in the
  1 12 department's possession concerning a patient whose
  1 13 cost of care is chargeable to the county.  The cost of
  1 14 care shall not be chargeable without provision of the
  1 15 data set.
  1 16    Sec.    .  Section 230.20, subsection 8, Code 2001,
  1 17 is amended to read as follows:
  1 18    8.  The department shall provide a county with the
  1 19 data set as described in section 331.440, subsection
  1 20 1, and other information, which is not otherwise
  1 21 confidential under law, in the department's possession
  1 22 concerning a patient whose cost of care is chargeable
  1 23 to the county, including but not limited to the
  1 24 information specified in section 229.24, subsection 3.
  1 25 The cost of care shall not be chargeable without
  1 26 provision of the data set.
  1 27    Sec.    .  Section 249A.26, Code 2001, is amended
  1 28 by adding the following new subsection:
  1 29    NEW SUBSECTION.  4.  The department shall provide a
  1 30 county with the data set as described in section
  1 31 331.440, subsection 1, and other information, which is
  1 32 not otherwise confidential under law, in the
  1 33 department's possession concerning an individual for
  1 34 whom the nonfederal share of the cost of care is
  1 35 chargeable to the county.  The cost of care shall not
  1 36 be chargeable without provision of the data set.
  1 37    Sec.    .  Section 331.440, subsection 1, paragraph
  1 38 c, Code 2001, is amended to read as follows:
  1 39    c.  The single entry point and clinical assessment
  1 40 process shall include provision for the county's
  1 41 participation in a management information system
  1 42 developed in accordance with rules adopted pursuant to
  1 43 subsection 3 4.  The management information system
  1 44 shall include standardization of a minimum data set
  1 45 concerning the persons receiving services through the
  1 46 single entry point process.  The data set shall
  1 47 incorporate administrative information as defined in
  1 48 section 228.1 and information that is not otherwise
  1 49 confidential under law.  The data set shall be
  1 50 provided by the state and by counties as part of
  2  1 billing for services provided to a person.
  2  2    Sec. 100.  DISPUTED BILLINGS.
  2  3    1.  To the extent allowable under federal law or
  2  4 regulation, if the costs of a service are payable in
  2  5 whole or in part by a county in accordance with a
  2  6 chapter of the Code listed in this section, the
  2  7 service was rendered prior to July 1, 1997, and the
  2  8 county that would be obligated to pay for the costs of
  2  9 the service has not been billed for the service or has
  2 10 disputed the billing prior to the effective date of
  2 11 this section, or the state has fully charged off the
  2 12 cost of the service to an appropriation made in a
  2 13 prior fiscal year or has not provided the data set as
  2 14 described in section 331.440, subsection 1, as amended
  2 15 by this Act, or other information to appropriately
  2 16 document the basis for the billing, the county shall
  2 17 have no obligation to pay for the service.
  2 18    2.  This section is applicable to service costs
  2 19 that are a county obligation under the following
  2 20 chapters of the Code:
  2 21    a.  Chapter 222.
  2 22    b.  Chapter 230.
  2 23    c.  Chapter 249A.
  2 24    Sec.    .  EFFECTIVE DATE – APPLICABILITY.  This
  2 25 division of this Act, being deemed of immediate
  2 26 importance, takes effect upon enactment.  Section 100
  2 27 of this division of this Act, relating to disputed
  2 28 billings, is applicable to billings for services
  2 29 provided prior to July 1, 1997, and the remainder of
  2 30 this division of this Act is applicable to billings
  2 31 for services provided on or after July 1, 1997."
  2 32    #2.  Title page, line 5, by inserting after the
  2 33 word "dates" the following:  "and an applicability
  2 34 provision".
