  1  1    Amend Senate File 66, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 16 the
  1  4 following:
  1  5    "Sec.    .  Section 8.55, subsection 2, Code 2001,
  1  6 is amended to read as follows:
  1  7    2.  The maximum balance of the fund is the amount
  1  8 equal to five percent of the adjusted revenue estimate
  1  9 for the fiscal year.  If the amount of moneys in the
  1 10 Iowa economic emergency fund is equal to the maximum
  1 11 balance, moneys in excess of this amount shall be
  1 12 transferred to the general children first fund.
  1 13    Sec.    .  NEW SECTION.  8.57B  CHILDREN FIRST
  1 14 FUND.
  1 15    1.  A children first fund is created in the state
  1 16 treasury.  The children first fund shall be separate
  1 17 from the general fund of the state and shall not be
  1 18 considered part of the general fund of the state
  1 19 except in determining the cash position of the state
  1 20 for payment of state obligations.  The moneys in the
  1 21 children first fund are not subject to section 8.33
  1 22 and shall not be transferred, used, obligated,
  1 23 appropriated, or otherwise encumbered except as
  1 24 provided in this section.  Moneys in the children
  1 25 first fund may be used for cash flow purposes provided
  1 26 that any moneys so allocated are returned to the
  1 27 children first fund by the end of each fiscal year.
  1 28 However, the children first fund shall be considered a
  1 29 special account for the purposes of section 8.53.
  1 30    2.  Notwithstanding section 12C.7, subsection 2,
  1 31 interest or earnings on moneys deposited in the
  1 32 children first fund shall be credited to the children
  1 33 first fund.  Interest or earnings on the moneys
  1 34 deposited in the fund are subject to appropriation for
  1 35 purposes of enhancing preschool and early education
  1 36 programs for young children.  An appropriation of any
  1 37 other moneys deposited in or credited to the fund
  1 38 shall not be made unless the bill or joint resolution
  1 39 is passed by a vote of at least three-fifths of the
  1 40 members of each house of the general assembly and is
  1 41 approved by the governor."
