2 9. In order to be excused from repayment of the
3 total grant amount, a grant recipient shall remain a
4 resident of the state and be employed within the
5 state, for a period of two years after successful
6 completion of a career opportunities and resources for
7 education program. If a grant recipient changes
8 residence to another state prior to the time specified
9 by the commission, the commission shall establish a
10 plan for repayment of the total grant amount,
11 including an amount of interest to be prescribed by
12 the commission by rule, over a ten-year period. If a
13 person required to make the repayment does not make
14 the required payments, the commission shall provide
15 for payment collection.
16 10. The departments of economic development,
17 education, and workforce development, the college
18 student aid commission, and the community colleges
19 with designated programs shall jointly promote the
20 career opportunities and resources for education
21 program to all appropriate populations.
22 11. A career opportunities and resources for
23 education repayment fund is created for deposit of
24 payments made by grant recipients who do not fulfill
25 the conditions of the commission's specified residency
26 and employment requirements, and for any other moneys
27 appropriated to or received by the commission for
28 deposit in the fund. Notwithstanding section 8.33,
29 moneys deposited in the fund shall not revert to the
30 general fund of the state at the end of any fiscal
31 year, except as provided in this paragraph, but shall
32 remain in the repayment fund and be continuously
33 available to make additional grants under the program.
34 Notwithstanding section 12C.7, subsection 2, interest
35 or earnings on moneys deposited in the fund shall be
36 credited to the fund. Upon the repeal of this
37 section, moneys deposited in the fund and moneys due
38 the fund subsequent to the date of repeal shall be
39 deposited in the general fund of the state.
40 12. The commission shall adopt rules pursuant to
41 chapter 17A to administer this section.
42 13. This section is repealed on July 1, 2005.
43 Sec. 22. Section 261.25, subsection 1, Code
44 Supplement 1999, is amended to read as follows:
45 1. There is appropriated from the general fund of
46 the state to the commission for each fiscal year the
47 sum of forty-seven forty-eight million six eight
48 hundred sixty-four thirty thousand seven hundred fifty
49 seventy-five dollars for tuition grants.
50 Sec. 23. Section 261.111, subsections 2 and 4,
