1 contributions from participating entities, as defined
2 in section 256.52, subsection 3, paragraph "dd", and
3 transfers of interest, earnings, and moneys from other
4 funds as provided by law and any other contributions
5 to the fund.
6 2. Moneys in the fund are not subject to section
7 8.33. Notwithstanding section 12C.7, subsection 2,
8 interest or earnings on moneys in the fund shall be
9 credited to the fund.
10 3. Moneys in the fund are subject to appropriation
11 by the general assembly to the state librarian for the
12 purposes described in section 256.52, subsection 3,
13 paragraph "dd".
14 Sec. 18. Section 256B.15, subsection 7, paragraph
15 a, Code 1999, is amended to read as follows:
16 7. a. The treasurer of the state shall credit
17 receipts received under this section to the department
18 of human services to pay contractual fees incurred by
19 the department to maximize federal funding for special
20 education services. All remaining receipts in excess
21 of the amount necessary to pay contractual fees shall
22 be credited to the general fund of the state
23 department of human services medical assistance
24 account.
25 Sec. 19. Section 256E.2, subsection 2, Code
26 Supplement 1999, is amended to read as follows:
27 2. The department shall adopt rules concerning the
28 grant application and award process, including
29 reasonable cost estimates for beginning teacher
30 induction programs. The department may disapprove a
31 plan submitted by a board if the plan does not meet
32 the minimum criteria set forth in section 256E.3,
33 subsection 2, or the plan exceeds the reasonable costs
34 as determined by the department. If the cost
35 estimates submitted by a board exceed reasonable cost
36 estimates as determined by the department, the
37 department shall work with the board to identify
38 measures for reducing plan costs. If the department
39 determines that moneys appropriated by the general
40 assembly are insufficient to meet the grant requests
41 for all approved beginning teacher induction program
42 plans, the department shall award grants based on the
43 geographic location and district population of the
44 school districts with approved plans. Grants may be
45 awarded in subsequent years based upon the most recent
46 plan on file with the department. It is the intent of
47 the general assembly that the department approve plans
48 that incorporate local innovation and take into
49 consideration local needs.
