Weidman Weigel Whitead Wise Witt Absent or not voting, 2: Chapman Connors The bill having received a constitutional majority was declared to have passed the House and the title was agreed to. IMMEDIATE MESSAGE Siegrist of Pottawattamie asked and received unanimous consent that House File 746 be immediately messaged to the Senate. Regular Calendar Senate File 115, a bill for an act relating to alcohol testing of private sector employees and prospective employees and providing an effective date, with report of committee recommending passage, was taken up for consideration. Taylor of Linn offered the following amendment H?1258 filed by him and moved its adoption: H-1258 1 Amend Senate File 115, as passed by the Senate, as 2 follows: 3 1. By striking page 2, line 18, through page 3, 4 line 5, and inserting the following: 5 " (2) Notwithstanding any provision of this section 6 to the contrary, alcohol testing, including initial 7 and confirmatory testing, may be conducted pursuant to 8 rules adopted by the Iowa department of public health. 9 The rules shall be consistent with regulations adopted 10 by the United States department of transportation 11 governing alcohol testing as contained in 49 C.F.R., 12 pt. 40. 13 Sec. . Section 730.5, subsection 7, paragraph 14 g, Code 1999, is amended to read as follows: 15 g. A medical review officer shall, prior to the 16 results being reported to an employer, review and 17 interpret any confirmed positive test results, 18 including both quantitative and qualitative test 19 results, to ensure that the chain of custody is 20 complete and sufficient on its face and that any
