PAG LIN 1 1 Section 1. TREASURER OF STATE. There is appropriated from 1 2 the general fund of the state to the treasurer of state for 1 3 the fiscal year beginning July 1, 2000, and ending June 30, 1 4 2001, the following amount, or so much thereof as is 1 5 necessary, to be used for the purpose designated: 1 6 For debt service: 1 7 .................................................. $ 12,860,000 1 8 Funds appropriated in this section shall be deposited in a 1 9 separate fund established in the office of the treasurer of 1 10 state, to be used solely for debt service for the Iowa 1 11 communications network. The Iowa telecommunications and 1 12 technology commission shall certify to the treasurer of state 1 13 when a debt service payment is due, and upon receipt of the 1 14 certification the treasurer shall make the payment. The 1 15 commission shall pay any additional amount due from funds 1 16 deposited in the Iowa communications network fund. 1 17 Sec. 2. IOWA COMMUNICATIONS NETWORK OPERATIONS. 1 18 1. There is appropriated from the general fund of the 1 19 state to the Iowa telecommunications and technology commission 1 20 for the fiscal year beginning July 1, 2000, and ending June 1 21 30, 2001, the following amount, or so much thereof as is 1 22 necessary, to be used for the purposes designated in this 1 23 subsection: 1 24 For operations of the network consistent with chapter 8D 1 25 and for the following full-time equivalent positions: 1 26 .................................................. $ 2,981,920 1 27 ............................................... FTEs 104.00 1 28 2. Notwithstanding section 8.33 or 8.39, moneys 1 29 appropriated in this section which remain unobligated or 1 30 unexpended at the close of the fiscal year shall not revert to 1 31 the general fund of the state but shall remain available for 1 32 the purposes designated in the succeeding fiscal year, and 1 33 shall not be transferred to any other program. 1 34 3. a. It is the intent of the general assembly that the 1 35 Iowa telecommunications and technology commission annually 2 1 review the hourly rates established, as provided in section 2 2 8D.3, subsection 3, paragraph "i", consistent with this 2 3 paragraph. Such rates shall be established in a manner to 2 4 minimize any subsidy provided through state general fund 2 5 appropriations. 2 6 b. Notwithstanding paragraph "a", the general assembly 2 7 declares its support for, and that it is the intent of the 2 8 general assembly to continue, subsidization of video rates 2 9 charged to libraries, public or nonpublic schools for grades 2 10 kindergarten through twelve, private universities and 2 11 colleges, community colleges, and institutions under the 2 12 control of the state board of regents. Except for original 2 13 debt service, the Iowa telecommunications and technology 2 14 commission shall develop and implement a long-term plan for 2 15 establishing rates that will eliminate, by June 30, 2007, the 2 16 need for legislatively appropriated funds to be used for 2 17 subsidization of network costs for authorized users other than 2 18 the network costs associated with video rates charged to 2 19 public or nonpublic schools for grades kindergarten through 2 20 twelve, private universities and colleges, community colleges, 2 21 and institutions under the control of the state board of 2 22 regents. 2 23 4. It is the intent of the general assembly that the Iowa 2 24 telecommunications and technology commission enter into an 2 25 agreement for a demonstration project to provide voice service 2 26 for state government over internet protocol. Such agreement 2 27 for a demonstration project shall be entered into with a 2 28 vendor which agrees to provide any necessary equipment 2 29 associated with the project at no cost to the state. 2 30 Sec. 3. PUBLIC BROADCASTING. There is appropriated from 2 31 the general fund of the state to the public broadcasting 2 32 division of the department of education for the fiscal year 2 33 beginning July 1, 2000, and ending June 30, 2001, the 2 34 following amount, or so much thereof as is necessary, to be 2 35 used for the purposes designated in subsections 1 and 2 and 3 1 for the following full-time equivalent positions: 3 2 .................................................. $ 2,170,595 3 3 ............................................... Of the amount appropriated in this section, $478,403 3 5 shall be expended by the public broadcasting division of the 3 6 department of education to provide support for functions 3 7 related to the network, including but not limited to the 3 8 following functions: development of distance learning 3 9 applications; development of a central information source on 3 10 the Internet relating to educational uses of the network; 3 11 second-line technical support for network sites; testing and 3 12 initializing sites onto the network; and coordinating the work 3 13 of the education telecommunications council. 3 14 2. Of the amount appropriated in this section, $1,692,192 3 15 shall be allocated by the public broadcasting division of the 3 16 department of education to the regional telecommunications 3 17 councils established in section 8D.5. The regional 3 18 telecommunications councils shall use the funds to provide 3 19 technical assistance for network classrooms, planning and 3 20 troubleshooting for local area networks, scheduling of video 3 21 sites, and other related support activities. 3 22 Sec. 4. DEPARTMENT OF GENERAL SERVICES. There is 3 23 appropriated from the general fund of the state to the 3 24 division of information technology services of the department 3 25 of general services for the fiscal year beginning July 1, 3 26 2000, and ending June 30, 2001, the following amount, or so 3 27 much thereof as is necessary, to be used for the purpose 3 28 designated: 3 29 For the purpose of providing information technology 3 30 services to state agencies and for the following full-time 3 31 equivalent positions: 3 32 .................................................. $ 3,563,943 3 33 ............................................... FTEs 131.61 3 34 Sec. 5. POOLED TECHNOLOGY ACCOUNT. 3 35 1. a. A pooled technology account is established in the 4 1 office of the treasurer of state under the control of the 4 2 division of information technology services of the department 4 3 of general services and shall be used for the purpose of 4 4 supporting various technology programs as provided in this 4 5 section. 4 6 b. Notwithstanding the distribution formula contained in 4 7 section 8.62 for an operational appropriation which remains 4 8 unexpended or unencumbered for the fiscal year beginning July 4 9 1, 1999, 75 percent of the unexpended or unencumbered moneys 4 10 subject to section 8.62 are appropriated to the pooled 4 11 technology account. The remaining 25 percent of such moneys 4 12 shall remain with the entity to which the operational 4 13 appropriation was made. Notwithstanding section 8.33, for an 4 14 appropriation other than an operational appropriation as 4 15 provided in section 8.62 which remains unencumbered for the 4 16 fiscal year beginning July 1, 1999, 100 percent of the 4 17 unexpended or unencumbered moneys are appropriated to the 4 18 pooled technology account. 4 19 Notwithstanding this paragraph, the first $7,500,000 4 20 subject to reversion and appropriation to the pooled 4 21 technology account under this paragraph shall be deposited in 4 22 the general fund to be used for balancing the state's budget 4 23 for the fiscal year beginning July 1, 2000, and ending June 4 24 30, 2001. 4 25 2. Moneys in the pooled technology account are allocated, 4 26 to the extent available, in the descending priority order for 4 27 use during the fiscal year beginning July 1, 2000, and ending 4 28 June 30, 2001, as follows: 4 29 a. To the division of information technology services of 4 30 the department of general services for IowAccess: 4 31 .................................................. $ 300,000 4 32 b. A department or agency receiving an appropriation under 7 25 subsection 2 shall consult with the division of information 7 26 technology services in the department of general services 7 27 regarding any technology purchase, lease, or contract, prior 7 28 to making a purchase or entering into a lease or contract. 7 29 4. Effective July 1, 2001, the division of information 7 30 technology in the department of general services shall not 7 31 deposit any additional moneys into the pooled technology 7 32 account, unless reauthorized to do so by the general assembly 7 33 during the 2001 regular session. Funds allocated to a project 7 34 pursuant to this section which are encumbered prior to July 1, 7 35 2001, may be spent for the specified purpose as provided in 8 1 this Act. Funds which are allocated but unencumbered as of 8 2 July 1, 2001, shall revert to the general fund. 8 3 5. The department of management, in cooperation with the 8 4 division of information technology services of the department 8 5 of general services, shall develop a standard budget request 8 6 form for technology or business reengineering projects. A 8 7 department requesting funding for projects which will cost 8 8 more than $100,000 shall use the request form. The form shall 8 9 require consistent reporting criteria including, but not 8 10 limited to, project description, project goals, project 8 11 performance measures, return on investment, cost, time frame, 8 12 funding sources, and customer base. 8 13 Sec. 6. FUNDING FOR IOWACCESS. 8 14 1. Notwithstanding section 321A.3, subsection 1, for the 8 15 fiscal year beginning July 1, 2000, and ending June 30, 2001, 8 16 the first $1,000,000 collected and transferred by the 8 17 department of transportation to the treasurer of state with 8 18 respect to the fees for transactions involving the furnishing 8 19 of a certified abstract of a vehicle operating record under 8 20 section 321A.3, subsection 1, shall be allocated as follows: 8 21 a. Four hundred thousand dollars shall be transferred to 8 22 the IowAccess revolving fund created in section 18.187 and 8 23 administered by the division of information technology 8 24 services of the department of general services for the 8 25 purposes of developing, implementing, maintaining, and 8 26 expanding electronic access to government records in 8 27 accordance with the requirements set forth in chapter 18, 8 28 division VII. 8 29 b. Six hundred thousand dollars shall be transferred to 8 30 the division of information technology services of the 8 31 department of general services to be used for general 8 32 operating expenditures of the division. 8 33 2. It is the intent of the general assembly that all fees 8 34 collected with respect to transactions involving IowAccess 8 35 shall be deposited in the IowAccess revolving fund created in 9 1 section 18.187 and shall be used only for the support of 9 2 IowAccess projects. 9 3 Sec. 7. 2000 Iowa Acts, Senate File 2395, if enacted, is 9 4 amended by adding the following new section: 9 5 SEC. . NEW SECTION. 14B.102A OPERATIONS REVOLVING 9 6 FUND. 9 7 An operations revolving fund is created in the state 9 8 treasury. The operations revolving fund shall be administered 9 9 by the department and shall consist of moneys collected by the 9 10 department as fees, moneys appropriated by the general 9 11 assembly, and any other moneys obtained or accepted by the 9 12 department for deposit in the revolving fund. The proceeds of 9 13 the revolving fund are appropriated to and shall be used by 9 14 the department for the operations of the department consistent 9 15 with this chapter. The department shall submit an annual 9 16 report not later than January 31, to the members of the 9 17 general assembly and the legislative fiscal bureau, of the 9 18 activities funded by and expenditures made from the revolving 9 19 fund during the preceding fiscal year. Section 8.33 does not 9 20 apply to any moneys in the revolving fund and, notwithstanding 9 21 section 12C.7, subsection 2, earnings or interest on moneys 9 22 deposited in the revolving fund shall be credited to the 9 23 revolving fund. 9 24 Sec. 8. Section 18.183, subsections 1 and 2, Code 9 25 Supplement 1999, are amended to read as follows: 9 26 1. The government agency that is the lawful custodian of a 9 27 public record shall be responsible for determining whether a 9 28 record is required by state statute to be confidential. The 9 29 transmission of a record by a government agency by use of 9 30 electronic means established, maintained, or managed by the 9 31division of information technology servicesdepartment shall 9 32 not constitute a transfer of the legal custody of the record 9 33 from the individual government agency to thedivision of9 34information technology servicesdepartment or to any other 9 35 person or entity. 10 1 2. Thedivision of information technology services10 2 department shall not have authority to determine whether an 10 3 individual government agency should automate records of which 10 4 the individual government agency is the lawful custodian. 10 5 However, thedivisiondepartment may encourage governmental 10 6 agencies to implement electronic access to government records. 10 7 Sec. 9. Section 18.184, Code 1999, is amended to read as 10 8 follows: 10 9 18.184 FINANCIAL TRANSACTIONS. 10 10 1. Thedivision of information technology services10 11 department shall collect moneys paid to participating 10 12 governmental entities from persons who complete an electronic 10 13 financial transaction with the governmental entity by 10 14 accessingtheIowAccessnetwork. The moneys may include all 10 15 of the following: 10 16 a. Fees required to obtain an electronic public record as 10 17 provided in section 22.3A. 10 18 b. Fees required to process an application or file a 10 19 document, including but not limited to fees required to obtain 10 20 a license issued by a licensing authority. 10 21 c. Moneys owed to a governmental entity by a person 10 22 accessingtheIowAccessnetworkin order to satisfy a 10 23 liability arising from the operation of law, including the 10 24 payment of assessments, taxes, fines, and civil penalties. 10 25 2. Moneys transferred usingtheIowAccessnetworkmay 10 26 include amounts owed by a governmental entity to a person 10 27 accessingtheIowAccessnetworkin order to satisfy a 10 28 liability of the governmental entity. The moneys may include 10 29 the payment of tax refunds, and the disbursement of support 10 30 payments as defined in section 252D.16 or 598.1 as required 10 31 for orders issued pursuant to section 252B.14. 10 32 3. Thedivision of information technology services10 33 department shall serve as the agent of the governmental entity 10 34 in collecting moneys for receipt by governmental entities. 10 35 The moneys shall be transferred to governmental entities 11 1 directly or to the treasurer of state for disbursement to 11 2 governmental entities as required by the treasurer of state in 11 3 cooperation with the auditor of state. 11 4 4. In addition to other forms of payment, credit cards 11 5 shall be accepted in payment for moneys owed to a governmental 11 6 entity as provided in this section, according to rules which 11 7 shall be adopted by the treasurer of state. The fees to be 11 8 charged shall not exceed those permitted by statute. A 11 9 governmental entity may adjust its fees to reflect the cost of 11 10 processing as determined by the treasurer of state. The 11 11 discount charged by the credit card issuer may be included in 11 12 determining the fees to be paid for completing a financial 11 13 transaction under this section by using a credit card. 11 14 Sec. 10. Section 18.185, Code 1999, is amended to read as 11 15 follows: 11 16 18.185 AUDITS REQUIRED. 11 17 A technology audit of the electronic transmission system by 11 18 which government records are transmitted electronically to the 11 19 public shall be conducted not less than once annually for the 11 20 purpose of determining that government records and other 11 21 electronic data are not misappropriated or misused by the 11 22division of information technology servicesdepartment or a 11 23 contractor of thedivisiondepartment. A financial audit 11 24 shall be conducted not less than once annually to determine 11 25 the financial condition of thedivision of information11 26technology servicesdepartment and to make other relevant 11 27 inquiries. 11 28 Sec. 11. Section 18.187, Code Supplement 1999, is amended 11 29 to read as follows: 11 30 18.187 IOWACCESS REVOLVING FUND. 11 31 An IowAccess revolving fund is created in the state 11 32 treasury. The revolving fund shall be administered by the 11 33divisiondepartment and shall consist of moneys collected by 11 34 thedivisiondepartment as fees, moneys appropriated by the 11 35 general assembly, and any other moneys obtained or accepted by 12 1 thedivisiondepartment for deposit in the revolving fund. 12 2 The proceeds of the revolving fund are appropriated to and 12 3 shall be used by thedivisiondepartment to maintain, develop, 12 4 operate, and expandtheIowAccessnetworkconsistent with this 12 5chaptersubchapter. Thedivisiondepartment shall submit an 12 6 annual report not later than January 31, to the members of the 12 7 general assembly and the legislative fiscal bureau, of the 12 8 activities funded by and expenditures made from the revolving 12 9 fund during the preceding fiscal year. Section 8.33 does not 12 10 apply to any moneys in the revolving fund and, notwithstanding 12 11 section 12C.7, subsection 2, earnings or interest on moneys 12 12 deposited in the revolving fund shall be credited to the 12 13 revolving fund. 12 14 Sec. 12. Notwithstanding 1997 Iowa Acts, chapter 210, 12 15 section 10, subsection 1, paragraph "f", any moneys 12 16 appropriated to the reversion incentive program fund 12 17 established in 1997 Iowa Acts, chapter 210, section 10, which 12 18 remain unobligated or unexpended on the effective date of this 12 19 Act shall be transferred to the pooled technology account 12 20 established in section 5 of this Act. 12 21 Sec. 13. 1998 Iowa Acts, chapter 1224, section 7, 12 22 subsection 2, paragraph j, is amended to read as follows: 12 23 j. To the department of revenue and finance for a 12 24 remittance processing system: 12 25 .................................................. $ 1,500,000 12 26 Notwithstanding section 8.33, moneys allocated to the 12 27 department of revenue and finance in this paragraph "j" which 12 28 remain unobligated or unexpended at the close of the fiscal 12 29 year shall not revert but shall remain available for 12 30 expenditure for the purpose for which allocated in this 12 31 paragraph "j" for the fiscal year beginning July 1, 2000, and 12 32 ending June 30, 2001. 12 33 Sec. 14. 1998 Iowa Acts, chapter 1224, section 7, 12 34 subsection 2, paragraph r, as amended by 1999 Iowa Acts, 12 35 chapter 207, section 18, is amended to read as follows: 13 1 r. To the department of general services for a purchasing 13 2 system: 13 3 .................................................. $ 2,500,000 13 4 Notwithstanding section 8.33, moneys allocated to the 13 5 department of general services in this paragraph "r" which 13 6 remain unobligated or unexpendedat the close of the fiscal13 7yearon the effective date of this Act shallnot revert but13 8shall remain available for the purpose designated in this13 9paragraph "r" for the fiscal year beginning July 1, 1999, and13 10ending June 30, 2000be transferred to the pooled technology 13 11 account established in section 5 of this Act. 13 12 Sec. 15. 1999 Iowa Acts, chapter 196, section 1, is 13 13 amended to read as follows: 13 14 SECTION 1. DEPARTMENT OF GENERAL SERVICES EMBEDDED 13 15 CHIPS. There is appropriated from the rebuild Iowa 13 16 infrastructure fund to the division of information technology 13 17 services of the department of general services for the fiscal 13 18 year beginning July 1, 1998, and ending June 30, 1999, to 13 19 supplement the moneys in the reversion incentive program fund 13 20 as provided in 1997 Iowa Acts, chapter 210, section 10, the 13 21 following amount, or so much thereof as is necessary, to be 13 22 used for the purpose designated: 13 23 For the replacement of noncompliant year 2000 embedded 13 24 chips in the technology and equipment of state departments, 13 25 notwithstanding section 8.57, subsection 5, paragraph "c": 13 26 .................................................. $ 2,435,000 13 27 Moneys appropriated in this section shall be deposited into 13 28 the reversion incentive program fund created pursuant to 1997 13 29 Iowa Acts, chapter 210, section 10. 13 30 Notwithstanding section 8.33, moneys appropriated in this 13 31 section which remain unencumbered or unobligatedat the close13 32of the fiscal yearon the effective date of this Act shallnot13 33revert but shall remain available for expenditure for the13 34purpose designated until the close of the fiscal year13 35beginning July 1, 2000, and any unobligated or unencumbered14 1moneys remaining on that date shall be credited to the general14 2fund of the statebe transferred to the pooled technology 14 3 account established in section 5 of this Act. 14 4 Sec. 16. 1999 Iowa Acts, chapter 207, section 5, 14 5 subsection 3, paragraphs d, e, g, i, and l, are amended to 14 6 read as follows: 14 7 d. To the department of human services for a welfare 14 8 reform system (TANF): 14 9 .................................................. $ 742,555 14 10 Notwithstanding section 8.33, moneys allocated to the 14 11 department of human services in this paragraph "d" which 14 12 remain unobligated or unexpended at the close of the fiscal 14 13 year shall not revert but shall remain available for the 14 14 purpose designated for the fiscal year beginning July 1, 2000, 14 15 and ending June 30, 2001. 14 16 e. To the division of information technology services in 14 35 the department of general services for reengineering projects: 15 1 ................................................. $ 1,750,000 15 2 Of the amounts appropriated in this paragraph "i", $750,000 15 3 shall be allocated as follows: 15 4 (1) One hundred thousand dollars for the development of a 15 5 business licensure center for the department of economic 15 6 development. 15 7 (2) Five hundred thousand dollars for a community 15 8 resources directory for the department of Iowa workforce 15 9 development. 15 10 (3) One hundred fifty thousand dollars for the 15 11 implementation of an enterprise-wide information security 15 12 system plan. 15 13 Notwithstanding section 8.33, moneys allocated to the 15 14 division of information technology services in this paragraph 15 15 "i", other than the moneys allocated in this paragraph "i", 15 16 subparagraphs (1) and (3), which remain unobligated or 15 17 unexpended at the close of the fiscal year shall not revert 15 18 but shall remain available for the purpose for which allocated 15 19 in the subparagraph for the fiscal year beginning July 1, 15 20 2000, and ending June 30, 2001. 15 21 l. To the office of the governor for technology upgrades: 15 22 .................................................. $ 45,000 15 23 Notwithstanding section 8.33, moneys allocated to the 15 24 office of the governor in this paragraph "l" which remain 15 25 unobligated or unexpanded at the close of the fiscal year 15 26 shall not revert but shall remain available for the purpose 15 27 designated for the fiscal year beginning July 1, 2000, and 15 28 ending June 30, 2001. 15 29 Sec. 17. CONDITIONAL EFFECTIVENESS. 15 30 1. Sections 7 through 11 of this Act take effect upon the 15 31 effective date of an enactment of the general assembly during 15 32 the 2000 regular legislative session, signed by the governor, 15 33 which establishes an information technology department. If 15 34 sections 7 through 11 take effect pursuant to this subsection, 15 35 the Code editor shall transfer sections 18.183, 18.184, 16 1 18.185, and 18.187, as amended by this Act, and section 18.186 16 2 to the new Code chapter establishing an information technology 16 3 department, as appropriate. The term "department" in sections 16 4 18.183, 18.184, 18.185, and 18.187, as amended by this Act, 16 5 means the information technology department. 16 6 2. The references to the division of information 16 7 technology services of the department of general services in 16 8 this Act, if enacted, shall be corrected by the Code editor to 16 9 refer to the information technology department, if an 16 10 information technology department is established by enactment 16 11 of the general assembly during the 2000 regular legislative 16 12 session, and signed by the governor. 16 13 Sec. 18. EFFECTIVE DATE. Sections 5, 12, 13, 14, 15, 16, 16 14 and 17 of this Act, being deemed of immediate importance, take 16 15 effect upon enactment. 16 16 EXPLANATION 16 17 This bill relates to state government technology operations 16 18 by making appropriations to a number of entities for such 16 19 technology. Specifically the bill makes appropriations for 16 20 the 2000-2001 fiscal year from the general fund of the state 16 21 for debt service associated with the Iowa communications 16 22 network, for subsidization of operations of the network 16 23 necessary as a result of charging authorized users video rates 16 24 which generate less revenue than necessary to cover associated 16 25 costs of the network, for support functions related to the 16 26 network provided by the public broadcasting division of the 16 27 department of education, and for information technology 16 28 services provided by the division of information technology 16 29 services of the department of general services to other state 16 30 agencies. 16 31 The bill creates a pooled technology account in the office 16 32 of the treasurer of state under the control of the division of 16 33 information technology services of the department of general 16 34 services for the purpose of supporting various technology 16 35 projects. The account is to be funded by taking a portion of 17 1 funds which are subject to reversion from the 1999-2000 fiscal 17 2 year, and by transferring certain moneys which have been 17 3 previously appropriated but which have not been spent. The 17 4 technology projects specified are to be funded in the order 17 5 provided in the bill to the extent that funds are available. 17 6 The bill provides for funding for IowAccess and provides 17 7 that it is the intent of the general assembly that all fees 17 8 collected associated with transactions through IowAccess are 17 9 to be deposited in the IowAccess revolving fund created in 17 10 Code section 18.187 and shall be used only for the support of 17 11 IowAccess projects. 17 12 The bill creates a new Code section 14B.102A which creates 17 13 an operations revolving fund for an information technology 17 14 department, if such department is created during the 2000 17 15 regular session. 17 16 The bill provides for the transfer of Code sections 17 17 relating to IowAccess if an information technology department 17 18 is established during the 2000 regular session. 17 19 The bill provides that certain appropriations made in prior 17 20 years are not to revert but are to remain available for the 17 21 purposes for which appropriated for the 2000-2001 fiscal year. 17 22 The bill provides an immediate effective date for portions 17 23 of the bill. 17 24 LSB 5376JA 78 17 25 mj/gg/8.1
