  1  1    Section 1.  Section 184.7, subsections 1 and 2, Code 1999,
  1  2 are amended to read as follows:
  1  3    1.  A person shall serve as a member on the council for a
  1  4 term of three years.  A person may serve as a member on the
  1  5 council for more than one term.  However, if a person serves
  1  6 for two complete consecutive terms, the person must wait at
  1  7 least twelve months prior to serving another term.
  1  8    2.  The council shall elect a chairperson, and other
  1  9 officers as needed, from among its voting members who shall
  1 10 serve for a one-year term, and may be reelected to serve
  1 11 subsequent terms according to procedures adopted by the
  1 12 council.
  1 13    Sec. 2.  Section 184.10, unnumbered paragraph 1, Code 1999,
  1 14 is amended to read as follows:
  1 15    The Iowa egg council may do all perform any function
  1 16 related to the production and marketing of eggs or egg
  1 17 products, including but not limited to doing any of the
  1 18 following:
  1 19    Sec. 3.  Section 184.10, Code 1999, is amended by adding
  1 20 the following new subsections:
  1 21    NEW SUBSECTION.  6.  Become a dues-paying member of an
  1 22 organization carrying out a purpose related to the increased
  1 23 consumption and utilization of eggs or egg products.
  1 24    NEW SUBSECTION.  7.  Fund research and education programs
  1 25 directed toward better and more efficient production,
  1 26 marketing, and utilization of eggs and egg products.
  1 27    Sec. 4.  Section 184.11, subsections 1 and 2, Code 1999,
  1 28 are amended by striking the subsections.
  1 29    Sec. 5.  Section 184.11, subsections 3 and 4, Code 1999,
  1 30 are amended by striking the subsections and inserting in lieu
  1 31 thereof the following:
  1 32    3.  Execute a contract or act as an agent of a person who
  1 33 executes a contract for any of the following:
  1 34    a.  Selling eggs or egg products.
  1 35    b.  Selling equipment used in the manufacturing of egg
  2  1 products.
  2  2    Sec. 6.  Section 184.12, Code 1999, is amended to read as
  2  3 follows:
  2  4    184.12  COMPENSATION.
  2  5    Members of the council may receive payment for their actual
  2  6 expenses and travel in performing official council functions.
  2  7 Payment shall be made from amounts collected from the
  2  8 assessment.  A member of the council shall not be a salaried
  2  9 employee of the council or any organization or agency
  2 10 receiving moneys from the council.
  2 11    Sec. 7.  Section 184.15, Code 1999, is amended to read as
  2 12 follows:
  2 13    184.15  BOND REQUIRED.
  2 14    All persons holding positions of trust under this chapter
  2 15 shall provide a bond in an amount required by the council.
  2 16 The premiums for bond costs shall be paid from moneys
  2 17 transferred from the Iowa egg fund to the council as provided
  2 18 in section 184.13.
  2 19    Sec. 8.  EFFECTIVE DATE.  This Act, being deemed of
  2 20 immediate importance, takes effect upon enactment.  
  2 21                           EXPLANATION
  2 22    This bill amends Code chapter 184 which establishes the
  2 23 Iowa egg council.  The bill eliminates a number of
  2 24 requirements relating to the administration of the council.
  2 25 It eliminates a provision prohibiting a member of the council
  2 26 from serving more than two complete consecutive terms.  It
  2 27 eliminates a requirement that the chairperson or other officer
  2 28 of the council must serve a one-year term.  It provides for
  2 29 the powers and duties of the council, including by becoming a
  2 30 member of organizations and funding research and education
  2 31 programs.  It rewrites a provision prohibiting the council
  2 32 selling eggs or egg machinery.  It eliminates a requirement
  2 33 that prohibits a member of the council from being a salaried
  2 34 employee of an organization or agency receiving moneys from
  2 35 the council.  It eliminates a provision providing that council
  3  1 expenses and bond premiums must be paid from assessments.
