  1  1    Section 1.  Section 717B.9, Code 1999, is amended to read
  1  2 as follows:
  1  3    717B.9  INJURY OR INTERFERENCE WITH A POLICE SERVICE DOG OR
  1  4 HORSE.
  1  5    1.  A person who knowingly, and willfully or maliciously
  1  6 torments, strikes, administers a nonpoisonous desensitizing
  1  7 substance to, or otherwise interferes with a police service
  1  8 dog or horse, without inflicting serious injury on the dog or
  1  9 horse, commits a serious misdemeanor.
  1 10    2.  A person who knowingly, and willfully or maliciously
  1 11 does any of the following commits a class "D" felony:
  1 12    a.  Tortures a police service dog or horse.
  1 13    b.  Injures, so as to disfigure or disable, a police
  1 14 service dog or horse.
  1 15    c.  Sets a booby trap device for purposes of injuring, so
  1 16 as to disfigure or disable, or killing a police service dog or
  1 17 horse.
  1 18    d.  Pays or agrees to pay a bounty for purposes of injury,
  1 19 so as to disfigure or disable, or killing a police service dog
  1 20 or horse.
  1 21    e.  Kills a police service dog or horse.
  1 22    f.  Administers poison to a police service dog or horse.
  1 23    3.  As used in this section, "police service dog or horse"
  1 24 means a dog or horse used by a peace officer or correctional
  1 25 officer in the performance of the officer's duties, whether or
  1 26 not the dog or horse is on duty.
  1 27    4.  This section does not apply to a peace officer or
  1 28 veterinarian who terminates the life of such a dog or horse
  1 29 for the purpose of relieving the dog or horse of undue pain or
  1 30 suffering, or to a person who justifiably acts in defense of
  1 31 self or another.  
  1 32                           EXPLANATION 
  1 33    This bill amends Code section 717B.9 by establishing the
  1 34 new criminal offense of injury to or interference with a
  1 35 police service horse.  If a person generally torments,
  2  1 strikes, or interferes with a police horse without causing a
  2  2 serious injury, that person commits a serious misdemeanor.  A
  2  3 serious misdemeanor is punishable by imprisonment not to
  2  4 exceed one year and a fine of at least $250 but not more than
  2  5 $1,500.
  2  6    If a person generally injures, poisons, or kills a police
  2  7 horse, that person commits a class "D" felony.  A class "D"
  2  8 felony is punishable by imprisonment not to exceed five years
  2  9 and a fine of at least $500 but not more than $7,500.
  2 10    Existing law applies the same penalties to persons who
  2 11 injure or interfere with a police dog.
