PAG LIN 1 1 Amend Senate File 464 as follows: 1 2 #1. Page 24, by inserting after line 23 the 1 3 following: 1 4 "Sec. . Section 257.8, Code 1999, is amended by 1 5 adding the following new subsection: 1 6 NEW SUBSECTION. 2A. Notwithstanding the 1 7 calculation in subsection 2, the department of 1 8 management shall calculate the regular program 1 9 allowable growth for the budget year beginning July 1, 1 10 1999, by multiplying the state percent of growth for 1 11 the budget year by the regular program state cost per 1 12 pupil for the base year plus thirty-eight dollars. 1 13 Sec. . Section 257.10, subsection 5, Code 1999, 1 14 is amended to read as follows: 1 15 5. COMBINED DISTRICT COST PER PUPIL. The combined 1 16 district cost per pupil for a school district is the 1 17 sum of the regular program district cost per pupil and 1 18 the special education support services district cost 1 19 per pupil. Combined district cost per pupil does not 1 20 include additional allowable growth added for school 1 21 districts that have a negative balance of funds raised 1 22 for special education instruction programs, additional 1 23 allowable growth granted by the school budget review 1 24 committee for a single school year, or additional 1 25 allowable growth added for programs for dropout 1 26 preventionand for programs for gifted and talented1 27children. 1 28 Sec. . Section 257.42, unnumbered paragraphs 1, 1 29 4, and 5, Code 1999, are amended to read as follows: 1 30 Boards of school districts, individually or jointly 1 31 with the boards of other school districts,requesting1 32to use additional allowable growth for gifted and1 33talented children programs, mayshall annually submit 1 34 program plans for gifted and talented children 1 35 programs and budget costs, including requests for1 36additional allowable growth for funding the programs,1 37 to the department of education and to the applicable 1 38 gifted and talented children advisory council, if an 1 39 advisory council has been established, as provided in 1 40 this chapter. 1 41 The department of education shall adopt rules under 1 42 chapter 17A relating to the administration of sections 1 43 257.42 through 257.49. The rules shall prescribe the 1 44 format of program plans submitted under section 257.43 1 45 and shall require that programs fulfill specified 1 46 objectives. The department shall encourage and assist 1 47 school districts to provide programs for gifted and 1 48 talented childrenwhether or not additional allowable1 49growth is requested under this chapter. 1 50 The department may request that the staff of the 2 1 auditor of state conduct an independent program audit 2 2 to verify that the gifted and talented programsfunded2 3by additional allowable growthconform to a district's 2 4 program plans. 2 5 Sec. . Section 257.43, Code 1999, is amended to 2 6 read as follows: 2 7 257.43 PROGRAM PLANS. 2 8 The program plans submitted by school districts 2 9 shall be part of the school improvement plan submitted 2 10 pursuant to section 256.7, subsection 21, paragraph 2 11 "a", and shall include all of the following: 2 12 1. Program goals, objectives, and activities to 2 13 meet the needs of gifted and talented children. 2 14 2. Student identification criteria and procedures. 2 15 3. Staff in-service education design. 2 16 4. Staff utilization plans. 2 17 5. Evaluation criteria and procedures and 2 18 performance measures. 2 19 6. Program budget. 2 20 7. Qualifications required of personnel 2 21 administering the program. 2 22 8. Other factors the department requires. 2 23 Sec. . Section 257.45, subsection 1, Code 1999, 2 24 is amended to read as follows: 2 25 1. The board of directors of a school district 2 26requesting to use additional allowable growth for2 27gifted and talented children programsshall submit 2 28 applications for approval for the programs to the 2 29 department not later than November 1 preceding the 2 30 fiscal year during which the program will be offered. 2 31 The board shall also submit a copy of the program 2 32 plans to the gifted and talented children advisory 2 33 council, if an advisory council has been established. 2 34 The department shall review the program plans and 2 35 shall prior to January 15 either grant approval for 2 36 the program or return the request for approval with 2 37 comments of the department included. Any unapproved 2 38 request for a program may be resubmitted with 2 39 modifications to the department not later than a date 2 40 established by the department. Not later than 2 41 February 15 the department shall notify the department 2 42 of management and the school budget review committee 2 43 of the names of the school districts for which gifted 2 44 and talented children programsusing additional2 45allowable growth for fundinghave been approved and 2 46 the approved budget of each program listed separately 2 47 for each school district having an approved program. 2 48 Sec. . Section 257.46, Code 1999, is amended to 2 49 read as follows: 2 50 257.46 FUNDING. 3 1 The budget of an approved gifted and talented 3 2 children program for a school district, after 3 3 subtracting funds received from other sources for that 3 4 purpose, shall be funded annually on a basis of one- 3 5 fourth or more from the district cost of the school 3 6 districtand up to three-fourths by an increase in3 7allowable growth as defined in section 257.8.The3 8approved budget for a gifted and talented children3 9program shall not exceed an amount equal to one and3 10twenty-four-hundredths percent of the district cost3 11per pupil of the district for the base year multiplied3 12by the budget enrollment of the district for the3 13budget year. Annually, the department of management3 14shall establish a modified allowable growth for each3 15such district equal to the difference between the3 16approved budget for the gifted and talented children3 17program for that district and the sum of the amount3 18funded from the district cost of the school district3 19plus funds received from other sources.3 20 If any portion of the gifted and talented program 3 21 budget remains unexpended at the end of the budget 3 22 year, the part ofthe remainderequal to the3 23proportion of the original budget which was funded by3 24an increase in allowable growth, as defined in section3 25257.8,shall be carried over to the subsequent budget 3 26 year and added to the gifted and talented program 3 27 budget for that year." 3 28 #2.
