1 1 Amend Senate File 190 as follows:
1 2 #1. By striking everything after the enacting
1 3 clause and inserting the following:
1 4 "Section 1. Section 364.3, Code 1999, is amended
1 5 by adding the following new subsection:
1 6 NEW SUBSECTION. 7. A city which operates a cable
1 7 communications system shall manage the right of way on
1 8 a competitively neutral and nondiscriminatory basis.
1 9 Additionally, a city-operated cable communications
1 10 system shall be required to pay the same fees and
1 11 charges and comply with other requirements as may be
1 12 imposed by the city by ordinance or by the terms of a
1 13 franchise granted by the city, or as may otherwise be
1 14 imposed by the city, upon any other cable provider.
1 15 This subsection does not prohibit a city from making
1 16 an equitable apportionment of franchise requirements
1 17 between or among cable television providers, in order
1 18 to eliminate duplication. This subsection shall not
1 19 be construed to prohibit a city-operated cable
1 20 communications system from making transfers of surplus
1 21 as otherwise allowed or from making in-kind
1 22 contributions as otherwise allowed."
