  1  4 RELATING TO THE REQUIREMENTS FOR ESTABLISHING AND OPERATING
  1  5    A CITY CABLE COMMUNICATION UTILITY.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 364.3, Code 1999, is amended by adding
  1 10 the following new subsection:
  1 11    NEW SUBSECTION.  7.  A city which operates a cable
  1 12 communications system shall manage the right of way on a
  1 13 competitively neutral and nondiscriminatory basis.
  1 14 Additionally, a city-operated cable communications system
  1 15 shall be required to pay the same fees and charges and comply
  1 16 with other requirements as may be imposed by the city by
  1 17 ordinance or by the terms of a franchise granted by the city,
  1 18 or as may otherwise be imposed by the city, upon any other
  1 19 cable provider.  This subsection does not prohibit a city from
  1 20 making an equitable apportionment of franchise requirements
  1 21 between or among cable television providers, in order to
  1 22 eliminate duplication.  This subsection shall not be construed
  1 23 to prohibit a city-operated cable communications system from
  1 24 making transfers of surplus as otherwise allowed or from
  1 25 making in-kind contributions as otherwise allowed.
