REVERSION OF EXTENDED SCHOOL YEAR GRANT MONEYS. 7 28 Notwithstanding section 256.22, subsection 4, and 1998 Iowa 7 29 Acts, chapter 1216, section 1, subsection 1, the $50,000 made 7 30 available from the reduction made to the allocation in 1999 7 31 Iowa Acts, chapter 205, section 10, subsection 1, in sections 7 32 13 and 14 of this division of this Act, and any other moneys 7 33 remaining unencumbered or unobligated from the appropriation 7 34 made in 1998 Iowa Acts, chapter 1216, section 1, subsection 1, 7 35 shall revert to the credit of the general fund of the state on 8 1 the effective date of this Act. 8 2 STATE BOARD OF REGENTS 8 3 Sec. 18. 1999 Iowa Acts, chapter 205, section 13, 8 4 subsection 1, is amended by adding the following new 8 5 paragraph: 8 6 NEW PARAGRAPH. f. The sum of the appropriations made in 8 7 this subsection to the office of the state board of regents is 8 8 reduced by $6,459. Within one day of the effective date of 8 9 this lettered paragraph, the office shall notify the general 8 10 assembly, the department of management, and the legislative 8 11 fiscal bureau of the amount of reduction established by the 8 12 office for each appropriation in order to allocate the total 8 13 reduction amount required by this lettered paragraph. 8 14 Sec. 19. 1999 Iowa Acts, chapter 205, section 13, 8 15 subsection 2, is amended by adding the following new 8 16 paragraph: 8 17 NEW PARAGRAPH. q. The sum of the appropriations made in 8 18 this subsection to the state university of Iowa is reduced by 8 19 $1,563,634. Within one day of the effective date of this 8 20 lettered paragraph, the state university shall notify the 8 21 general assembly, the department of management, and the 8 22 legislative fiscal bureau of the amount of reduction 8 23 established by the state university for each appropriation in 8 24 order to allocate the total reduction amount required by this 8 25 lettered paragraph. 8 26 Sec. 20. 1999 Iowa Acts, chapter 205, section 13, 8 27 subsection 3, is amended by adding the following new 8 28 paragraph: 8 29 NEW PARAGRAPH. g. The sum of the appropriations made in 8 30 this subsection to the Iowa state university of science and 8 31 technology is reduced by $1,320,567. The regional 10 14 telecommunications councils shall use the funds to provide 10 15 technical assistance for network classrooms, planning and 10 16 troubleshooting for local area networks, scheduling of video 10 17 sites, and other related support activities. 10 18 OTHER PROVISIONS 10 19 Sec. 25. MEDICAL ASSISTANCE CLAIMING BY STATE BOARD OF 10 20 REGENTS. If the state enters into a contract to enhance 10 21 claiming of medical assistance program reimbursement payable 10 22 for services provided by the state university of Iowa 10 23 hospitals and clinics, the first $4,000,000 received in 10 24 additional reimbursement from the enhanced claiming during the 10 25 period beginning with the effective date of this Act, and 10 26 ending June 30, 2001, shall be credited to the general fund of 10 27 the state. The balance of the additional reimbursement 10 28 received during the period is appropriated to the state board 10 29 of regents for the state university of Iowa hospitals and 10 30 clinics for the contract costs and other expenses associated 10 31 with the enhanced claiming and for the provision of services. 10 32 The state board of regents shall report quarterly during the 10 33 period delineated in this section to the department of 10 34 management and the legislative fiscal bureau concerning the 10 35 enhanced claiming and reimbursement that is received and 11 1 anticipated. 11 2 Sec. 26. EDUCATIONAL EXCELLENCE PROGRAM. For the fiscal 11 3 year beginning July 1, 1999, and ending June 30, 2000, the 11 4 appropriation from the general fund of the state to the 11 5 department of education for the educational excellence program 11 6 in section 294A.25, after the allocations for Phase I and 11 7 Phase II of the program, is reduced by the following amount: 11 8 .................................................. $ 425,000 11 9 Sec. 27. FTEs 574.25 19 10 Sec. 51. 1999 Iowa Acts, chapter 202, section 20, is 19 11 amended by adding the following new subsection: 19 12 NEW SUBSECTION. 12. Notwithstanding section 97A.8, 19 13 subsection 1, paragraph "b", and the percentage amounts stated 19 14 in the appropriations made in this section, the total amount 19 15 of the state's contribution to the peace officers' retirement, 19 16 accident, and disability system for the fiscal year beginning 19 17 July 1, 1999, made in this section on or after the effective 19 18 date of this subsection shall be reduced by $1,161,207. The 19 19 department shall apply the reduction by prorating the 19 20 $1,161,207 among the enforcement divisions based upon a 19 21 division's relative share of the covered payroll for all of 19 22 the divisions. 19 23 Sec. 52. HIGHWAY SAFETY PATROL FUND. All moneys remaining 19 24 in the highway safety patrol fund created in section 80.41, 19 25 Code 1999, following the repeal of the fund on July 1, 1999, 19 26 shall be transferred and credited to the general fund of the 19 27 state on the effective date of this section of this Act. 19 28 Sec. 53. HOUSING OF FEDERAL AND COUNTY PRISONERS. For the 19 29 fiscal periods designated in subsections 1 and 2 of this 19 30 section, the department of corrections may contract for the 19 31 housing of federal and county prisoners in correctional 19 32 facilities administered by the department. Moneys received 19 33 for such housing, less the direct expenses associated with the 19 34 contract as approved by the department of management, shall be 19 35 credited to the general fund of the state. The approved 20 1 amount for direct expenses is appropriated to the department 20 2 of corrections. The department of corrections shall report 20 3 quarterly to the department of management and the legislative 20 4 fiscal bureau concerning amounts received under the contracts, 20 5 direct expenses incurred, and amounts credited to the general 20 6 fund of the state. 20 7 Moneys appropriated in this section for approved direct 20 8 expenses that remain unexpended at the close of a fiscal 20 9 period shall be credited to the general fund of the state. 20 10 The provisions of this section are applicable for the 20 11 following fiscal periods: 20 12 1. For the fiscal period beginning on the effective date 20 13 of this section and ending June 30, 2000. 20 14 2. For the fiscal year beginning July 1, 2000, and ending 20 15 June 30, 2001. 20 16 DIVISION VIII 20 17 COMMUNITY-BASED CORRECTIONS ENROLLMENT FEE 20 18 Sec. 54. Section 905.14, subsection 1, Code 1999, is 20 19 amended to read as follows: 20 20 1. A person placed on probation or parole and subject to 20 21 supervision by a district department shall be required to pay 20 22 an enrollment fee of two hundred fifty dollars to the district 20 23 department to offset the costs of supervision.The fee shall20 24be based on the offense class of the most serious offense for20 25which the person has received probation or parole, including20 26deferred judgments or deferred sentences, and shall be as20 27follows:20 28a. For a felony, one hundred fifty dollars.20 29b. For an aggravated misdemeanor, one hundred twenty-five20 30dollars.20 31c. For a serious or simple misdemeanor, one hundred20 32dollars.20 33 Sec. 55. EFFECTIVE DATE. This division of this Act, 20 34 amending section 905.14, takes effect April 1, 2000. 20 35 DIVISION IX 21 1 TRANSPORTATION 21 2 STATE DEPARTMENT OF TRANSPORTATION 21 3 Sec. 56. 1999 Iowa Acts, chapter 198, section 1, 21 4 subsection 2, is amended to read as follows: 21 52. For planning and programming, for salaries, support,21 6maintenance, and miscellaneous purposes:21 7................................................. $ 203,08521 8 DIVISION X 21 9 SALARY ADJUSTMENT, OUT-OF-STATE TRAVEL, AND OTHER PROVISIONS 21 10 Sec. 57. 1999 Iowa Acts, chapter 200, section 6, 21 11 unnumbered paragraph 1, is amended to read as follows: 21 12 There is appropriated from the general fund of the state to 21 13 the salary adjustment fund for distribution by the department 21 14 of management to the various state departments, boards, 21 15 commissions, councils, and agencies, including the state board 21 16 of regents, for the fiscal year beginning July 1, 1999, and 21 17 ending June 30, 2000, the amount of$52,800,000$50,091,029, 21 18 or so much thereof as may be necessary, to fully fund the 21 19 following annual pay adjustments, expense reimbursements, and 21 20 related benefits: 21 21 Sec. 58. INNOVATION FUND. The department of management 21 22 shall transfer $300,000 of the moneys credited to the 21 23 innovation fund created in section 8.63 to the general fund of 21 24 the state. The transfer shall be completed during the period 21 25 beginning with the effective date of this Act and ending with 21 26 the close of the fiscal year that commenced on July 1, 1999. 21 27 Sec. 59. OUT-OF-STATE TRAVEL. For the fiscal year 21 28 beginning July 1, 1999, and ending June 30, 2000, the 21 29 appropriations from the general fund of the state and the 21 30 reversion technology initiatives account listed in this 21 31 section are reduced in the overall amount of $364,021, as 21 32 necessary to effect a 25 percent reduction in expenditures for 21 33 out-of-state travel. The reduction of the individual 21 34 appropriations shall be allocated by the department of 21 35 management in consultation with the affected departments and 22 1 agencies on the basis of an individual appropriation's 22 2 proportion of the sum of the listed appropriations as adjusted 22 3 according to the department's or agency's ability to implement 22 4 the reduction. The specific amount that each individual 22 5 appropriation is reduced shall be outlined in a memorandum 22 6 prepared by the department of management which shall be 22 7 submitted to the general assembly and legislative fiscal 22 8 bureau within 30 days of the effective date of this section of 22 9 this Act. The reduction of an individual appropriation 22 10 pursuant to this section shall be in addition to any other 22 11 reduction required by law. The reduction shall apply to the 22 12 following appropriations: 22 13 1. To the indicated departments and agencies in 1999 Iowa 22 14 Acts, chapter 195. 22 15 2. To the department of general services, division of 22 16 information technology services, for embedded chips in 1999 22 17 Iowa Acts, chapter 196. 22 18 3. To the departments of economic development and 22 19 workforce development, Iowa state university of science and 22 20 technology, state university of Iowa, university of northern 22 21 Iowa, and public employee relations board in 1999 Iowa Acts, 22 22 chapter 197, sections 1, 6 through 9, and 12. 22 23 4. To the indicated state departments and agencies in 1999 22 24 Iowa Acts, chapter 199, sections 2 through 4, 6, 10 through 22 25 12, 14, subsection 1, 16, and 24. 22 26 5. To the department for the blind, departments of elder 22 27 affairs, public health, and human rights, Iowa state civil 22 28 rights commission, commission of veterans affairs, and 22 29 governor's alliance on substance abuse in 1999 Iowa Acts, 22 30 chapter 201, sections 1 through 7, and 16. 22 31 6. To the indicated state departments and agencies for 23 11 purposes of state government technology and operations in 1999 23 12 Iowa Acts, chapter 207, sections 2 through 5. 23 13 DIVISION XI 23 14 EFFECTIVE DATE 23 15 Sec. 60. EFFECTIVE DATE. Except as otherwise provided in 23 16 this Act, this Act, being deemed of immediate importance, 23 17 takes effect upon enactment. 23 18 EXPLANATION 23 19 This bill provides for reductions and supplementation of 23 20 appropriations for the fiscal year beginning July 1, 1999. 23 21 The bill amends Code section 905.14, relating to enrollment 23 22 fees charged to persons placed on parole subject to 23 23 supervision by a judicial district department of corrections. 23 24 The bill strikes enrollment fee amounts specified for simple, 23 25 serious, and aggravated misdemeanors, and felonies and 23 26 establishes an enrollment fee of $250 for all of those offense 23 27 levels. This provision takes effect April 1, 2000. The 23 28 remainder of the bill takes effect upon enactment. As part of 23 29 the appropriation reduction applicable to the Iowa department 23 30 of public health for promoting the health status of children 23 31 and adolescents, allocation language for a grant of $75,000 to 23 32 provide primary and preventive health care for children, is 23 33 stricken. 23 34 LSB 5171XG 78 23 35 jp/as/5.3
