  1  1    Section 1.  Section 602.8108A, subsection 1, Code
  1  2 Supplement 1999, is amended to read as follows:
  1  3    1.  The Iowa prison infrastructure fund is created and
  1  4 established as a separate and distinct fund in the state
  1  5 treasury.  Notwithstanding any other provision of this chapter
  1  6 to the contrary, the first eight million dollars and,
  1  7 beginning July 1, 1997 2000, the first nine eight million five
  1  8 four hundred thousand dollars, of moneys remitted to the
  1  9 treasurer of state from fines, fees, costs, and forfeited bail
  1 10 collected by the clerks of the district court in criminal
  1 11 cases, including those collected for both scheduled and
  1 12 nonscheduled violations, collected in each fiscal year
  1 13 commencing with the fiscal year beginning July 1, 1995, shall
  1 14 be deposited in the fund.  Interest and other income earned by
  1 15 the fund shall be deposited in the fund.  However, beginning
  1 16 with the fiscal year beginning July 1, 1998, all fines and
  1 17 fees attributable to commercial vehicle violation citations
  1 18 issued after July 1, 1998, shall be deposited as provided in
  1 19 section 602.8108, subsection 5.  If the treasurer of state
  1 20 determines pursuant to 1994 Iowa Acts, chapter 1196, that
  1 21 bonds can be issued pursuant to this section and section
  1 22 16.177, then the moneys in the fund are appropriated to and
  1 23 for the purpose of paying the principal of, premium, if any,
  1 24 and interest on bonds issued by the Iowa finance authority
  1 25 under section 16.177.  Except as otherwise provided in
  1 26 subsection 2, amounts in the funds shall not be subject to
  1 27 appropriation for any purpose by the general assembly, but
  1 28 shall be used only for the purposes set forth in this section.
  1 29 The treasurer of state shall act as custodian of the fund and
  1 30 disburse amounts contained in it as directed by the department
  1 31 of corrections including the automatic disbursement of funds
  1 32 pursuant to the terms of bond indentures and documents and
  1 33 security provisions to trustees and custodians.  The treasurer
  1 34 of state is authorized to invest the funds deposited in the
  1 35 fund subject to any limitations contained in any applicable
  2  1 bond proceedings.  Any amounts remaining in the fund at the
  2  2 end of each fiscal year shall be transferred to the general
  2  3 fund of the state.  
  2  4                           EXPLANATION
  2  5    This bill amends Code section 602.8108A to decrease the
  2  6 amount of money deposited in the Iowa prison infrastructure
  2  7 fund in each fiscal year from the first $9.5 million collected
  2  8 by the clerks of the district court from fines, fees, costs,
  2  9 and forfeited bail in criminal cases to the first $8.4 million
  2 10 so collected.
