PAG LIN 1 1 HOUSE FILE 2153 1 2 1 3 AN ACT 1 4 RELATING TO DRUG POLICY COORDINATION, INCLUDING ESTABLISHMENT 1 5 OF A DRUG POLICY COORDINATOR, THE GOVERNOR'S OFFICE OF DRUG 1 6 CONTROL POLICY, AND A DRUG POLICY ADVISORY COUNCIL. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 80E.1, subsection 1, Code 1999, is 1 11 amended to read as follows: 1 12 1. A drugenforcement and abuse preventionpolicy 1 13 coordinator shall be appointed by the governor, subject to 1 14 confirmation by the senate, and shall serve at the pleasure of 1 15 the governor. The governor shall fill a vacancy in the office 1 16 in the same manner as the original appointment was made. The 1 17 coordinator shall be selected primarily for administrative 1 18 ability. The coordinator shall not be selected on the basis 1 19 of political affiliation and shall not engage in political 1 20 activity while holding the office. The salary of the 1 21 coordinator shall be fixed by the governor. 1 22 Sec. 2. Section 80E.1, subsection 2, paragraph a, Code 1 23 1999, is amended to read as follows: 1 24 a.CoordinateDirect the governor's office of drug control 1 25 policy, and coordinate and monitor all statewide narcotics 1 26 enforcement efforts, coordinate and monitor all state and 1 27 federal substance abuse treatment grants and programs, 1 28 coordinate and monitor all statewide substance abuse 1 29 prevention and education programs in communities and schools, 1 30 and engage in such other related activities as required by 1 31 law. The coordinator shall work in coordinating the efforts 1 32 of the department of corrections, the department of education, 1 33 the Iowa department of public health, the department of public 1 34 safety, and the department of human services. The coordinator 1 35 shall assist in the development and implementation of local 2 1 and community strategies to fight substance abuse, including 2 2 local law enforcement, education, and treatment activities. 2 3 Sec. 3. Section 80E.2, subsection 1, Code 1999, is amended 2 4 to read as follows: 2 5 1. An Iowa drugabuse prevention and educationpolicy 2 6 advisory council is established which shall consist of the 2 7 followingninefifteen members: 2 8 a. The drugenforcement and abuse preventionpolicy 2 9 coordinator, who shall serve as chairperson of the council. 2 10 b. The director of the department of corrections, or the 2 11 director's designee. 2 12 c. The director of the department of education, or the 2 13 director's designee. 2 14 d. The director of the Iowa department of public health, 2 15 or the director's designee. 2 16 e. The commissioner of public safety, or the 2 17 commissioner's designee. 2 18 f. The director of the department of human services, or 2 19 the director's designee. 2 20 ff. The director of the division of criminal and juvenile 2 21 justice planning, in the department of human rights, or the 2 22 division director's designee. 2 23 g. A prosecuting attorney. 2 24 h. A licensed substance abuse treatment specialist. 2 25 i. Alaw enforcement officercertified substance abuse 2 26 prevention specialist. 2 27 j. A substance abuse treatment program director. 2 28 k. A justice of the Iowa supreme court, or judge, as 2 29 designated by the chief justice of the supreme court. 2 30 l. A member representing the Iowa association of chiefs of 2 31 police and peace officers. 2 32 m. A member representing the Iowa state police 2 33 association. 2 34 n. A member representing the Iowa state sheriffs' and 2 35 deputies' association. 3 1 The prosecuting attorney, licensed substance abuse 3 2 treatment specialist, certified substance abuse prevention 3 3 specialist, substance abuse treatment program director, member 3 4 representing the Iowa association of chiefs of police and 3 5 peace officers, member representing the Iowa state police 3 6 association, andlaw enforcement officerthe member 3 7 representing the Iowa state sheriffs' and deputies' 3 8 association shall be appointed by the governor, subject to 3 9 senate confirmation, for four-year terms beginning and ending 3 10 as provided in section 69.19. A vacancy on the council shall 3 11 be filled for the unexpired term in the same manner as the 3 12 original appointment was made. 3 13 Sec. 4. Section 80E.2, subsection 2, Code 1999, is amended 3 14 to read as follows: 3 15 2. The council shall make policy recommendations to the 3 16 appropriate departments concerning the administration, 3 17 development, and coordination of programs related to substance 3 18 abuse education, prevention,andtreatment, and enforcement. 3 19 Sec. 5. Section 232.190, subsection 1, Code 1999, is 3 20 amended to read as follows: 3 21 1. A community grant fund is established in the state 3 22 treasury under the control of the division of criminal and 3 23 juvenile justice planning of the department of human rights 3 24 for the purposes of awarding grants under this section. The 3 25 criminal and juvenile justice planning advisory council and 3 26 the juvenile justice advisory council shall assist the 3 27 division in administering grants awarded under this section. 3 28 The departments of education, human services, public health, 3 29 and public safety, and the governor'salliance on substance3 30abuseoffice of drug control policy shall advise the division 3 31 on grant application and selection criteria and performance 3 32 measures for the programs. Not more than five percent of the 3 33 moneys appropriated to the fund shall be used for 3 34 administrative purposes. 3 35 Sec. 6. Section 235C.2, subsection 13, Code Supplement 4 1 1999, is amended to read as follows: 4 2 13. A representative from the governor'salliance on4 3substance abuseoffice of drug control policy selected by the 4 4allianceoffice. 4 5 Sec. 7. Section 256.41, subsection 9, Code 1999, is 4 6 amended to read as follows: 4 7 9. The drugenforcement and abuse preventionpolicy 4 8 coordinator shall serve as an ex officio and nonvoting member. 4 9 Sec. 8.
