PAG LIN 1 1 Section 1. Section 692A.7, subsection 1, Code 1999, is 1 2 amended to read as follows: 1 3 1. Awillful failure to register as required under this1 4chapter isperson required to register under this chapter who 1 5 knowingly violates any requirements specified under sections 1 6 692A.2 through 692A.4 commits an aggravated misdemeanor for a 1 7 first offense and a class "D" felony for a second or 1 8 subsequent offense. However, a personwho willfully fails to1 9register as required under this chapterrequired to register 1 10 under this chapter who knowingly violates any of the 1 11 requirements specified under sections 692A.2 through 692A.4 1 12 and who commits a criminal offense against a minor, sexual 1 13 exploitation, an other relevant offense, or a sexually violent 1 14 offense is guilty of a class "C" felony. Any fine imposed for 1 15 a second or subsequentoffenseviolation shall not be 1 16 suspended. The court shall not defer judgment or sentence for 1 17 any violation ofthe registrationany requirementsof this1 18chapterspecified under sections 692A.2 through 692A.4.The1 19willful failureA knowing violation of a person who is on 1 20 probation, parole,orwork release, or any other form of 1 21 release toregister as required under this chaptercomply with 1 22 any requirements specified under sections 692A.2 through 1 23 692A.4 shall result in the automatic revocation of the 1 24 person's probation, parole, or work release. 1 25 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 26 immediate importance, takes effect upon enactment. 1 27 EXPLANATION 1 28 This bill makes changes to the criminal penalties relating 1 29 to the sex offender registry. The bill provides that an 1 30 offender who knowingly violates any provision in Code sections 1 31 692A.2 through 692A.4 of the sex offender registry law commits 1 32 an aggravated misdemeanor for a first offense and a class "D" 1 33 felony for a second or subsequent offense. The bill also 1 34 provides that an offender who knowingly violates Code sections 1 35 692A.2 through 692A.4 of the sex offender registry law and 2 1 subsequently commits an offense against a minor or certain 2 2 sexual offenses commits a class "C" felony. The bill also 2 3 provides that an offender shall have the offender's probation, 2 4 parole, or work release revoked if the offender knowingly 2 5 commits a violation. 2 6 A class "C" felony is punishable by confinement for no more 2 7 than 10 years and a fine of at least $1,000 but not more than 2 8 $10,000. A class "D" felony is punishable by confinement for 2 9 no more than five years and a fine of at least $750 but not 2 10 more than $7,500. An aggravated misdemeanor is punishable by 2 11 confinement for no more than two years and a fine of at least 2 12 $500 but not more than $5,000. 2 13 The bill takes effect upon enactment. 2 14 LSB 5193HV 78 2 15 jm/gg/8
