  1  1    Section 1.  Section 8D.2, subsection 5, Code 1999, is
  1  2 amended to read as follows:
  1  3    5.  "Public agency" means a state agency, an institution
  1  4 under the control of the board of regents, the judicial branch
  1  5 as provided in section 8D.13, subsection 17, a school
  1  6 corporation, a city library, a regional library as provided in
  1  7 chapter 256, a county library as provided in chapter 336, a
  1  8 city, a county, or a judicial district department of
  1  9 correctional services established in section 905.2, to the
  1 10 extent provided in section 8D.13, subsection 15, an agency of
  1 11 the federal government, or a United States post office which
  1 12 receives a federal grant for pilot and demonstration projects.
  1 13    Sec. 2.  Section 8D.11, subsection 4, Code 1999, is amended
  1 14 to read as follows:
  1 15    4.  A political subdivision receiving communications
  1 16 services from the state as of April 1, 1986, may continue to
  1 17 do so but communications services shall not be provided or
  1 18 resold to additional political subdivisions other than a city,
  1 19 a county, a school corporation, a city library, a regional
  1 20 library as provided in chapter 256, and a county library as
  1 21 provided in chapter 336.  The rates charged to the political
  1 22 subdivision shall be the same as the rates charged to state
  1 23 agencies.
  1 24    Sec. 3.  Section 8D.13, Code Supplement 1999, is amended by
  1 25 adding the following new subsection:
  1 26    NEW SUBSECTION.  20.  Access to the network shall be
  1 27 offered to cities and counties.  A city or county shall be
  1 28 responsible for all costs associated with becoming a part of
  1 29 the network.
  1 30    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  1 31 immediate importance, takes effect upon enactment.  
  1 32                           EXPLANATION
  1 33    This bill defines cities and counties as public agencies
  1 34 for purposes of the Iowa communications network.  Access to
  1 35 the network is to be offered to cities and counties so long as
  2  1 a city or county pays for all costs associated with becoming a
  2  2 part of the network.
  2  3    The bill would take effect upon enactment.
