  1  1    Section 1.  Section 256.44, Code 1999, is amended by
  1  2 striking the section and inserting in lieu thereof the
  1  3 following:
  1  4    256.44  NATIONAL BOARD CERTIFICATION PILOT PROJECT –
  1  5 APPROPRIATION.
  1  6    1.  A national board certification pilot project is
  1  7 established to be administered by the department of education.
  1  8 A teacher, as defined in section 272.1, who registered for
  1  9 national board for professional teaching standards
  1 10 certification by January 1, 1999, and is employed by a school
  1 11 district in Iowa and receiving a salary as a classroom
  1 12 teacher, shall be eligible for the following:
  1 13    a.  A reimbursement award in the amount of one thousand
  1 14 dollars for the registration fee charged by the national board
  1 15 for professional teaching standards.  The teacher shall apply
  1 16 to the department of education within one year of
  1 17 registration, submitting to the department any documentation
  1 18 the department requires.
  1 19    b.  An annual award in the amount of three thousand dollars
  1 20 for up to fifteen years upon achieving certification by the
  1 21 national board of professional teaching standards.  A teacher
  1 22 shall apply to the department for an award within one year of
  1 23 eligibility.  Payment for awards shall be made only upon
  1 24 departmental approval of an application or recertification of
  1 25 eligibility.  A term of eligibility shall be for fifteen years
  1 26 or for the years in which the individual maintains a valid
  1 27 certificate, whichever time period is shorter.  However, the
  1 28 department shall award not more than forty-five thousand
  1 29 dollars to an individual during the individual's term of
  1 30 eligibility for annual awards.  In order to continue receipt
  1 31 of payments, a recipient shall annually recertify eligibility.
  1 32    2.  Reimbursement payments and annual awards shall be made
  1 33 on a first-come, first-served basis and are subject to
  1 34 sufficient funds being appropriated by the general assembly.
  1 35    3.  A teacher receiving an annual award pursuant to this
  2  1 section shall provide additional services to the school
  2  2 district that employs the teacher.  Additional services may
  2  3 include, but are not limited to, mentoring beginning teachers
  2  4 and providing professional guidance and assistance to
  2  5 ineffectual teachers.  The additional services to be provided
  2  6 by the teacher shall be mutually agreed upon by the school
  2  7 district and the teacher.
  2  8    4.  A national board for professional teaching standards
  2  9 certification fund is established in the office of treasurer
  2 10 of state to be administered by the department.  Moneys
  2 11 appropriated by the general assembly for deposit in the fund
  2 12 shall be paid as follows:
  2 13    a.  Upon receipt of reimbursement documentation as provided
  2 14 in subsection 1, paragraph "a".
  2 15    b.  On April 15 to teachers whose applications and
  2 16 recertifications for annual awards as provided in subsection
  2 17 1, paragraph "b", are approved by the department.
  2 18    The treasurer of state shall act as custodian of the fund
  2 19 and may invest the moneys deposited in the fund.  The director
  2 20 of revenue and finance shall issue warrants upon the fund
  2 21 pursuant to the order of the department and such warrants
  2 22 shall be paid from the fund by the treasurer of state.
  2 23 Notwithstanding section 8.33, unencumbered or unobligated
  2 24 moneys remaining in the fund on June 30 of the fiscal year for
  2 25 which the funds were appropriated shall not revert but shall
  2 26 be available for subsequent fiscal years for the purposes of
  2 27 this section.  Notwithstanding section 12C.7, subsection 2,
  2 28 interest or earnings on moneys deposited in the national board
  2 29 for professional teaching standards certification fund shall
  2 30 be credited to the fund.
  2 31    5.  Notwithstanding any provision to the contrary, a
  2 32 teacher approved by the department to receive an annual award
  2 33 for certification in accordance with this section in the
  2 34 fiscal year beginning July 1, 1998, shall receive the annual
  2 35 award amount specified in this section to commence with the
  3  1 fiscal year beginning July 1, 1999.  
  3  2                           EXPLANATION 
  3  3    This bill strikes from the Code the original national board
  3  4 certification award provisions, and replaces those provisions
  3  5 with language establishing a national board certification
  3  6 pilot project to be administered by the department of
  3  7 education.
  3  8    Under the pilot project, a teacher, who registered by
  3  9 January 1, 1999, for and achieves a national board certificate
  3 10 and who is employed by a school district in Iowa, shall be
  3 11 eligible for the following:
  3 12    1.  A reimbursement payment in the amount of $1,000 for the
  3 13 registration fee charged by the national board.
  3 14    2.  An annual award in the amount of $3,000 once
  3 15 certification is achieved.
  3 16    The nonrenewable term of award eligibility is for 15 years
  3 17 or while the certificate is valid, whichever time period is
  3 18 shorter.  However, the department is prohibited from awarding
  3 19 an amount of more than $45,000 to any one individual during
  3 20 the individual's term of eligibility for annual awards.
  3 21    Reimbursement payments and annual awards shall be made on a
  3 22 first-come, first-served basis subject to the availability of
  3 23 appropriated funds.
  3 24    A teacher receiving an annual award must provide additional
  3 25 services to the school district of employment.  Additional
  3 26 services may include, but are not limited to, mentoring
  3 27 beginning teachers and providing professional guidance and
  3 28 assistance to ineffectual teachers.  The school district and
  3 29 the teacher must mutually agree upon the additional services
  3 30 to be provided.
  3 31    The bill establishes a national board for professional
  3 32 teaching standards certification fund in the office of
  3 33 treasurer of state to be administered by the department.
  3 34 Moneys appropriated for the pilot project are to be deposited
  3 35 in the fund, and the director of revenue and finance shall
  4  1 issue warrants upon the fund based on the amounts of
  4  2 reimbursement and award amounts determined by the department
  4  3 of education.  The treasurer of state pays the warrants from
  4  4 the fund.  The bill permits moneys in the fund to carry over
  4  5 to be available for subsequent fiscal years for the purposes
  4  6 of the pilot project.  Interest or earnings on moneys
  4  7 deposited in the fund shall be credited to the fund.
