PAG LIN 1 1 Section 1. Section 19A.9, Code 1999, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 21A. For the rejection of applicants for 1 4 employment for the failure to comply with the requirement to 1 5 register with the selective service system in accordance with 1 6 the federal Military Selective Service Act, 50 U.S.C. App. 1 7 453. 1 8 Sec. 2. Section 260C.14, Code 1999, is amended by adding 1 9 the following new subsection: 1 10 NEW SUBSECTION. 21. Prohibit the award of a state- 1 11 supported loan, grant, or scholarship to a male individual if 1 12 the individual is between the ages of eighteen and twenty-six 1 13 years and has not registered with the federal selective 1 14 service system in accordance with the federal Military 1 15 Selective Service Act, 50 U.S.C. App. 453. The board shall 1 16 include as part of the community college admission form a 1 17 statement of selective service, which shall be filled out by 1 18 any male applicant between the ages of eighteen and twenty-six 1 19 years. The statement shall include space for the applicant to 1 20 record the selective service number assigned to the applicant 1 21 and shall certify one of the following: 1 22 a. That the applicant has registered with the selective 1 23 service system in accordance with the Military Selective 1 24 Service Act, 50 U.S.C. App. 453. 1 25 b. That the applicant is not required to register with the 1 26 selective service system for one of the following reasons: 1 27 (1) The applicant is on active duty with the armed forces 1 28 of the United States other than for training in a reserve or 1 29 national guard unit. 1 30 (2) The applicant is a nonimmigrant alien lawfully in the 1 31 United States in accordance with section 101(a)(15) of the 1 32 federal Immigration and Nationality Act, 8 U.S.C. } 1101. 1 33 (3) The applicant is not a citizen of the United States 1 34 and is a permanent resident of the Trust Territory of the 1 35 Pacific Islands or the Northern Mariana Islands. 2 1 If the institution awards or approves a state-supported 2 2 loan, grant, or scholarship to a male applicant who is less 2 3 than eighteen years of age, the community college shall 2 4 require the student to file a revised statement of selective 2 5 service status after reaching the age of eighteen. The 2 6 community college shall not award or renew a state-supported 2 7 loan, grant, or scholarship to the student until the student 2 8 submits a statement certifying that the student is registered 2 9 with the federal selective service system or is exempt from 2 10 registration. For an applicant not required to register with 2 11 the federal selective service system, the statement shall 2 12 include space for certification of nonregistration and for an 2 13 explanation of the reason for the exemption. The board may 2 14 require that the statement be accompanied by any documentation 2 15 the board deems necessary. 2 16 Sec. 3. Section 262.9, Code 1999, is amended by adding the 2 17 following new subsection: 2 18 NEW SUBSECTION. 30. Prohibit the institutions of higher 2 19 learning under its control from awarding a state-supported 2 20 loan, grant, or scholarship to a male individual if the 2 21 individual is between the ages of eighteen and twenty-six 2 22 years and has not registered with the federal selective 2 23 service system in accordance with the federal Military 2 24 Selective Service Act, 50 U.S.C. App. 453. Each institution 2 25 of higher learning under the control of the regents is 2 26 directed to include as part of its admission form a statement 2 27 of selective service, which shall be filled out by any male 2 28 applicant between the ages of eighteen and twenty-six years. 2 29 The statement shall include space for the applicant to record 2 30 the selective service number assigned to the applicant and 2 31 shall certify one of the following: 2 32 a. That the applicant has registered with the selective 2 33 service system in accordance with the Military Selective 2 34 Service Act, 50 U.S.C. App. 453. 2 35 b. The board may 3 24 direct the institutions to require that the statement be 3 25 accompanied by any documentation the board deems necessary. 3 26 Sec. 4. NEW SECTION. 280.9C SELECTIVE SERVICE 3 27 REGISTRATION. 3 28 At least twice during each school year, the board of 3 29 directors of each public school district operating a high 3 30 school and the authorities in charge of each accredited 3 31 nonpublic school operating a high school shall offer the 3 32 opportunity to each eligible student to register with the 3 33 selective service system in accordance with the federal 3 34 Military Selective Service Act, 50 U.S.C. App. 453. 3 35 EXPLANATION 4 1 The bill deals with the registration of individuals 4 2 required to be registered with the selective service system in 4 3 accordance with federal law. 4 4 The bill provides that the department of personnel adopt 4 5 rules providing that individuals who fail to register with the 4 6 selective service system shall be rejected for employment 4 7 subject to the state merit system. 4 8 This bill also directs the state board of regents and the 4 9 boards of directors of the community colleges to prohibit the 4 10 institutions of higher learning under their control from 4 11 awarding any male individual a state-supported loan, grant, or 4 12 scholarship if the individual is between the ages of 18 and 26 4 13 years and has not registered with the federal selective 4 14 service system in accordance with the federal Military 4 15 Selective Service Act. 4 16 Each institution or board is directed to include on its 4 17 admission form a statement of selective service, which shall 4 18 be filled out by any male applicant between the ages of 18 and 4 19 26. The statement shall include space for the applicant to 4 20 record the selective service number assigned to the applicant 4 21 and to either indicate that the applicant is registered or 4 22 explain why the applicant is not required to register. 4 23 A male student who enrolled at less than 18 years of age is 4 24 required to file a revised statement of selective service 4 25 status after reaching the age of 18, and until the student 4 26 does, the student shall not be awarded, or receive a renewal 4 27 for, a state-supported loan, grant, or scholarship. For those 4 28 applicants not required to register with the federal selective 4 29 service system, the statement shall include space for 4 30 certification of nonregistration and for an explanation of the 4 31 reason for the exemption. The board may require that the 4 32 statements be accompanied by documentation. 4 33 The bill also provides that all private and public high 4 34 schools offer students, at least twice a year, the opportunity 4 35 to register with the selective service system. 5 1 LSB 2145YH 78 5 2 ec/jw/5.1
