  1  1    Section 1.  NEW SECTION.  714.7B  DOG THEFT.
  1  2    A person commits a serious misdemeanor if the person takes
  1  3 possession or control of a dog with the intention to deprive
  1  4 the dog's owner of the possession or control of the dog and if
  1  5 the person does not have the right or authority to destroy or
  1  6 kill the dog.  
  1  7                           EXPLANATION
  1  8    This bill creates the new criminal offense of theft of a
  1  9 dog.  If a person takes possession of a dog without the
  1 10 consent of the dog's owner, and intends to deprive the owner
  1 11 of the possession or control of the dog, the person commits a
  1 12 serious misdemeanor.  However, a person does not commit theft
  1 13 of a dog if the dog is killed while attacking a person or
  1 14 another animal, or the dog is humanely destroyed pursuant to
  1 15 Code section 351.37 or 351.39, or the person has the right or
  1 16 authority to destroy the dog.
  1 17    A serious misdemeanor is punishable by confinement for no
  1 18 more than one year and a fine of at least $250 but not more
  1 19 than $1,500.
