1 1 Section 1. Section 8.57, subsection 5, paragraph c, Code
1 2 1999, is amended to read as follows:
1 3 c. (1) Moneys in the fund in a fiscal year shall be used
1 4 as directed by the general assembly for public vertical
1 5 infrastructure projects. For the purposes of this subsection,
1 6 "vertical infrastructure" includes only land acquisition and
1 7 construction, major renovation and major repair of buildings,
1 8 all appurtenant structures, utilities, site development, and
1 9 recreational trails. "Vertical infrastructure" does not
1 10 include routine, recurring maintenance or operational expenses
1 11 or leasing of a building, appurtenant structure, or utility
1 12 without a lease-purchase agreement. However, appropriations
1 13 may be made for the fiscal years beginning July 1, 1997, and
1 14 July 1, 1998, for the purpose of funding the completion of
1 15 Part III of the Iowa communications network.
1 16 (2) Commencing with the fiscal year beginning July 1,
1 17 2000, and ending June 30, 2001, at least one-fourth of all
1 18 moneys available in the fund for a fiscal year shall be used
1 19 for public vertical infrastructure projects that involve major
1 20 renovation or major repair to correct life, safety, or fire
1 21 hazards. This requirement shall not apply if the estimated
1 22 total cost of such projects in a fiscal year is less than one-
1 23 fourth of the total amount of moneys available in the fund for
1 24 the fiscal year.
1 25 EXPLANATION
1 26 This bill amends Code section 8.57 to require that,
1 27 beginning with fiscal year 2001, one-fourth of all moneys
1 28 available in the rebuild Iowa infrastructure fund in a fiscal
1 29 year be used for public vertical infrastructure projects that
1 30 involve major renovation or major repair to correct life,
1 31 safety, or fire hazards. The requirement does not apply if
1 32 the total costs of such projects in a fiscal year is less than
1 33 one-fourth of the total amount of moneys available in the fund
1 34 for the fiscal year.
1 35 Code section 8.57 currently defines "vertical
2 1 infrastructure" to include only land acquisition and
2 2 construction, major renovation and major repair of buildings,
2 3 all appurtenant structures, utilities, site development, and
2 4 recreational trails.
