  1  4 RELATING TO THE ROLE OF AN AUCTIONEER IN CONDUCTING A PUBLIC
  1  5    SALE OR AUCTION INVOLVING REAL PROPERTY.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 543B.7, subsection 5, Code 1999, is
  1 10 amended to read as follows:
  1 11    5.  The acts of an auctioneer in conducting a public sale
  1 12 or auction.  The auctioneer's role must be limited to
  1 13 establishing the time, place, and method of an auction,;
  1 14 advertising the auction including a brief description of the
  1 15 property for auction, and the time and place for the auction,
  1 16 and the name and address of the real estate broker or attorney
  1 17 who is providing brokerage services for the transaction and
  1 18 who is also responsible for closing the sale of the property;
  1 19 and crying the property at the auction.  If the auctioneer
  1 20 closes or attempts to close the sale of the property or
  1 21 otherwise engages in acts defined in sections 543B.3 and
  1 22 543B.6, then the requirements of this chapter do apply to the
  1 23 auctioneer.
