  1  4 RELATING TO REIMBURSEMENT, PAYMENT, AND COVERAGE BY THE STATE
  1  5    FOR DAMAGES INVOLVING INDIVIDUALS PROVIDING FOSTER HOME,
  1  6    GUARDIAN, OR CONSERVATOR SERVICES AND PROVIDING AN EFFECTIVE
  1  7    DATE.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 237.13, subsection 3, Code 1999, is
  1 12 amended to read as follows:
  1 13    3.  Except as provided in this section, the fund shall pay,
  1 14 on behalf of each licensed foster home, any valid and approved
  1 15 claim of foster children, their parents, guardians, or
  1 16 guardians ad litem, for damages arising from the foster care
  1 17 relationship and the provision of foster care services.  The
  1 18 fund shall also reimburse compensate licensed foster homes for
  1 19 property damage, at replacement cost, or for bodily injury, as
  1 20 a result of the activities of the foster child, and reasonable
  1 21 and necessary legal fees incurred in defense of civil claims
  1 22 filed pursuant to subsection 7, paragraph "d", and any
  1 23 judgments awarded as a result of such claims.
  1 24    Sec. 2.  Section 237.13, subsection 4, paragraph g, Code
  1 25 1999, is amended by striking the paragraph.
  1 26    Sec. 3.  Section 237.13, subsection 4, paragraph h, Code
  1 27 1999, is amended by striking the paragraph.
  1 28    Sec. 4.  Section 237.13, subsection 6, Code 1999, is
  1 29 amended to read as follows:
  1 30    6.  The fund is not liable for the first seventy-five one
  1 31 hundred dollars of any claim based on a single occurrence for
  1 32 all claims arising out of one or more occurrences during a
  1 33 fiscal year related to a single foster home.  The fund is not
  1 34 liable for damages in excess of three hundred thousand dollars
  1 35 for a single foster home for all claims arising out of one or
  2  1 more occurrences during a calendar fiscal year related to a
  2  2 single home.
  2  3    Sec. 5.  TRANSITION TO FISCAL YEAR.  The limit on foster
  2  4 home liability established in section 237.13, subsection 6, in
  2  5 effect for the calendar year beginning January 1, 1999, shall
  2  6 apply through June 30, 1999.  This section of this Act, being
  2  7 deemed of immediate importance, takes effect upon enactment.
