  1  1    Section 1.  Section 80A.1, Code 1999, is amended by adding
  1  2 the following new subsections:
  1  3    NEW SUBSECTION.  0A.  "Alarm system agency" means a person
  1  4 engaged in the alarm system business.
  1  5    NEW SUBSECTION.  0B.  "Alarm system business" means the
  1  6 business of providing, for a fee or other valuable
  1  7 consideration, the installation of electronic or mechanical
  1  8 alarm signal devices, burglar alarms, television cameras or
  1  9 still cameras, or electronic access control systems used to
  1 10 manually or automatically signal or detect burglary, breaking
  1 11 and entering, shoplifting, pilferage, theft, or hold-up; and
  1 12 the servicing or monitoring of such systems, or the design of
  1 13 such installations, including surveys of premises to be
  1 14 protected.  An alarm system business does not include a
  1 15 locksmith business.
  1 16    NEW SUBSECTION.  7A  "Locksmith business" means the
  1 17 business of making, repairing, and installing locks, re-keying
  1 18 locks, opening locks or safes, and changing safe or lock
  1 19 combinations; or the making, repairing, and installing of
  1 20 access control systems which are not attached to an electronic
  1 21 integrated system that directly or indirectly causes a
  1 22 response by a law enforcement or security agency.
  1 23    Sec. 2.  Section 80A.2, Code 1999, is amended by adding the
  1 24 following new subsections:
  1 25    NEW SUBSECTION.  10.  A person engaged in the business of
  1 26 over-the-counter sales of alarm systems for installation by
  1 27 the purchaser.
  1 28    NEW SUBSECTION.  11.  A person engaged in the performance
  1 29 of activities typically performed by a locksmith who is
  1 30 employed by a locksmith business.
  1 31    Sec. 3.  Section 80A.3, subsections 1 and 2, Code 1999, are
  1 32 amended to read as follows:
  1 33    1.  A person shall not operate a an alarm system business,
  1 34 bail enforcement business, private investigation business, or
  1 35 private security business, or otherwise employ persons in the
  2  1 operation of such a business located within this state unless
  2  2 the person is licensed by the commissioner in accordance with
  2  3 this chapter.
  2  4    2.  A license issued under this chapter, other than an
  2  5 alarm system business license, expires two years from the date
  2  6 issued.  An alarm system business license expires four years
  2  7 from the date issued.
  2  8    Sec. 4.  Section 80A.4, subsection 3, Code 1999, is amended
  2  9 by striking the subsection.
  2 10    Sec. 5.  Section 80A.5, subsection 3, Code 1999, is amended
  2 11 to read as follows:
  2 12    3.  The fee for a two-year license for a bail enforcement
  2 13 business, a private investigative agency, or a private
  2 14 security agency, or for a four-year license for an alarm
  2 15 system business, is one hundred dollars.
  2 16    Sec. 6.  NEW SECTION.  80A.6A  BACKGROUND INVESTIGATIONS.
  2 17    Each employee of an applicant or licensee regulated by this
  2 18 chapter shall possess the qualifications required by section
  2 19 80A.4, subsection 1.  A person applying for employment on or
  2 20 after the effective date of this Act shall not be employed by
  2 21 an agent to work in any business regulated by this chapter
  2 22 until the agency has completed a background investigation into
  2 23 the character of the employee.  The background investigation
  2 24 shall include a local criminal record check with local law
  2 25 enforcement agencies, and the submission of fingerprints to
  2 26 the department of public safety for the purpose of conducting
  2 27 a state and federal criminal record check on the applicant.
  2 28 Each fingerprint submission shall include a fee as established
  2 29 by the department by rule to offset the cost of such checks.
  2 30    Sec. 7.  Section 80A.7, subsection 1, Code 1999, is amended
  2 31 to read as follows:
  2 32    1.  The department shall issue to each licensee in the bail
  2 33 enforcement business, private investigation business, or
  2 34 private security business, and to each employee of the
  2 35 licensee, an identification card in a form approved by the
  3  1 commissioner.  The application for a permanent identification
  3  2 card shall include a temporary identification card valid for
  3  3 fourteen days from the date of receipt of the application by
  3  4 the applicant.
  3  5    Sec. 8.  Section 80A.7, Code 1999, is amended by adding the
  3  6 following new subsection:
  3  7    NEW SUBSECTION.  5.  An alarm system agency shall issue an
  3  8 identification card to each employee engaged in the alarm
  3  9 system business.  The identification card shall include the
  3 10 name of the employee and the employee's picture as well as the
  3 11 name, address, and telephone number of the agency.  Alarm
  3 12 system employees shall have their identification card in their
  3 13 immediate possession when engaged in the alarm system
  3 14 business, and shall produce such card upon request of their
  3 15 clients, prospective clients, or law enforcement agencies.
  3 16    Sec. 9.  Section 80A.10, subsection 1, paragraph a, Code
  3 17 1999, is amended to read as follows:
  3 18    a.  Five thousand dollars in the case of an agency licensed
  3 19 to conduct only an alarm system business, a bail enforcement
  3 20 business, private security business, or a private
  3 21 investigation business.
  3 22    Sec. 10.  Section 80A.10A, Code 1999, is amended to read as
  3 23 follows:
  3 24    80A.10A  LICENSEE'S PROOF OF FINANCIAL RESPONSIBILITY.
  3 25    Notwithstanding the minimum bond amount that must be filed
  3 26 in accordance with section 80A.10, a license shall not be
  3 27 issued unless the applicant furnishes proof acceptable to the
  3 28 commissioner of the applicant's ability to respond in damages
  3 29 for liability on account of accidents or wrongdoings occurring
  3 30 subsequent to the effective date of the proof, arising out of
  3 31 the ownership and operation of a private security business,
  3 32 private investigation business, or bail enforcement business.
  3 33 An alarm system business shall hold and maintain a liability
  3 34 insurance policy in the amount of one million dollars.
  3 35    Sec. 11.  Section 80A.16, subsection 2, paragraph c, Code
  4  1 1999, is amended to read as follows:
  4  2    c.  Falsely advertises that the person is a licensed alarm
  4  3 system agent, private investigator, private security agent, or
  4  4 bail enforcement agent.
  4  5    Sec. 12.  Section 80A.16, subsection 3, Code 1999, is
  4  6 amended to read as follows:
  4  7    3.  A person who is subject to the licensing requirements
  4  8 of this chapter and who engages in an alarm system business, a
  4  9 private investigation business, or private security business
  4 10 as defined in this chapter, without possessing a current valid
  4 11 license as provided by this chapter, is guilty of a serious
  4 12 misdemeanor.
  4 13    Sec. 13.  EFFECTIVE DATE.  This Act takes effect January 1,
  4 14 2000.
