PAG LIN 1 1 Section 1. Section 405A.3, subsection 1, paragraph b, Code 1 2 1999, is amended to read as follows: 1 3 b. The ratio of the population of each city to the total 1 4 population of all cities in the state, multiplied by twenty- 1 5 seven million three hundred thousand dollars. Of the moneys 1 6 allocated pursuant to this paragraph, ten million six hundred 1 7 thousand dollars represents a portion of the state profits 1 8 from the sale of alcoholic liquors and this portion of the 1 9 allocation which represents state alcoholic liquor profits 1 10 shall be remitted by each city to the appropriate county board 1 11 of health which shall distribute the moneys in accordance with 1 12 the needs identified through a substance abuse needs 1 13 assessment for the treatment, rehabilitation, and education 1 14 for persons who are substance abusers or at risk for substance 1 15 abuse in this state. The population of each city shall be 1 16 determined by the latest available federal census. A city may 1 17 have one special federal census taken each decade, and the 1 18 population figure obtained shall be used in apportioning 1 19 amounts under this subsection beginning the calendar year 1 20 following the year in which the special census is certified to 1 21 the secretary of state. If a city has annexed territory since 1 22 the last regular or special federal census, the mayor and 1 23 council shall certify to the treasurer of state the actual 1 24 population of the annexed territory as determined by the last 1 25 certified federal census of the territory and the 1 26 apportionment of funds under this subsection shall be based 1 27 upon the population of the city as modified by the 1 28 certification of the population of the annexed territory until 1 29 the next regular or special federal census enumeration. 1 30 EXPLANATION 1 31 This bill provides that of the $27.3 million allocation of 1 32 state funds annually to cities to replace personal property 1 33 taxes, the sum of $10.6 million represents a portion of the 1 34 state profit from the sale of alcoholic liquors. The 1 35 proportionate amount of these moneys allocated to cities in a 2 1 county shall be used under the direction of the county board 2 2 of health for the treatment, rehabilitation, and education of 2 3 persons who are substance abusers or at risk for substance 2 4 abuse in this state. 2 5 LSB 1553HH 78 2 6 tj/gg/8
